The record in brief

Nevada's regime ran on a single chain of gubernatorial instruments issued under NRS ch. 414 pursuant to the March 12, 2020 Declaration of Emergency (Ex. NV-001), which remained in force through every claimable quarter and was not terminated until May 20, 2022; every Emergency Directive from 001 to 052 recites that declaration as its source of power, and Directive 010 provides that all Directives 'shall be in force for the duration that the Declaration of Emergency shall be in effect, unless specifically terminated by a subsequent order' (Ex. NV-012 s. 1). 2020 Q2 (March 13 - June 30, 2020): schools were closed from March 16 (Directive 001, announced March 15; Directive 005 of March 20 fixed reopening 'no earlier than April 16' and ordered emergency distance education; Directive 014 moved the date to April 30; Directive 015 closed every K-12 building 'for the remainder of the 2019-2020 school year'); gaming was shut down at 11:59 p.m. on March 17 (Directive 002; GCB Notice 2020-19); every Non-Essential Business closed at 11:59 p.m. on March 20 and restaurants were confined to take-out, drive-through, curbside and delivery (Directive 003), with the essential and non-essential lists fixed the same day by the Department of Public Safety's emergency regulation amending NAC ch. 414 (Ex. NV-005); gatherings of ten or more were prohibited statewide from March 24 with criminal and civil penalties under NRS 199.280 and 202.450 (Directive 007); a residential and commercial eviction and foreclosure moratorium began March 29 (Directive 008); DMV offices closed and credential expirations were extended (Directive 004); statutes of limitation were tolled and State and local licenses extended (Directive 009 revised); the Stay at Home Order took effect April 1 ('all Nevadans are ordered to stay in their residences. Gatherings of individuals outside the home is prohibited') through April 30 (Directive 010), extended to May 15 with curbside retail from May 1 (Directive 016); Directive 013 (April 8) closed golf courses and every showroom of an essential business, prohibited in-person worship of ten or more, prohibited open houses and in-person showings of occupied rentals, barred in-home beauty services and imposed queue control on essential retailers. Phase One began May 9 (Directive 018: retail, dealers and restaurants at 50 percent, salons by appointment, nightclubs, bars, gyms, theaters, museums, spas and entertainment venues closed, casinos closed, gatherings of ten, employers 'shall require employees who interact with the public to wear face coverings' and 'are encouraged to permit their employees to work from home to the maximum extent practicable'); Phase Two began May 29 (Directive 021: gatherings of fifty, worship capped at fifty persons, gyms, theaters, bowling, museums, tattoo and massage at 50 percent, live events closed to the public, casinos from June 4 under Gaming Control Board policies); the statewide face-covering mandate took effect at 11:59 p.m. on June 25 (Directive 024, with a business duty to refuse entry). 2020 Q3: Phase Two was extended through July 31 (Directive 026) and then indefinitely 'for the duration of the current state of emergency' (Directive 029, July 31); bars in Clark, Washoe and other elevated-transmission counties closed again on July 10 and restaurant parties were capped at six (Directive 027, sections 4-6 expiring August 20 under Directive 030); Directive 028 (July 28) required masks of every K-12 student and staff member and fixed distancing for the 2020-21 school year; Directive 030 (August 14) created the COVID-19 Mitigation and Management Task Force with power to impose county-level restrictions; the residential eviction protections ran through October 14 (Directives 025 and 031); SB 4 (August 11) and the NAC ch. 447 emergency regulation (August 31) imposed cleaning, distancing, testing and response-plan standards on every hotel, casino and lodging facility in Clark and Washoe Counties for the life of the emergency. 2020 Q4: Directive 033 (effective October 1) raised gatherings to the lesser of 250 or 50 percent and reopened live events and conventions under approved plans; Directive 034 (October 3) regulated sports; the Statewide Pause (Directive 035, signed November 22, effective November 24) cut gatherings to the lesser of 50 or 25 percent, private gatherings to ten from two households, casinos, restaurants, bars, gyms, venues and worship to 25 percent, required reservations and four-person tables, and prohibited tournaments; the residential eviction moratorium returned December 15 (Directive 036). 2021 Q1: the Pause held until February 14; Directive 037 stepped capacity to 35 percent and gatherings to the lesser of 100 or 35 percent on February 15 and to 50 percent and the lesser of 250 or 50 percent on March 15, with large gatherings only under approved plans (20 percent of fixed seating; conventions capped at 1,000); Directive 038 governed schools; Directive 041 (March 12) created the county Local Mitigation and Enforcement Plan process for a May 1 transition; Directive 043 (March 31) extended the eviction moratorium to May 31. 2021 Q2: Directive 044 (April 19) terminated statewide social distancing at 11:59 p.m. on April 30, delegated capacity and gathering management to counties on May 1 subject to Baseline Statewide Mitigation Measures, and ended State review of large gatherings for events on or after June 1; Directive 045 (May 3) tied the mask mandate to CDC guidance and kept the business duty to ensure patrons wear face coverings; Gaming Control Board Notice 2021-48 (May 26) rescinded every gaming-floor protocol effective June 1, recording that 'none of Nevada's counties will retain social distancing or occupancy limitations' from that date. 2021 Q3: the Declaration of Emergency, Directives 006, 011 (as amended by Directive 046 of July 20), 024, 041, 044 and 045, SB 4 and NAC ch. 447 were in force on July 1; Directive 047 (July 27, effective 12:01 a.m. July 30) reinstated universal indoor masking in counties of substantial or high transmission (12 of 17 counties on July 30; 16 of 17 by August 24, including Clark and Washoe throughout); Directive 048 (August 4) required masks in every K-12 building in counties of 100,000 or more and of all school staff statewide, and weekly testing of unvaccinated students and staff in inter-county activities; Directives 049 (August 16) and 050 (September 2) conditioned mask-free large events and conventions of 4,000 or more on proof of vaccination for every attendee; the State Board of Health adopted emergency regulations requiring COVID-19 vaccination of Nevada System of Higher Education students (August 20) and of State employees and contractors in State-operated health-care and detention settings (September 10, compliance by November 1); NV OSHA adopted the federal COVID-19 Healthcare Emergency Temporary Standard effective July 1 and enforced Directives 024, 028, 044, 045 and 047 against every Nevada business. The mask mandate ended February 10, 2022 (Directive 052); the emergency ended May 20, 2022; Executive Order 2023-001 (January 6, 2023) rescinded the remaining COVID-19 instruments.

