The record in brief

ScopeCounty and municipal instruments of the Atlanta metropolitan area (City of Atlanta; Fulton County Board of Commissioners and Board of Health; DeKalb County CEO and Board of Commissioners; Cobb County Board of Commissioners Chairman; Gwinnett County; Clayton County), their courts (Atlanta, Cobb and Clayton Judicial Circuits), school districts, MARTA, and the City of Savannah and Chatham County, March 2020 through September 30, 2021, with the State's preemption history. Statewide instruments of Governor Kemp and the Supreme Court of Georgia are cited by name and date only.

The Atlanta metro's local layer led the State in March 2020 and was displaced by the State on April 3, 2020; the local layer then re-emerged as the metro's mask, gathering, court and facility regime from July 2020 through September 2021, against a Governor who suspended local orders three times (April 2, 2020; July 15, 2020; August 19, 2021). Run-up and 2020 Q2 (wages from March 13, 2020). Atlanta declared an emergency on March 15, 2020 (gatherings over 250), cut the cap to 50 on March 16 (EO 2020-07, Ex. MET-ATL-005), limited restaurant occupancy to 50 (EO 2020-08, Ex. 048), called a 60-day eviction moratorium on City-affiliated housing (EO 2020-10, Ex. 006), closed all dine-in service, bars, nightclubs, gyms, theaters, bowling alleys and arcades effective 12:00 a.m. March 20, 2020 (order of March 19; recited in AO 2020-07, Ex. 049), and ordered every resident to stay at home, every business to cease non-essential operations at physical locations and every non-essential gathering of any number to cease effective 12:00 a.m. March 24, 2020 (EO 2020-21, Ex. 001; re-declared March 26 by EO 2020-22, Ex. 054). South Fulton imposed Georgia's first curfew on March 17. DeKalb County's CEO declared an emergency on March 23, 2020 (EO 20-001, Ex. 022: no dine-in from 12:01 a.m. March 24, business hours 6 a.m.-9 p.m., occupancy of ten at gyms and salons, gatherings of ten barred, employers directed to enable remote work, a 9 p.m.-6 a.m. voluntary curfew) and ordered all residents to stay at home effective 9:00 p.m. March 28 (EO 20-002, Ex. 023). Cobb County's Chairman declared an emergency on March 24, 2020 (Ex. 030: from noon March 25, no dine-in, business hours 6 a.m.-9 p.m., 'all individuals and families are required to shelter in place,' symptomatic persons barred from public places) and on April 2 closed every gym, salon, barber shop, nail salon, spa, tattoo parlor and massage establishment and every other close-contact business (Ex. 032). Gwinnett County and its 16 cities issued a joint stay-at-home order effective 12:01 a.m. March 28, 2020 (AJC). Clayton County extended its emergency and banned gatherings of ten on March 25 and its Board ordered shelter in place from 12:01 a.m. April 1 to 11:59 p.m. April 12, 2020 (Exs. 060, 057). The Fulton County Board of Health, a State public health district acting under O.C.G.A. § 31-3-4 and Ga. Comp. R. & Regs. 511-9-1-.04, resolved on March 24 to close every dine-in restaurant in the county and limit gatherings and direct-contact businesses to fewer than ten (Ex. 018) and on March 31 'commanded' every resident of Fulton County to stay at home under a misdemeanor penalty of up to $1,000 and twelve months in jail (Administrative Order 20.03.31, Ex. 002, with the essential-business addendum, Ex. 003). Savannah declared an emergency on March 19 (bars, gyms, theaters, venues and all guided tours closed; restaurants at 50 percent seating; Ex. 008) and ordered shelter at home on March 24 (Ex. 009). The courts closed first: the Cobb Judicial Circuit declared a judicial emergency on March 13, 2020 (Ex. 033), the Clayton Judicial Circuit on March 16 (Ex. 059), and the Chief Justice's Statewide Judicial Emergency of March 14, 2020 (State) suspended jury trials in every metro court until it expired on June 30, 2021. MARTA moved to rear-door boarding and suspended bus fares from March 19, cut its bus network to 41 routes on April 20, 2020 (Ex. 053), and required masks of every rider by July 2020 (Ex. 055). Preemption. Governor Kemp's EO 04.02.20.01 (April 2, 2020) suspended enforcement of every local order issued since March 1 that 'conflicts, varies, or differs' from the statewide shelter-in-place effective April 3, 2020 (recited verbatim in Savannah's Ex. 010); the statewide order ran to April 30, and the State's reopening orders of April 20 and 23, 2020 (04.20.20.01; 04.23.20.02) replaced local closure orders with the State's business-specific operating requirements. Savannah preserved its shelter order to revive on any lapse of the State's (Ex. 010); DeKalb transitioned by EO 20-003 effective April 24 (Ex. 045). 