The record in brief

Marion County ran its own COVID-19 command structure from March 16, 2020 through June 30, 2021, and that structure, not the Governor's, set the operating limits for every business, school, court and transit rider in Indianapolis for fifteen and a half months. The instruments are the forty-one numbered Public Health Orders of 2020 issued by Dr. Virginia A. Caine under Ind. Code 16-20-1-24 and -25 and the Code of the Health and Hospital Corporation of Marion County (exhibits MET-IND-001 through 041), the 2021 series ratified by the City-County Council under Ind. Code 16-20-1-24.5 (MET-IND-080 through 083), the Mayor's local-disaster-emergency and travel orders under Ind. Code 10-14-3-29 and -29.5 (MET-IND-060 through 067), the Marion Circuit and Superior Courts' facility orders (MET-IND-050 through 056), and IndyGo's service and boarding directives (MET-IND-070 through 073). Every one of the sixty-four primary exhibits was retrieved from the issuing government's own repository and its operative text was read from the face of the document. The chronology is unbroken. On March 16, 2020 the county closed schools, banned gatherings above fifty and prohibited on-site consumption at every restaurant and bar (PHO 1-2020), a week before the Governor's stay-at-home order. PHO 2-2020 imposed a county stay-at-home order effective March 24, 2020 with its own list of closed businesses. PHO 4-2020 and 5-2020 extended the closure regime to May 15, 2020, two weeks past the statewide reopening; the Governor's EO 20-26 and 20-28 held Marion County in Stage 2 and the county's own orders held it longer. Reopening proceeded in county-drawn stages (PHO 9/10, 13/14, 16/17 of 2020) with percentage caps on malls, retail, libraries and food courts. On July 9, 2020 PHO 20-2020 imposed a countywide mask mandate eighteen days before the State's, and on July 24, 2020 PHO 21/22-2020 closed every bar and nightclub in the county, capped social gatherings at fifty and all other events at 250 persons or 25 percent of fire-marshal capacity, and required MCPHD pre-approval of a mitigation plan for anything larger. PHO 29-2020 (effective September 8, 2020) reopened bars at 25 percent, held restaurants at 50 percent indoors, imposed a midnight-to-5 a.m. closing on every food and drink establishment, and required daily employee screening in retail. PHO 31-2020 and 33-2020 carried the 50 percent dining cap, the nightly closure and the six-foot workplace rule through October and into November 2020 while the State sat in Stage 5 with no capacity limits at all. PHO 35-2020 (effective November 16, 2020) cut social gatherings to twenty-five, events to 25 percent of venue capacity with pre-approval above fifty persons, bars to 25 percent, party size to six, and ordered every school in the county to virtual instruction from November 30, 2020 to January 15, 2021; PHO 36-2020 and 40-2020 capped court facilities at twenty-five and then fifteen persons, and the courts continued every jury trial to after January 15, 2021. PHO 38-2020 (December 14, 2020) carried that regime into 2021 until superseded, and MCPHD was still suspending bar licenses for hours violations on March 23, 2021. When the General Assembly overrode the Governor's veto of SEA 5 in April 2021 and required legislative approval of any local order stricter than the State's, the City-County Council ratified the county's mask mandate, capacity limits, court and school orders on May 10, 2021 (Special Ordinance No. 3, 2021, 19-5) and approved PHO 12-2021 on June 7, 2021 (Special Ordinance No. 4, 2021, 19-5): masks for the unvaccinated, 75 percent capacity for restaurants, bars, gyms and entertainment venues, six-foot spacing, party size ten, event caps and pre-approval above 500, six-foot workplace spacing including manufacturing. The general restrictions ended when the Mayor and Dr. Caine lifted every capacity, distancing and mask requirement effective July 1, 2021; the courts rescinded their own mask order June 30, 2021. The record of Q3 2021 is exact: MCPHD issued recommendations, not orders, in July 2021; the Mayor stated on July 24, 2021 that no restrictions were warranted; the courts reinstated a courthouse-only mask order on August 16, 2021 (Sheriff enforcement from August 17) citing the Delta variant and the CDC high-transmission designation; the Health and Hospital Corporation required its own employees to be vaccinated by September 20, 2021; PHO 8-2020 (non-congregate sheltering of the homeless) remained on the books; federal transit masking continued on IndyGo. Statewide, the Governor's emergency (EO 20-02 series) was renewed monthly through the quarter and the State's mask order had been advisory since April 6, 2021 (EO 21-09). No Marion County instrument suspended or limited the operations of a trade or business between July 1 and September 30, 2021. The mayoral emergency series is equally clear: watch-level advisory March 16, 2020 (EO 1), warning-level travel emergency March 23 to May 1, 2020 (EOs 2 and 3, a Class B misdemeanor to violate), watch-level advisory and telework encouragement from May 2, 2020 (EOs 4, 5, 10), and rescission on March 1, 2021 (EO 1, 2021). The Mayor's EO 4, 2020 states on its face that the local health order controls where the State's order is less restrictive unless expressly preempted, and the only express preemption in the period, EO 20-28's bar on local warning-level travel restrictions (May 21, 2020), was lifted by EO 20-29 effective May 31, 2020. Every Governor's reopening order permitted stricter local orders, and Marion County issued them.

