Operative words
During a state of public health emergency, in addition to any powers conferred upon the governor by law, he may do any or all of the following:... (7) Control ingress and egress to and from a disaster area, the movement of persons within the area, and the occupancy of premises therein.

LA-005 recites R.S. 29:766(D)(7) by number), for the stay-at-home order, the capacity limits and the occupancy conditions on premises; a declaration under it is an order the public is bound to obey under R.S. 29:724(E). Subsection (A) verbatim: 'A state of public health emergency may be declared by executive order or proclamation of the governor, following consultation with the public health authority, if he finds a public health emergency as defined in R.S. 29:762 has occurred or the threat thereof is imminent.' Proclamation 33 JBE 2020 (Ex. LA-005) recites 'R.S. 29:766(D)(7) to control ingress and egress to and from a disaster area, the movement of persons within the area, and the occupancy of premises therein' as the basis of the stay-at-home order. R.S. 29:768 (read in a secondary source, not saved) limits each declaration to thirty days unless renewed and allows either house of the Legislature to terminate it by majority petition; the House petition of October 23, 2020 was declared void.