2020 Q3-Q4 and 2021 Q1-Q2. The local layer returned as the mask layer. Savannah imposed Georgia's first mask mandate on June 30, 2020, effective July 1 (every commercial establishment, every outdoor public space, every tour vehicle, $500 civil fines; employers in restaurants, retail, salons, groceries and pharmacies 'MUST require' masked employees; Ex. 011). Atlanta followed on July 8 (EO 2020-113, Ex. 007: masks in every commercial entity and public space; gatherings over ten barred on City property) and July 10 (EO 2020-114, Ex. 061: all gatherings of any number barred on City property; the City returned to 'Phase 1: Stay at Home' under its Recommended Guidelines, Ex. 046). DeKalb's Board adopted a countywide mask ordinance on July 14, amended July 21 (Ex. 042). The Governor's EO 07.15.20.01 (July 15, 2020) suspended local face-covering requirements more restrictive than the State's and the Governor sued Atlanta on July 16, 2020 (Kemp v. Bottoms, Fulton Super. Ct. No. 2020cv338387; Order for Mediation of July 22, Ex. 004); no injunction issued; the State withdrew the suit on August 13 and EO 08.15.20.01 (August 15, 2020) created the 'Local Option Face Covering Requirement' for counties above 100 cases per 100,000 over 14 days, enforceable against individuals but not, without consent, on private property. Under it Savannah renewed its order monthly (Exs. 012-015: December 11, 2020 to January 9, 2021; February 7 to March 7; March 7 to April 6; April 6 to May 6, 2021), Sandy Springs and Smyrna adopted mandates on August 20, 2020, and Atlanta re-declared its emergency and mask requirement on January 13, 2021 (EO 2021-06). The courts operated under the Statewide Judicial Emergency throughout: the Atlanta Judicial Circuit's Guidelines for Expanding In-Person Proceedings (adopted as an order June 12, 2020, Ex. 020) imposed masks, temperature screening, capacity limits and a phased return of jurors; Cobb required a thermal scan and mask to enter any court (Ex. 027), heard no evictions from March 14 through July 2020 (Ex. 029), and re-suspended non-essential in-person proceedings on December 22-23, 2020 (Ex. 037). The Public Health State of Emergency (State) ran to July 1, 2021. 2021 Q3. Instruments in force July 1-September 30, 2021: the Atlanta Judicial Circuit's June 12, 2020 guidelines and its Local Order Declaring a Judicial Emergency (July 30-August 29, 2021, Ex. 052); Savannah's Emergency Order of July 26, 2021 (masks in City buildings, every school, every hospital, every federally regulated conveyance and every tour vehicle, July 26-August 25; Ex. 016) and Emergency Order 29 of August 24, 2021 (the same, plus a ban on groups over 50 on City property, closure of City buildings and community centers, cancellation of every Civic Center event and revocation of every event permit in public spaces through September 30, 2021; Ex. 017); Atlanta's Executive Order of July 28, 2021 requiring masks 'in all public places, including private businesses and establishments,' while indoors (Ex. 063); Chatham County's mask requirement in county buildings (July 27, 2021); Cobb County's Declaration of Emergency of August 19, 2021 (masks required in every county facility from August 20; businesses urged to re-impose masks; Ex. 043) renewed September 17 through October 17, 2021 (Ex. 026); the school-district mask mandates of Atlanta Public Schools, DeKalb, Clayton and Savannah-Chatham for 2021-22 and Fulton County Schools' summer program (Ex. 056); MARTA's mask requirement under the federal conveyance order; the State's Economic Recovery State of Emergency (06.30.21.01, renewed 07.22.21.01, 08.19.21.01, 09.20.21.01) and its EO 08.19.21.03 of August 19, 2021, which suspended enforcement of every local COVID-19 ordinance 'more or less restrictive' than the State's, declared that no organization 'shall be compelled to enforce' any local COVID-19 ordinance, and made violation of the Governor's order a misdemeanor. The third preemption is itself a Q3 2021 order of an appropriate governmental authority regulating how metro businesses could operate.

