Operative words
1. All persons shall wear a mask or face covering that covers their nose and mouth, such as a fabric or surgical mask, whenever they are indoors on the premises of a business, club, place of assembly or other place that is open to members of the public, including but not limited to retail establishments, restaurants, bars, performance venues, social clubs, event spaces, and municipal buildings. 2. Restaurant, indoor bar, and dance venue customers may only remove face coverings when they are actively eating or drinking. Patrons standing or ordering at the bar must be masked. Guests must be masked on indoor dance floors.... 7. This Order shall take effect on 8:00 a.m. on August 27th, 2021 and remain in effect until rescinded by the Executive Director, in their discretion.
Enforcement
'this Order may be enforced through an order of a court of competent jurisdiction. The Executive Director may seek the assistance of other City of Boston agencies'; 'Failure to comply with any of the provisions of this Order constitutes an imminent and immediate threat to public health'
Notes
Recites CDC community transmission in Suffolk County 'categorized as high' for Aug. 9-15, 2021, the Delta variant, and that 'fully vaccinated individuals can spread the virus to others'. Exemptions: private residences without compensation; children under two; medical inability; performers six feet from customers.