End of general restrictions

Instrument Emergency Directive 044 (Apr. 19, 2021) (Ex. NV-038), which terminated statewide social distancing at 11:59 p.m. on April 30, 2021 and delegated capacity and gathering management to the counties on May 1, 2021, with State review of large-gathering plans ending for events on or after June 1, 2021; the statewide end of capacity limits is recorded in Gaming Control Board Notice 2021-48 (May 26, 2021) (Ex. NV-074): 'Effective 12:00am on Tuesday, June 1, 2021, the Board rescinds all applicable COVID-19 mitigation protocols... As of June 1, 2021, none of Nevada's counties will retain social distancing or occupancy limitations that would apply to a gaming licensee.'

What remained in force

The March 12, 2020 Declaration of Emergency (to May 20, 2022); the Baseline Statewide Mitigation Measures named in Directive 044 s. 7: the face-covering requirement of Directives 024 and 045 (business duty to ensure patrons wear face coverings, Directive 045 s. 5), the Open Meeting Law provisions of Directive 006, gaming mitigation measures, and the Crisis Standards of Care and licensing provisions of Directive 011 (amended July 20, 2021 by Directive 046); SB 4 and NAC ch. 447E public-accommodation cleaning, distancing, testing and response-plan requirements in Clark and Washoe Counties; county Local Mitigation and Enforcement Plans under Directives 041 and 044; NV OSHA enforcement of the remaining Directives and, from July 1, 2021, of the COVID-19 Healthcare ETS; the residential eviction moratorium of Directives 036 and 043 through May 31, 2021. From July 30, 2021 Directive 047 reinstated universal indoor masking in substantial- and high-transmission counties; from August 4, 2021 Directive 048 imposed school masking and testing; from August 16 and September 2, 2021 Directives 049 and 050 conditioned mask-free large events and conventions on proof of vaccination; on August 20 and September 10, 2021 the State Board of Health adopted vaccination mandates for NSHE students and State health-care and detention employees.