End of general restrictions

2020-04-30 (statewide shelter-in-place ended; local closure orders already suspended Apr. 3, 2020) for stay-home and closure orders; 2021-05-06 for the Savannah mask mandate's first run

Instrument Local stay-home and closure orders: suspended by Governor Kemp's EO 04.02.20.01 (Apr. 2, 2020) effective Apr. 3, 2020 6:00 p.m. and replaced by the State's reopening orders 04.20.20.01 (Apr. 20, 2020; gyms, salons, bowling reopened Apr. 24) and 04.23.20.02 (Apr. 23, 2020; dine-in and theaters Apr. 27; shelter-in-place ended Apr. 30, 2020). Local mask and gathering orders: Savannah's mandate ran to May 6, 2021 (Ex. MET-ATL-015) and was downgraded to an advisory in May 2021; Atlanta's EO 2020-114/2021-06 mask regime continued into 2021 (end not fixed); both cities reinstated mandates on July 26 and July 28, 2021.

What remained in force

After Apr. 30, 2020: the State's business-specific operating requirements and gathering caps (Empowering a Healthy Georgia series, to Apr. 30, 2021 and beyond); the Statewide Judicial Emergency (to June 30, 2021) and the metro courts' own orders (Exs. 020, 027-029, 036, 037); Atlanta's and DeKalb's July 2020 mask orders, Savannah's July 1, 2020 mask order and its renewals to May 6, 2021, and the August 2020 municipal mandates; MARTA's mask rule and, from Feb. 1, 2021, the federal conveyance mask order. After July 1, 2021 (State PHE ended): the Economic Recovery State of Emergency (June 30, 2021 onward), the Atlanta Judicial Circuit's guidelines and July 30-Aug. 29, 2021 judicial emergency, the July-September 2021 reinstated mask orders of Savannah, Atlanta, Chatham County and Cobb County, the school-district mandates, and the federal transit mask order.

The State and the local orders

Three State suspensions of local orders, each by an order of the Governor under O.C.G.A. §§ 38-3-28 and 38-3-51. (1) EO 04.02.20.01 (Apr. 2, 2020, effective Apr. 3, 2020 6:00 p.m. through Apr. 13, extended to Apr. 30, 2020) suspended 'enforcement of any local ordinance or order adopted or issued since March 1, 2020, with the stated purpose or effect of responding to a public health state of emergency, ordering residents to shelter in place, ordering a quarantine, or combatting the spread of coronavirus or COVID-19 that in any way conflicts, varies, or differs from the terms of this Order' (quoted in Savannah's Extension of Apr. 3, 2020, Ex. MET-ATL-010). Atlanta's EO 2020-21/22, Fulton BOH Administrative Order 20.03.31, DeKalb EO 20-002, Cobb's Mar. 24 and Apr. 2 orders, Gwinnett's Mar. 27 order, Clayton's Apr. 1 order and Savannah's Mar. 24 order were displaced by the statewide shelter-in-place, which imposed the same or greater restrictions statewide. (2) EO 07.15.20.01 (July 15, 2020, effective July 16-31) and 07.31.20.02 (Aug. 1-15, 2020) suspended 'any state, county, or municipal law, order, ordinance, rule, or regulation that requires persons to wear face coverings... to the extent that they are more restrictive' than the State's; Governor Kemp sued the Mayor and Council of Atlanta on July 16, 2020 (Kemp v. Bottoms, Fulton Super. Ct. No. 2020cv338387) to void EO 2020-113/114; Judge Barwick ordered mediation on July 22 (Ex. MET-ATL-004); no injunction issued; the Attorney General withdrew the suit on Aug. 13, 2020 after the Mayor's 'concession regarding the city's Phase One roll-back plan' (Governor's statement, Aug. 13, 2020); Savannah, Athens-Clarke, East Point and DeKalb maintained their mandates during the suspension. (3) EO 08.15.20.01 (Aug. 15, 2020) and each successor through Apr. 30, 2021 authorized a 'Local Option Face Covering Requirement' in counties with 100 or more cases per 100,000 over the prior 14 days, enforceable only against individuals and not on private property without the owner's consent, with no 'fines, fees, penalties, or other causes of action' against businesses (Husch Blackwell tracker); Savannah's renewals (Exs. 012-015) recite the 'local control provisions' of the corresponding State orders. (4) EO 08.19.21.03 (Aug. 19, 2021, 'Protecting Economic Recovery During the State of Emergency for Continued COVID-19 Economic Recovery'), read in full: 'No Organization or sports team or organization that continues in-person operations during the effective dates of this Order shall be compelled to enforce any provision of any county or municipal ordinance, order, rule, or regulation enacted pursuant to emergency authority or a declaration of emergency related to COVID-19'; 'No law enforcement agency shall compel any Organization... to adhere to any provision of any county or municipal ordinance...'; local orders 'more or less restrictive than the terms of this Order shall be considered inconsistent'; 'enforcement of any county or municipal ordinance, order, rule or regulation that is more or less restrictive than this Order and is not otherwise expressly permitted by the terms herein is hereby suspended'; 'any person who violates this Order shall be guilty of a misdemeanor' (O.C.G.A. § 38-3-7); effective upon signature for the duration of the Economic Recovery State of Emergency (06.30.21.01, renewed 07.22.21.01, 08.19.21.01 to Sept. 28, 2021, 09.20.21.01). Atlanta's July 28, 2021 order and Savannah's July 26 and Aug. 24, 2021 orders were issued under O.C.G.A. § 38-3-28(a) before and after this suspension; their requirements on City property, in schools and hospitals, and on individuals continued to be applied by the issuing governments. Georgia had no statewide mask mandate at any time; the State barred 'vaccine passport' requirements by EO 05.25.21.01 (May 25, 2021).
