The record in brief

Washington was the first State in the Union with a confirmed COVID-19 case, the first with a fatal outbreak (Life Care Center of Kirkland) and, on February 29, 2020, the first to proclaim a statewide emergency (Proclamation 20-05, Ex. WA-001), which ran without interruption through September 30, 2021 and was not terminated until October 31, 2022. The March 2020 run-up was a cascade of statewide prohibitions: gatherings of 250 or more (20-07, 20-11), then 50 or more (20-14); every K-12 school closed from March 17 (20-08, 20-09) for the balance of the school year (20-09.1, to June 19, 2020); every college barred from in-person classes (20-12); every restaurant, bar, coffee shop, catered event, theater, gym, card room, barbershop, salon, tattoo parlor and pool hall closed to on-site service on March 16 (20-13); long-term care facilities closed to visitors (20-06, 20-16); driver-licensing offices closed to in-person business (20-15); residential evictions barred (20-19); utility disconnections barred (20-23); and, on March 19, every hospital, ambulatory surgical center and dental, orthodontic and endodontic office prohibited from performing any procedure that could be delayed three months without harm (20-24). On March 23, 2020, Proclamation 20-25 (Ex. WA-016) ordered 'all people in Washington State' to 'immediately cease leaving their home or place of residence' except for essential activities and essential work, prohibited every public and private gathering 'regardless of the number of people involved,' and, from midnight March 25, ordered 'all non-essential businesses in Washington State [to] cease operations except for performing basic minimum operations,' defined to include 'facilitat[ing] employees of the business being able to continue to work remotely from their residences.' Non-essential construction and manufacturing stopped; construction restarted in phases from April 24 (Ex. WA-029); outdoor recreation and golf reopened May 5 (20-25.2); curbside retail, vehicle sales, landscaping, car washes and pet walking reopened in early May (20-25.3). The stay-home order was extended to May 4 and May 31, 2020 and on June 1 was renamed, not lifted: Proclamation 20-25.4 (Ex. WA-035) kept 'all of the prohibitions' in force 'except as otherwise provided' in the county-by-county Safe Start plan, added a universal employee face-covering mandate from June 8, and required every employer to comply with L&I's rule WAC 296-800-14035, which makes every proclamation condition a workplace-safety duty. Under Safe Start (Ex. WA-034) counties moved through Phases 1-3 (retail 30 percent, restaurants 50 percent with tables of five and no bar seating, offices with telework 'strongly encouraged,' gatherings of five per week in Phase 2 and 50 in Phase 3); no county ever reached Phase 4; phase advancement was frozen June 27; the Secretary of Health's Order 20-03 (June 24, 2020; Ex. WA-037) required every person to mask in every indoor and outdoor public setting; Proclamation 20-25.6 (July 7) prohibited any business from serving an unmasked customer and any employer from operating without cooperating in case investigations; the July 24 revision (20-25.7 and Order 20-03.1) closed bars to indoor service, cut Phase 3 gatherings to 10 and prohibited live entertainment; agricultural employers could operate only under the Agriculture COVID-19 Requirements from June 3, 2020 (20-57) and only if they provided COVID-19 paid leave from August 18 (20-67); long-term care moved to a phased visitation regime (20-66, Aug. 7, 2020) that remained in force through Q3 2021 (20-66.5). The winter 2020-21 re-tightening came by Proclamation 20-25.8 (Nov. 15, 2020; Ex. WA-047), effective November 17: indoor social gatherings prohibited absent quarantine, indoor dining closed, gyms closed, movie theaters, museums, zoos and bowling closed, business meetings and retail events at venues prohibited, open houses prohibited, in-store retail and personal services at 25 percent, religious services at 25 percent or 200, weddings and funerals at 30 with receptions prohibited, and 'Professional Services are required to mandate that employees work from home when possible and close offices to the public if possible,' with any open office at 25 percent; the rollback was extended three times (20-25.9,.10,.11) to January 11, 2021, when Healthy Washington - Roadmap to Recovery (20-25.12; Ex. WA-056) put every region in Phase 1 (indoor dining still prohibited; retail, offices and personal services at 25 percent; indoor gatherings prohibited; indoor entertainment general admission prohibited). Phase 2 (indoor dining 25 percent; alcohol service ending 11 p.m.; 25 percent/200 caps) reached most regions in February; Phase 3 (50 percent caps; alcohol ending midnight; gatherings of 10 indoors and 50 outdoors; spectator events with caps) began March 22 by county and, after a two-week pause on May 4, statewide on May 18, 2021 (20-25.13), running 'until June 30.' The variant-country traveler quarantine (20-83, Dec. 21, 2020; 14 days) became a mandate to comply with the CDC's international air-travel rules (20-83.1, Mar. 1; 20-83.2, Apr. 6, 2021) that the State's own Washington Ready plan still listed as a requirement in September 2021. The general business restrictions ended with Proclamation 20-25.14, 'Washington Ready' (July 1, 2021; Ex. WA-072), which lifted 'movement, occupancy, and face-covering restrictions' except large indoor events over 10,000 (75 percent unless vaccination verified), the face-covering order for unvaccinated persons and for schools, health care, correctional, shelter and transit settings, employer vaccination-verification duties before any worker could go unmasked, L&I's workplace rules, the traveler rules, long-term care rules, the K-12 and higher-education conditions, the evictions bridge (21-09, July 1 - Sept. 30, 2021, extended to Oct. 31), the utility-disconnection bar (to Sept. 30, 2021) and the Open Public Meetings Act prohibitions. Q3 2021 then re-tightened in law, not in advice: Proclamation 21-14 (Aug. 9) prohibited every health care provider and State worker from working unvaccinated after October 18, 2021 and 21-14.1 (Aug. 20) extended it to every K-12 school, child care program and college employee; Order 20-03.4 (Aug. 19, effective Aug. 23) and Proclamation 20-25.15 (Aug. 20, effective Aug. 23) reimposed indoor face coverings on every person regardless of vaccination status and prohibited every business and entity from admitting an unmasked person; Order 20-03.5 and Proclamation 20-25.17 (Sept. 13) extended the requirement to outdoor events of 500 or more; 20-09.4 (July 30) made in-person K-12 instruction lawful only under DOH masking, distancing and quarantine requirements; 21-15 (Sept. 3) waived nursing-home transfer rules because 'the Delta variant of COVID-19 is placing unprecedented demands on our health care system'; the Supreme Court's Order 25700-B-658 kept remote-proceeding presumptions on every court and Order 25700-B-669 (Aug. 18) mandated vaccination for court workers. Washington never preempted local orders; it expressly preserved more restrictive local requirements, prohibited local governments from interfering with business-imposed mask and vaccination-proof rules (20-25.16, Sept. 3, 2021), and froze the structure of local health jurisdictions (20-78, Dec. 14, 2020). Preemption of local orders