Preemption of local orders

Nevada never preempted local COVID-19 orders; it set a floor and invited counties and cities to go further. Directive 018 s. 24 (May 7, 2020) delegated 'to each county of this state... and local municipalities, the authority to adopt additional protective measures intended to combat the spread of COVID-19, including without limitation, stay at home and face covering orders, so long as those measures are at least as restrictive as those imposed by all Directives,' and provided that such measures 'may be implemented without additional approval by the State'; Directive 021 s. 38 and Directive 023 s. 5 repeated the delegation and extended it to State agencies. Directives 021 s. 2, 024 s. 2, 027 s. 2, 029 s. 2 and 030 s. 2 each provide that county restrictions 'may exceed the standards imposed by Declaration of Emergency Directives... but in no case shall county-guidelines be more permissive than the provisions of this Directive.' Directive 030 (Aug. 14, 2020) empowered the Mitigation and Management Task Force to impose county-specific restrictions on elevated-transmission counties. From May 1, 2021 Directives 041 and 044 transferred management of capacity, gathering and sector measures to counties under approved Local Mitigation and Enforcement Plans, while reserving Baseline Statewide Mitigation Measures to the State: Directive 044 s. 11 provides that 'if any provision of a Local Plan adopted by a county... conflicts with any Baseline Statewide Mitigation Measures, including but not limited to the face covering requirement in Directive 024, such provision is void,' and Directive 045 s. 2 repeats that county guidelines may be more restrictive but 'in no case... more permissive.' Directive 052 s. 6 (Feb. 10, 2022) preserved the power of any local health authority, local government, school or employer to require face coverings. Clark County's July 20, 2021 employee-mask directive (metro LAS) sat on this floor until Directive 047 superseded it on July 30, 2021.

Hotels, motels, short-term rentals and commercial lodging were essential (NAC 414 reg. s. 1(aa)) but gaming licensees offering hotel accommodations could 'remain open if needed to avoid guest displacement or for essential or emergency purposes' only (Directive 002 s. 2); casinos closed Mar. 17 to June 4, 2020; pools at 50 percent from May 29 (Directive 021 s. 29), hot tubs, saunas and spas closed; gaming floors at 25 percent Nov. 24, 2020 to Feb. 15, 2021, 35 percent to Mar. 15, 50 percent to Apr. 30, county limits (Clark 80 percent) May 1 to May 31, none from June 1, 2021 (GCB 2020-108, 2021-41, 2021-48); SB 4 (Aug. 11, 2020) and NAC ch. 447E (Aug. 31, 2020, amended Apr. 30, 2021): mandatory cleaning standards, daily housekeeping not to be discouraged, six-foot protocols, employee testing on return to work, daily temperature screening, written response plans and health-authority inspection in Clark and Washoe Counties for the life of the emergency; conventions closed to the public until Oct. 1, 2020, capped at 1,000 to Nov. 24, at the lesser of 50 or 25 percent to Mar. 15, 2021, at 1,000 under approved plans to May 1, 2021; universal indoor masks in casinos from July 30, 2021 (GCB 2021-71); vaccination-proof convention option from Sept. 2, 2021 (Directive 050).

