Operative words
Section 3.B. of Executive Order Number 20-112 allows restaurants and food establishments licensed under Chapters 500 or 509, Florida Statutes, to resume on-premise consumption of food and beverages, so long as they adopt appropriate social distancing measures and limit their indoor occupancy to no more the 25 percent of their building occupancy... it is necessary and appropriate to exercise the emergency powers authorized by City Code during the state of local emergency to facilitate and encourage outdoor seating areas to make restaurants safer to operate