None. Washington never preempted or barred local COVID-19 orders; State law layered them. Local health officers hold independent authority under RCW 70.05.070 (recited as a basis of every Secretary of Health order), and the Governor's proclamations repeatedly preserved stricter local rules: Proclamation 20-25.8 (Nov. 15, 2020) provides 'If current guidance is more restrictive than the below listed restrictions, the most restrictive guidance shall apply'; Order 20-03 (June 24, 2020) provides that where the order 'and the action of any other agency or official are in conflict, the more protective' requirement governs; Proclamation 20-25.13 (May 21, 2021) provides 'Nothing in this proclamation or in the Order of the Secretary of Health 20-03.2 prevents a business owner or local authority from imposing face covering or other restrictions or requirements'; Proclamation 20-25.14 (July 1, 2021) para. 7 and 20-25.17 (Sept. 13, 2021) para. 2 repeat that nothing prevents 'any other individual or entity from imposing more restrictive face covering or additional restrictions or requirements... within the scope of their legal authority'; Proclamations 20-25.13, 20-25.14 and 20-25.16 (Sept. 3, 2021) affirmatively prohibit 'local government agencies, officials, and authorities and landlords' from preventing any business or tenant from imposing face-covering requirements or requiring proof of vaccination and from taking 'any adverse action of any kind' for doing so; and Proclamation 20-78 (Dec. 14, 2020) prohibited any county or city from withdrawing from a combined city-county health department or health district during the emergency, preserving the local health officers who issued and enforced local orders. the Safe Start and Healthy Washington plans themselves operated county-by-county and region-by-region, so a business's lawful capacity depended on its county's phase.

Standing duties

The statutes, codes and penalty provisions of Washington that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Washington duties →