Offices and telework

Professional and technical services (legal, accounting, tax, payroll, real estate, property management) listed as Essential Licensed Businesses subject to the Stay at Home Order's limits on leaving home (NAC 414 reg. s. 1(w); Directive 010 s. 5); Directive 016 s. 2: 'All businesses are encouraged to permit their employees to work from home to the maximum extent practicable'; Directive 018 s. 10 and Directive 021 s. 13 repeat the words for all businesses, and Directive 021 s. 4: 'Businesses performing non-retail services, including without limitation, legal services, accounting services, or real estate services, are encouraged to conduct business telephonically or virtually to the greatest extent practicable'; employers 'shall require employees who interact with the public to wear face coverings' and 'must adopt measures that meet or exceed the standards promulgated by NV OSHA' (Directive 018 ss. 9-10; Directive 021 ss. 12-13); Directive 035 (Nov. 24, 2020) 'Nevadans are strongly encouraged to stay home'; Directive 048 s. 2 (Aug. 4, 2021) defines 'indoor public setting' to include 'office buildings, breakrooms, hallways, cafeterias, meeting rooms'; FFCRA leave mandatory on request for covered employers for the life of the emergency (Directive 018 s. 12; Directive 021 s. 16).

Manufacturing

Manufacturing and food processing were Essential Infrastructure operations (NAC 414 reg. s. 1(b)) subject to the six-foot workforce separation and minimum-public-contact mandate of Directive 003 s. 7 and NAC 414 reg. s. 3(d)(1), the NV OSHA standards made mandatory by Directives 016, 018 and 021, the face-covering mandates of Directives 024, 045 and 047, the stay-home limits on customers and workforce (Directive 010), and, in Clark and Washoe Counties, the SB 4 civil-liability safe harbor conditioned on compliance with controlling health standards.

Construction

Construction, mining, manufacturing and infrastructure were Essential Infrastructure operations permitted to continue but required to 'maintain strict social distancing practices to facilitate a minimum of six feet of separation between workers, and to adopt policies and practices that ensure minimum contact between the workforce and the general public' and to comply with Department of Business and Industry mitigation policies (Directive 003 s. 7; NAC 414 reg. s. 3(d)(1)); NV OSHA enforcement of all guidance (Directive 016 s. 12; Directive 018 s. 10); face coverings of employees interacting with the public from May 9, 2020 and of all persons in public indoor spaces from June 26, 2020 to May 13, 2021 and again from July 30, 2021 in substantial- and high-transmission counties.

Real estate

Real estate and property management were Essential Licensed Businesses (NAC 414 reg. s. 1(w)); Directive 013 s. 6 (Apr. 8, 2020): 'Open house showings, and in-person showings of single family and multi-family residences currently occupied by renters of real estate on the market for sale, are hereby prohibited,' with virtual tours permitted; Directive 021 s. 4 (May 29, 2020) encouraged real estate services to operate 'telephonically or virtually to the greatest extent practicable'; residential and commercial eviction and foreclosure moratorium Mar. 29, 2020 (Directive 008), commercial evictions and foreclosures resumed June 30, 2020 and residential nonpayment actions Sept. 1, 2020 (Directive 025), nonpayment summary evictions prohibited again Aug. 31 to Oct. 14, 2020 (Directive 031), residential moratorium for Covered Persons Dec. 15, 2020 to May 31, 2021 (Directives 036, 043); Directive 009 tolled limitation periods to July 31, 2020.

Hospitals and long-term care

Directive 011 (Apr. 1, 2020): licensing waivers, out-of-state and retired providers, students supervised, Crisis Standards of Care approved by the Chief Medical Officer, NRS 414.110 immunities, in force through the emergency and re-set by Directive 046 (July 20, 2021); hospitals ceased non-urgent procedures in March-April 2020 and resumed under a phased plan announced Apr. 28, 2020 (Ex. NV-059); residential facilities for seniors were essential businesses (NAC 414 reg. s. 1(y)); Board of Health emergency regulation of Sept. 10, 2021 requiring vaccination of State employees and contractors in State-operated licensed health-care settings and detention facilities by Nov. 1, 2021 (Exs. NV-056, NV-057); NV OSHA adopted the COVID-19 Healthcare ETS effective July 1, 2021 (Ex. NV-060).

