Operative words

Professional Services are required to mandate that employees work from home when possible... In Phase 1 and 2 occupancy is 25% of fire marshal capacity or 200 people (whichever is fewer) if six feet of physical distance can be maintained. In Phase 3 occupancy is 50% of fire marshal capacity or 400 people (whichever is fewer) if six feet of physical distance can be maintained.... Prior to recommencing on-site services, all professional service providers and employer-owners are required to develop at each establishment, a comprehensive COVID-19 exposure control, mitigation, and recovery plan.

Incorporated by reference in Proclamation 20-25 et seq. (violations a gross misdemeanor under RCW 43.06.220(5)); WAC 296-800-14035 makes non-compliance a workplace safety violation enforceable by L&I

Notes

The operative telework words for offices: 'required to mandate that employees work from home when possible'; office occupancy 25% (Phases 1-2) and 50% (Phase 3, added March 19, 2021). The Safe Start plan (Ex. WA-034) carried the Phase 2 formulation 'telework remains strongly encouraged' and Proclamation 20-25.8 (Ex. WA-047) para. 13 the November 2020 mandate.
