Operative words
Pursuant to section 7 of Emergency Directive 037, licensees must limit the maximum occupancy on the gaming floor and other gaming areas to 35% of its maximum capacity assigned to it by local building and fire codes. Effective March 15, 2021, licensees must limit the maximum occupancy on the gaming floor and other gaming areas to 50% of its maximum capacity assigned to it by local building and fire codes.... it is incumbent upon the licensee to ensure that its food and beverage tenants are fully complying with section 13 of Emergency Directive 037... The Board will consider the imposition of disciplinary action on a licensee whose tenants are out of compliance with such requirements.