Dental and elective health care

Dentists and orthodontists were Essential Healthcare operations (NAC 414 reg. s. 1(a)) bound by Directive 003 s. 4's risk-mitigation mandate; the Board of Dental Examiners directed practitioners to Directive 010 and 'supports the postponement of elective dental procedures until at least April 30, 2020 per the prior mandate given to all essential businesses in Directive 003' (Ex. NV-058, Apr. 7, 2020); the Governor announced the phased resumption of limited medical and dental procedures on Apr. 28, 2020 under Medical Advisory Team guidelines (Ex. NV-059), stating that hospitals and dental offices 'proactively paused medically necessary services'; Directive 011 (Apr. 1, 2020) waived licensing rules, authorized practice outside specialty and adopted Crisis Standards of Care, amended July 20, 2021 by Directive 046; face coverings in patient settings from June 26, 2020 (Directive 024 s. 6 'patients'); NV OSHA Healthcare ETS effective July 1, 2021 (Ex. NV-060).

Schools

All schools closed from Mar. 16, 2020 (Directive 001, Mar. 15, announced; Directive 005, Mar. 20: reopen 'no earlier than April 16, 2020, and only upon the approval of the Chief Medical Officer', emergency distance education by Mar. 23); Directive 014 (Apr. 14): no earlier than Apr. 30; Directive 015 (Apr. 28): 'All kindergarten through 12th grade school buildings shall remain closed for onsite education for the remainder of the 2019-2020 school year'; Directive 022 (June 9): buildings may reopen from June 10 at the lesser of 50 percent or fifty persons per space, reopening plans required; Directive 028 (July 28): masks for all K-12 students and staff, 3-foot and 6-foot distancing, hybrid models; Directive 038 (Feb. 17, 2021): 75 percent or 250 per space after 20 days of in-person instruction, buses at 66 percent; Directive 044 (Apr. 19, 2021): distancing and capacity delegated to School Leaders May 1, distance-education option required through the emergency; Directive 045 (May 3, 2021) terminated Directive 028 s. 4; Directive 048 (Aug. 4, 2021): masks in all school buildings in counties of 100,000 or more (Clark, Washoe), all staff statewide, weekly testing of unvaccinated students and staff in inter-county activities, NIAA testing plan, outbreak masking; Directive 052 (Feb. 10, 2022) ended the school mandate subject to local health authority plans.

Child care

Child care facilities were Essential Licensed Businesses (NAC 414 reg. s. 1(x); Governor's Mar. 19, 2020 statement that child care is essential) and operated under Division of Public and Behavioral Health protocols; child care in gyms closed May 29 to Nov. 2020 (Directive 021 s. 28(8)) and reopened under DHHS protocols (Directive 035 s. 18(8)); Directive 018 s. 12 and Directive 021 s. 16 directed employers to accommodate workers whose 'school or place of care is closed, or childcare provider is unavailable' and made FFCRA leave mandatory on request; Nevada Ready! Pre-K providers authorized to modify schedules (Directive 028 s. 9).

Worship and gatherings

Gatherings of ten or more prohibited Mar. 24, 2020 (Directive 007 s. 1, penalties NRS 199.280, 202.450); in-person worship of ten or more prohibited Apr. 8 (Directive 013 s. 4), drive-in services May 1 (Directive 016 s. 10); gatherings of ten May 9 (Directive 018 s. 7); fifty and worship at fifty persons May 29 (Directive 021 ss. 10-11; Calvary Chapel Dayton Valley v. Sisolak, 140 S. Ct. 2603 (July 24, 2020), refusing injunctive relief); the lesser of 250 or 50 percent Oct. 1 (Directive 033 ss. 7, 9); the lesser of 50 or 25 percent, private gatherings ten from two households, Nov. 24 (Directive 035 ss. 7-9); worship 50 percent, gatherings the lesser of 100 or 35 percent Feb. 15 and the lesser of 250 or 50 percent Mar. 15, 2021, indoor private gatherings ten and outdoor 25 (Directive 037 ss. 2-4); outdoor spaces without fire-code capacity capped at 250 (Directive 041 s. 8); delegated to counties May 1, 2021; large gatherings over 250 under Local Plans from June 1.

