The record in brief

Florida's regime ran through a single emergency predicate and a short, sharp closure phase followed by the earliest and most complete reopening of any large State, then a fourteen-month period in which the State itself imposed no general business restriction while it progressively stripped counties and cities of the power to impose their own. The predicate: the State Surgeon General declared a public health emergency on March 1, 2020 at the Governor's direction (EO 20-51), the Governor declared a state of emergency on March 9, 2020 (EO 20-52), and the emergency was renewed every sixty days (EO 20-114, 20-166, 20-192, 20-213, 20-276, 20-316, 21-45, 21-94) until the last renewal, issued April 27, 2021, ran out on June 26, 2021; the Governor did not renew it again, and every executive order that by its terms lasted 'for the duration of Executive Order 20-52' lapsed with it. The closure phase (2020 Q1-Q2 proof): EO 20-68 (Mar. 17) shut bars deriving more than half their revenue from alcohol for thirty days and cut restaurants to 50 percent; EO 20-70 (Mar. 20) closed on-premises food and drink service, theaters, gyms and beaches in Broward and Palm Beach; EO 20-71 (Mar. 20) suspended on-premises food consumption statewide, closed all gyms and fitness centers and confined alcohol to sealed off-premises sales (with to-go alcohol permitted for restaurants); EO 20-72 (Mar. 20) prohibited every hospital, ambulatory surgical center, office surgery center and 'dental, orthodontic and endodontic office' from performing 'any medically unnecessary, non-urgent or non-emergency procedure or surgery'; DEM Orders 20-002 (Mar. 11) and 20-006 (Mar. 15) barred visitation at every nursing home, assisted living facility, group home and long-term care hospital; EO 20-80, 20-82 and 20-86 (Mar. 23-27) imposed a fourteen-day isolation on travelers from the New York tri-State area and Louisiana, enforced by a second-degree misdemeanor and highway checkpoints; EO 20-87 (Mar. 27) prohibited vacation-rental check-ins; EO 20-89 (Mar. 30) ordered Miami-Dade, Broward, Palm Beach and Monroe Counties to close public access to every business 'deemed non-essential' under Miami-Dade Emergency Order 07-20; and EO 20-91 (Apr. 1, effective 12:01 a.m. Apr. 3) ordered that 'all persons in Florida shall limit their movements and personal interactions outside of their home to only those necessary to obtain or provide essential services or conduct essential activities,' defined essential services by the CISA list and the Miami-Dade list, forbade public gatherings of more than ten, and (as amended by EO 20-92) superseded 'any conflicting official action or order issued by local officials.' Reopening (2020 Q2): EO 20-112 (Apr. 29, eff. May 4) kept Safer at Home for seniors and the vulnerable, opened restaurants and retail at 25 percent, kept bars, gyms and vacation rentals closed and let elective procedures resume only on PPE and surge-capacity conditions, excluding Miami-Dade, Broward and Palm Beach; EO 20-120 (May 9, eff. May 11) opened barbershops and salons and moved Palm Beach into Phase 1; EO 20-122 moved Broward and Miami-Dade into Phase 1 on May 18; EO 20-123 (Full Phase 1, eff. May 18) raised restaurants, retail, museums and gyms to 50 percent and opened vacation rentals county by county; EO 20-139 (Phase 2, eff. June 5) opened bars at 50 percent with seated service, entertainment venues at 50 percent and personal services, with the three southeast counties excluded until they asked; DBPR Emergency Order 2020-09 (June 26) re-closed on-premises alcohol at bars statewide and DBPR Emergency Order 2020-10 (Sept. 10, eff. Sept. 14) reopened them at 50 percent. Every order in this phase carried the section 252.50 penalty: 'a second-degree misdemeanor... punishable by imprisonment not to exceed 60 days, a fine not to exceed $500, or both.' 2020 Q3: the travel isolation orders were rescinded by EO 20-192 (Aug. 5); Phase 2 capacity caps, the bar closure (to Sept. 14), the LTC visitation ban (partially relaxed by DEM 20-009 on Sept. 1), the eviction and foreclosure suspension (EO 20-94 as extended and narrowed through Oct. 1, 2020) and the local mask and capacity orders all ran; the quarter ended with EO 20-244 (Sept. 25), which 'supersedes and eliminates any and all restrictions of Executive Orders 20-112, 20-123 and 20-139,' forbade any local emergency order from preventing 'an individual from working or from operating a business' or cutting restaurants below 50 percent, and suspended 'the collection of fines and penalties associated with COVID-19 enforced upon individuals.' 2020 Q4 and 2021 Q1 (no statewide re-tightening): EO 20-297 (Nov. 25) extended Phase 3 for the duration of the emergency; DEM 20-011 (Oct. 22) kept the LTC visitation restrictions until DEM 21-001 rescinded them on March 22, 2021; the Florida Supreme Court kept every circuit in Phase 2 operations under AOSC20-23 and AOSC20-32 as amended, with jury trials resuming only under approved local plans; EO 20-315 (Dec. 23) confined vaccination to seniors, LTC residents and staff and health-care personnel; local mask orders continued without individual fines. 2021 Q2: EO 21-81 (Apr. 2) barred vaccine passports; on May 3, 2021 the Governor signed SB 2006 (Ch. 2021-8), issued EO 21-102 suspending 'all local COVID-19 restrictions and mandates on individuals and businesses' immediately and EO 21-101 invalidating every remaining local COVID emergency order effective July 1, 2021; the emergency lapsed June 26, 2021; the Supreme Court's AOSC21-17 (June 4) replaced the pandemic operating orders with health-and-safety protocols from June 21, 2021. 2021 Q3: Florida imposed no general business restriction, but four force-of-law instruments limited commerce, meetings and the workforce: section 381.00316 (eff. July 1, 2021; $5,000 per violation) prohibited every business from requiring proof of vaccination for 'access to, entry upon, or service from' its operations; EO 21-175 (July 30) and DOH Emergency Rule 64DER21-12 (Aug. 6) governed every public school's COVID protocols, required parental opt-outs from masks and kept exposed students out of school for four to seven days; 64DER21-15 (Sept. 22) replaced it with a parental-choice quarantine of up to seven days; and AOSC21-17 as amended July 29, 2021 governed every in-person court proceeding. Local orders were void; the federal layer (the CDC conveyance mask order, the TSA directives, the OSHA Healthcare ETS, the CMS conditions) ran throughout the quarter.