Washington law imposed four standing layers of compulsion on every employer before the first COVID-19 proclamation issued, and the proclamations then poured pandemic content into each of them. (1) Communicable-disease control: RCW 70.05.070(3) and (5) charge every local health officer to 'control and prevent the spread of any dangerous, contagious or infectious diseases' and to 'prevent, control or abate nuisances which are detrimental to the public health'; RCW 70.05.060(4) charges every local board of health to 'provide for the control and prevention of any dangerous, contagious or infectious disease'; RCW 43.20.050 makes the State Board of Health the rule-maker for 'the prevention and control of infectious and noninfectious diseases' and for 'the imposition and use of isolation and quarantine', and subsection (5) commands every officer and employee of the State and its subdivisions to 'enforce all rules adopted by the state board of health'; RCW 43.70.130(3) and (7) direct the Secretary of Health to 'strictly enforce all laws for the protection of the public health' and give the Secretary 'the same authority as local health officers' in an emergency; WAC 246-100-036(3) directs health officers to 'institute disease control and contamination control measures, including... isolation, quarantine,... condemnation of food supplies, and inspection and closure of facilities'; WAC 246-100-040 supplies the isolation and quarantine procedure; WAC 246-101-425 binds 'members of the general public' to 'cooperate with... public health authorities in their investigation and control of cases, outbreaks, and suspected outbreaks; and... implementation of infection control measures'. The penalty is RCW 70.05.120(4) (misdemeanor for 'violating or refusing or neglecting to obey any of the rules, regulations or orders made for the prevention, suppression and control of dangerous contagious and infectious diseases') and WAC 246-100-070(2)-(3). Secretary of Health Order 20-03 (Ex. WA-037) was issued under exactly these provisions and recites exactly these penalties. (2) Emergency orders as offenses: RCW 43.06.220(5) (Ex. LAW-340) makes willful violation of a gubernatorial emergency order a gross misdemeanor; RCW 38.52.150(2) makes 'every violation of any rule, regulation, or order issued under the authority of' the Emergency Management Act a misdemeanor and a second offense a gross misdemeanor; every proclamation in the WA library recites RCW 43.06.220(5) and chapters 38.08, 38.52 and 43.06 RCW. (3) Workplace safety: RCW 49.17.060 (WISHA) commands each employer to 'furnish to each of his or her employees a place of employment free from recognized hazards' and to 'comply with the rules, regulations, and orders promulgated under this chapter'; WAC 296-800-110 ('You must... Provide a workplace free from recognized hazards' (11005), 'Establish, supervise, and enforce rules that lead to a safe and healthy work environment' (11035), 'Protect employees from biological agents' (11045)) and WAC 296-800-140 (a written accident prevention program) are the standing core rules; L&I's emergency rule WAC 296-800-14035 (May 26, 2020, re-adopted through the end of Q3 2021; Exs. AGY-ST-LABOR-WORKPLACE-050 to -056, -078, WA-099, WA-067) made every proclamation condition a WISHA rule ('Employers must comply with all conditions for operation required by emergency proclamation'); DOSH Directive 1.70 (May 15, 2020 and July 7, 2021 versions; Exs. DUT-WA-017, -018) is the enforcement policy ('Employers who continue operations under the Order are required to maintain coronavirus prevention practices consistent with DOSH, OSHA and Department of Health guidance'; 'Employers must institute these prevention program elements or equivalent protections'); L&I publication F414-164-000 (Ex. DUT-WA-016) states the requirements in the agency's own imperative; the Health Emergency Labor Standards Act (ESSB 5115, 2021 c 252; RCW 49.17.062,.064) added the one-business-day exposure-notice duty and the 24-hour outbreak-reporting duty; RCW 49.17.180 (civil penalties to $7,000 per serious violation and $70,000 per willful or repeated violation) and RCW 49.17.190(3) (gross misdemeanor for a willful violation causing death) enforce them. The Ninth Circuit held in Slidewaters LLC v. Washington State Department of Labor & Industries, No. 20-35634 (9th Cir. July 8, 2021) (Ex. DUT-WA-020), that the Governor had authority under RCW 43.06.010(12) and 43.06.220 to issue the proclamations and that L&I 'acted within its scope of authority' in adopting WAC 296-800-14035, which 'creates an enforcement mechanism for the proclamations' restrictions on businesses'. (4) Standard of care: Washington enacted no COVID-19 civil-liability shield for businesses in 2020 or 2021; the standing rule of RCW 5.40.050 therefore governed every negligence claim: 'A breach of a duty imposed by statute, ordinance, or administrative rule... may be considered by the trier of fact as evidence of negligence.' Every proclamation condition, every L&I rule and every Secretary of Health order was such a duty. (5) Sanitary code: the Washington Retail Food Code binds the person in charge of every food establishment (WAC 246-215-02115) and commands a permit holder to 'immediately discontinue operations and notify the regulatory authority if an imminent health hazard might exist' (WAC 246-215-08455). (6) Operating conditions written into the orders: Proclamation 20-25 para. 3(b) ('Essential businesses are prohibited from operating under this Proclamation unless they establish and implement social distancing and sanitation measures established by' OSHA 3990 and the DOH workplace guidance), Proclamations 20-25.4, 20-25.6, 20-25.14 and 20-25.15 ('No employer may operate, allow a customer to enter a business, conduct business, or employ employees unless the employer... complies with all public health authority orders and directives; and... complies with all Department of Labor & Industries interpretive guidance, regulations, and rules'), the Safe Start plan ('All phases - Employers are required to...'), and the Washington Ready requirements sheet (vaccination verification 'Recommended, but not required, for large indoor and outdoor events'; physical distancing 'No requirements').