Courts and public offices

Eighth Judicial District Court AO 20-01 (Mar. 13, 2020, co-signed by the Chief Justice): non-essential hearings by video or on the papers, all jury trials suspended Mar. 16 to Apr. 17, 2020 and extended by later orders (Ex. NV-062; metro LAS covers the series); DMV offices closed Mar. 16, 2020 'until at least April 16' (Directive 004 s. 1), reopened by appointment June 15, 2020 (secondary), credential expirations extended to Sept. 13 and then Nov. 12, 2020 (Directives 026 s. 2, 032 s. 2); Directive 009 revised tolled every statutory limitation period from Apr. 1, 2020 and extended every State and local license and permit 90 days (ended June 30/July 31, 2020 by Directive 026 s. 5); Open Meeting Law suspended in part by Directive 006 (Mar. 22, 2020) and kept as a baseline measure through the emergency (Directive 044 s. 7); Supreme Court ADKT 567 eviction mediation program effective Oct. 15, 2020 (recited in Directive 043).

Travel and quarantine

No mandatory traveler quarantine; the Governor's Mar. 31, 2020 travel advisory asked visitors to self-quarantine 14 days and was 'not enforceable by law' (secondary); Directive 021 s. 8 'Nevadans are urged to avoid travel to the greatest extent practicable'; persons testing positive 'shall stay at home and self-quarantine for a minimum of two weeks' and contacts 'must quarantine and stay at home for two weeks, or until a negative test result has been received' under NRS 441A.180 (Directive 018 s. 6; Directive 021 s. 9); schools must enforce local isolation and quarantine instructions (Directive 028 s. 5); casino resorts and conventions, the State's travel demand, were closed Mar. 17 to June 4, 2020 and capacity-limited to June 1, 2021 as above.

Face coverings

Employees interacting with the public from May 9, 2020 (Directive 018 s. 9); all persons in public spaces from 11:59 p.m. June 25, 2020, businesses to refuse entry (Directive 024 ss. 5-6, penalties NRS 199.280, 202.450, board discipline, NV OSHA enforcement); K-12 students and staff from July 28, 2020 (Directive 028 s. 4); at private gatherings from Nov. 24, 2020 (Directive 035 s. 9); Directive 045 (May 3, 2021) tied the requirement to CDC guidance (fully vaccinated persons exempt indoors from May 13, 2021; unvaccinated persons still required) and kept the business duty (s. 5); Directive 047 (July 27, effective 12:01 a.m. July 30, 2021): all persons in counties of substantial or high transmission indoors, 12 of 17 counties on July 30 and 16 of 17 by Aug. 24, 2021; Directive 048 (Aug. 4, 2021) county-level mechanics and school masks; Directives 049 and 050 vaccination-proof alternative for large events; terminated Feb. 10, 2022 (Directive 052).

Vaccination mandates

State Board of Health emergency regulation amending NAC 441A.755 (Aug. 20, 2021; Governor's signature the same day): 'a person shall not enroll in courses at a university, community college, or state college on or after November 1, 2021, unless the person submits to the institution proof of a completed COVID-19 vaccination series' (Ex. NV-055); Directives 049 (Aug. 16) and 050 (Sept. 2, 2021): proof of at least one dose for every attendee as the condition of mask-free large events and conventions of 4,000 or more; the federal CMS and OSHA rules of Nov. 2021 post-date the period.