What remained in force

After Sept. 25, 2020: the state of emergency and every order tied to it (EO 20-69 public-meeting suspension to Nov. 1, 2020; the DEM long-term-care visitation restrictions, DEM 20-011, to Mar. 22, 2021); local mask and capacity orders without individual fines and with restaurants at no less than 50 percent (to May 3, 2021); the Florida Supreme Court's Phase 2 court operations (AOSC20-23/20-32 as amended, to June 21, 2021); the eviction/foreclosure final-action suspension to Oct. 1, 2020 (EO 20-211, then the CDC order). After June 26, 2021: section 381.00316 (vaccine-documentation ban, eff. July 1, 2021); EO 21-175 and DOH Emergency Rules 64DER21-12 (Aug. 6, 2021) and 64DER21-15 (Sept. 22, 2021) on school masking and quarantine; AOSC21-17 as amended (July 29, 2021) for every court proceeding; section 252.38(4) limits on any new local order; the federal instruments.

Preemption of local orders

Florida preempted local orders in four steps. (1) EO 20-91 s. 4 (Apr. 1, 2020) superseded local orders 'only to the extent that such action or order allows essential services or essential activities prohibited by this Executive Order'; EO 20-92 (Apr. 1, 2020) rewrote s. 4 to read 'This Order shall supersede any conflicting official action or order issued by local officials in response to COVID-19' (a ceiling as well as a floor). (2) EO 20-244 s. 2-4 (Sept. 25, 2020): 'No COVID-19 emergency ordinance may prevent an individual from working or from operating a business'; restaurants 'may not be limited by a COVID-19 emergency order by any local government to less than fifty percent (50%) of their indoor capacity'; the collection of COVID-19 fines and penalties 'enforced upon individuals' suspended. Local mask orders on businesses, curfews and capacity rules at or above 50 percent survived until step 3. (3) EO 21-102 (May 3, 2021): 'all local COVID-19 restrictions and mandates on individuals and businesses are hereby suspended'; 'eliminates and supersedes any existing emergency order or ordinance issued by a county or municipality that imposes restrictions or mandates upon businesses or individuals due to the COVID-19 emergency'; no county or municipality 'may renew or enact' such an order for the rest of the emergency; superseded EO 20-244 ss. 2-3. (4) SB 2006, Ch. 2021-8, Laws of Fla., s. 12 (eff. July 1, 2021), creating s. 252.38(4): a local emergency order 'automatically expires 7 days after issuance' and may be extended 'for a total duration of not more than 42 days'; 'The Governor may, at any time, invalidate an emergency order issued by a political subdivision'; 'Upon the expiration of an emergency order, a political subdivision may not issue a substantially similar order'; and EO 21-101 (May 3, 2021, eff. July 1, 2021) invalidated every COVID-19 local emergency order enacted before July 1, 2021. Ordinances adopted by regular (non-emergency) procedure were left to the counties (EO 21-102 s. 4). School-district mask rules of August-September 2021 were reached not by ch. 252 but by EO 21-175 and the DOH rules under s. 1003.22(3) and the Parents' Bill of Rights (Ch. 2021-199).