End of general restrictions

Instrument The last operative general order was PHO 12-2021 (effective June 8, 2021; approved by City-County Council Special Ordinance No. 4, 2021, June 7, 2021).

What remained in force

Locally: PHO 8-2020 (non-congregate shelter for persons experiencing homelessness; open-ended and ratified May 10, 2021); the Council's Special Ordinances 3 and 4 of 2021 as approval frameworks with no operative restriction after July 1, 2021; the Marion Circuit and Superior Courts' facial-coverings order of August 16, 2021 (Sheriff enforcement from August 17, 2021; courthouse facilities only; amended to a recommendation except in jury proceedings November 22, 2021); the Health and Hospital Corporation of Marion County's employee vaccination requirement (announced July 2021; deadline September 20, 2021; HHC workforce only). State: EO 20-02 public health emergency, renewed monthly (16th renewal signed June 30, 2021) and ended March 3, 2022; EO 21-09 and successors (statewide mask order advisory from April 6, 2021; no statewide capacity limits). Federal: CDC order and TSA security directive requiring masks on public transportation and at airports (in force on IndyGo and at Indianapolis International Airport throughout Q3 2021).

The State and the local orders

Indiana law authorized, and the Governor's orders expressly preserved, stricter local orders throughout 2020: EO 20-26 and 20-28 (May 2020) held Cass, Lake and Marion counties in Stage 2 and permitted local health officers to impose more restrictive measures; PHO 20-2020, 21/22-2020, 25-2020, 29-2020, 31-2020, 33-2020, 35-2020 and 38-2020 each recite that the Governor's Stage 4.5, EO 20-32/20-35/20-36, EO 20-43 or EO 20-48 apply only where the county order is silent. The one express State preemption of a local COVID-19 measure in the period was EO 20-28 (May 21, 2020), which temporarily barred local warning-level travel restrictions; EO 20-29 rescinded that preemption effective 11:00 a.m. May 31, 2020, as the Mayor's EO 9, 2020 recites. The Mayor's EO 4, 2020 (May 1, 2020) states that where the State's order is less restrictive the local health order controls 'unless expressly preempted by a State order'. In 2021 the General Assembly enacted SEA 5 over the Governor's veto (override May 10, 2021; codified at Ind. Code § 16-20-1-21.5, added by P.L. 219-2021, § 4), requiring that a local health order more stringent than the Governor's be approved by the local legislative body; the City-County Council supplied that approval on May 10, 2021 (Special Ordinance No. 3, 2021, ratifying PHO 6-2021, 8-2020, 9-2021, 10-2021 and 11-2021) and June 7, 2021 (Special Ordinance No. 4, 2021, approving PHO 12-2021, 13-2021 and 14-2021), each by 19-5. Dr. Caine told the Council on May 10, 2021 that 'there would be no restrictions in place if these health orders are not ratified'. No court injunction against any Marion County COVID-19 order was located. its operation is established by the Council's own recitals.