Standing duties

The statutes, codes and penalty provisions of Nevada that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Nevada duties →

Nevada's compulsion ran on four standing statutory tracks that predate COVID-19 and outlasted every Directive. First, the communicable-disease statute. NRS 441A.160 commands the health authority to 'immediately investigate' any communicable disease that poses a risk to the public and to 'take such measures for the prevention, suppression and control of the disease as are required by the regulations of the Board or a district board of health,' and it authorizes written orders of isolation, quarantine or treatment of 'any person or group of persons' that 'may direct the person or group of persons to take other actions that the health authority has determined are necessary to prevent the spread of the communicable disease' (Ex. DUT-NV-001). The State Board of Health's regulations bind every 'case, suspected case, carrier, contact or other person' to 'promptly cooperate' in 'the carrying out of measures for the prevention, suppression and control of a communicable disease, including procedures of exclusion, isolation and quarantine' (NAC 441A.280, Ex. DUT-NV-008); a person with a communicable disease in an infectious state 'shall not... engage in any occupation in which there is a high probability that the disease will be transmitted' (NRS 441A.180); refusal to comply with any Board regulation or any provision of the chapter is enjoinable on the complaint of the health authority (NRS 441A.900), and 'every person who violates any provision of this chapter is guilty of a misdemeanor' (NRS 441A.910), punishable by six months and $1,000 (NRS 193.150, Ex. DUT-NV-005). NRS chapter 439 makes the State Board of Health 'supreme in all nonadministrative health matters' (NRS 439.150), gives its regulations 'the effect of law' (NRS 439.200(2)), empowers county and district boards to isolate, quarantine, abate nuisances and regulate 'sanitation and sanitary practices' with regulations that 'take effect immediately' on State approval (NRS 439.360, 439.366), and commands that 'all persons in charge of public buildings and institutions, and all other public officers and employees shall respect and enforce this chapter... and all lawful rules, orders and regulations adopted in pursuance thereof' (NRS 439.560, Ex. DUT-NV-002), with injunctions (NRS 439.565) and district-attorney prosecution (NRS 439.570). Second, the emergency-management statute. NRS 414.060(3)(a) authorizes the Governor to 'make, amend and rescind the necessary orders and regulations'; NRS 414.070 adds, for the duration of a declared emergency, the power 'to enforce all laws and regulations relating to emergency management' and 'to perform and exercise such other functions, powers and duties as are necessary to promote and secure the safety and protection of the civilian population'; and NRS 414.160 commands every emergency-management organization to 'execute and enforce such orders and regulations as may be made by the Governor' (Ex. DUT-NV-003). Chapter 414 carries no free-standing criminal penalty; the penalty layer the Directives themselves recited was NRS 199.280 (willfully resisting, delaying or obstructing a public officer 'in discharging or attempting to discharge any legal duty of his or her office' is a misdemeanor, Ex. DUT-NV-011) and NRS 202.450 (every act or omission that 'annoys, injures or endangers the safety, health, comfort or repose of any considerable number of persons' is a public nuisance, maintained on pain of misdemeanor under NRS 202.470, Ex. DUT-NV-006), alongside license suspension and revocation by every State and local licensing authority (Directive 018 s. 25; Directive 021 s. 39; Directive 024 s. 10; Directive 029 s. 6, Exs. NV-016, NV-017, NV-019, NV-024), the Secretary of State's power to suspend a State business license for failure to comply with 'controlling health standards' (SB 4 s. 30, Ex. NV-054), Clark County Code 3.04.065 (up to $1,000 per violation per day or a criminal misdemeanor, Ex. MET-LAS-026) and NRS 202.595 (a gross misdemeanor, or a category C felony where substantial bodily harm or death results, for any act or neglect of a legal duty 'in willful or wanton disregard of the safety of persons or property'). Third, the workplace-safety duty. Nevada is an approved State plan, and NRS 618.375 commands that 'every employer shall' furnish employment