Travel and quarantine

Mar. 23, 2020 air travelers from NY/NJ/CT to isolate 14 days (FL-011, recited); Mar. 24 all persons entering from areas of substantial spread including the tri-State area (FL-012); Mar. 27 Louisiana, I-10 and I-95 checkpoints (FL-015); extended by FL-022 and FL-034 with commercial-activity exceptions; rescinded Aug. 5, 2020 (FL-042); no State travel rule after Aug. 5, 2020.

Face coverings

No statewide mask mandate at any time; DOH advisory June 20, 2020: 'All individuals in Florida should wear face coverings in any setting where social distancing is not possible' (FL-035); local mask orders (Miami-Dade, Broward, Palm Beach, Orange, Hillsborough, Pinellas, Alachua, Leon, Duval and others) from Apr.-June 2020, individual fines suspended Sept. 25, 2020 (FL-047 s. 4), business obligations suspended May 3, 2021 (FL-060); school mask opt-out rules Aug.-Sept. 2021 (FL-032, FL-033).

Vaccination mandates

None imposed by the State; Florida prohibited them: EO 21-81 (Apr. 2, 2021) barred businesses from requiring vaccination documentation of patrons (FL-056); s. 381.00316 (July 1, 2021) barred businesses, governments and schools from requiring it, $5,000 per violation (FL-030); EO 20-315 (Dec. 23, 2020) restricted who could be vaccinated (FL-052); county and city employee mandates of July-Sept. 2021 (Orange, Leon, Gainesville) were local and were fined or enjoined.

Standing duties

The statutes, codes and penalty provisions of Florida that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Florida duties →

Florida's emergency orders drew their compulsory force from standing statutes that predate the pandemic and outlasted every order. Section 252.36(1)(b) gives the Governor's executive orders 'the force and effect of law'; section 252.36(5)(g) and (k) authorize control of 'the occupancy of premises' and 'the calling of public meetings and gatherings'; section 252.46(2) gives county and municipal emergency orders 'full force and effect of law' on filing with the clerk; section 252.47 commands that 'the law enforcement authorities of the state and the political subdivisions thereof shall enforce the orders and rules'; and section 252.50 makes violation of 'any rule or order' a second-degree misdemeanor. Section 381.00315 charges the Department of Health with 'the duty and the authority to declare, enforce, modify, and abolish the isolation and quarantine of persons, animals, and premises,' requires rules on 'the closure of premises' and 'the disinfection of... premises,' and punishes violation of 'any requirement adopted by the department pursuant to a declared public health emergency' as a second-degree misdemeanor; Rule 64D-3.038 defines quarantine 'actions' to include 'closure of premises, testing,... disinfection.' Florida has no OSHA-approved State plan and the 2020 Florida Statutes contain no chapter 442; the workplace duty binding every private employer in the State throughout the six quarters is 29 U.S.C. 654(a)(1) and (2). Chapter 386 makes 'the keeping, maintaining,... or permission of anything... by which... disease may be caused' a sanitary nuisance punishable as a misdemeanor, and chapter 509 requires every lodging and food-service establishment to be 'operated with strict regard to the health, comfort, and safety of the guests' on pain of fines, suspension and closure. On March 29, 2021 the Legislature enacted section 768.38, which confers civil immunity on a business only if it 'made a good faith effort to substantially comply with authoritative or controlling government-issued health standards or guidance at the time the cause of action accrued,' retroactive to causes of action that accrued in 2020. The State's reopening orders (Exs. FL-022, FL-027, FL-034) made every reopening conditional ('so long as,' 'only if,' 'if they... abide by the safety guidelines issued by the CDC and OSHA') and recited enforcement under sections 252.47 and 252.50, and EO 20-139 marked in terms which of its provisions were 'guidance and not enforceable' and which were not. Two courts of the period held the orders to be valid exercises of the police power under section 252.36 and the county mask orders to be within the police power to 'prevent the spread of infectious or contagious diseases' (Henry v. DeSantis, S.D. Fla. May 11, 2020; Machovec v. Palm Beach County, Fla. 4th DCA Jan. 27, 2021).

Whether the measures Florida employers took beyond the four corners of the emergency orders were voluntary (Notice 2021-20, Q&A-14) or were compelled by standing law: the communicable-disease statute and rules, the Emergency Management Act's force-of-law and penalty provisions, the workplace-safety duty, the liability-shield condition, the sanitary-nuisance and lodging-and-food-service codes, and the operating conditions the State's own orders attached to lawful operation.