and a place of employment 'free from recognized hazards that are causing or are likely to cause death or serious physical harm,' 'adopt and use such practices, means, methods, operations and processes as are reasonably adequate to render such employment and places of employment safe and comply with all orders issued by the Division,' and 'do every other thing reasonably necessary to protect the lives, safety and health of employees' (Ex. DUT-NV-004); NRS 618.385 forbids an employer to 'require, permit or suffer any employee to go or be in any employment or place of employment which is not safe and healthful'; NRS 618.395 extends the prohibition to every 'owner or lessee of any real property'; NRS 618.545(1) lets the Administrator order a business to cease operations where imminent danger exists, the very power Nevada OSHA announced it would use against noncompliant businesses (Ex. AGY-ST-LABOR-WORKPLACE-032); NRS 618.625 to 618.645 assess administrative fines up to the federal 29 U.S.C. 666 amounts; and NAC 618.540(1)(e) requires every written safety program to contain 'a method for ensuring that employees comply with the safety rules and work practices' (Ex. DUT-NV-009). The Directives filled that standing vessel with COVID content: Directive 018 s. 9 ('All employers must take proactive measures to ensure compliance with the social distancing and sanitation guidelines. All employers shall require employees who interact with the public to wear face coverings... and shall abide by all other guidelines promulgated by' NV OSHA) and s. 10 ('All businesses must adopt measures that meet or exceed the standards promulgated by NV OSHA... NV OSHA shall enforce all violations of its guidance, protocols, and regulations'), Directive 021 s. 3 ('in no case shall business practices be more permissive than the provisions of this Directive or those imposed by NV OSHA and the LEAP') and s. 12, Directive 024 ss. 6 and 8, Directive 044 s. 6 and Directive 045 s. 4 as amended by Directive 047 s. 2 (Exs. NV-016, NV-017, NV-019, NV-038, NV-039, NV-041); NV OSHA's guidance marked each measure 'Required' with a reference to the Directive section or the federal standard that commanded it (Exs. AGY-ST-LABOR-WORKPLACE-028, -030, -031, -037, -040; NV-060). Fourth, the liability shield. SB 4 of the 32nd Special Session (Aug. 11, 2020) grants immunity from COVID-19 exposure suits only to an entity 'in substantial compliance with controlling health standards,' defined as any federal, State or local law, regulation, ordinance or 'written order or other document published by a federal, state or local government or regulatory body' that 'prescribed the manner in which an entity must operate,' and it provides that an entity 'not in substantial compliance' faces 'any claim recognized at common law or by statute' (SB 4 s. 29, Ex. NV-054): the Legislature made compliance with the health protocols the standard of care from August 11, 2020 through the third quarter of 2021 and beyond, and SB 4 ss. 11 to 15 and NAC ch. 447E imposed cleaning, distancing, screening and response-plan duties in terms ('must') on every public accommodation facility in Clark and Washoe Counties (Ex. NV-053). The sanitary layer completed the compulsion: NRS chapter 446 as in force in 2021 let the health authority order 'the immediate closure of the food establishment' and exclude food handlers on suspicion of disease transmission (NRS 446.935), suspend a permit 'without warning, notice or hearing' for a condition constituting 'a substantial hazard to the public health' (NRS 446.880(3)), and made every violation a misdemeanor with each day a separate violation (NRS 446.945, Ex. DUT-NV-010); NRS chapter 447 requires every hotel to be kept 'in a clean and sanitary condition... free of hazards to life and limb' on pain of a misdemeanor for each day (NRS 447.045, 447.210, Ex. DUT-NV-007). Every measure a Nevada employer took in the six quarters (distancing the floor, screening, sanitizing, masking, excluding the sick, limiting occupancy, writing the plan) was conduct these instruments commanded; the only voluntary act available to a Nevada employer was to exceed the floor, which Directive 021 s. 3 expressly invited and SB 4 s. 29 rewarded.

Whether the additional measures Nevada employers took beyond the four corners of the emergency directives were voluntary within Notice 2021-20 Q&A-14, or were the discharge of standing duties imposed by Nevada law.
