The record in brief

Louisiana ran one of the longest continuous statewide COVID-19 regimes in the South. Governor John Bel Edwards declared a statewide public health emergency in Proclamation 25 JBE 2020 on March 11, 2020 under the Louisiana Homeland Security and Emergency Assistance and Disaster Act, La. R.S. 29:721 et seq., and the Louisiana Health Emergency Powers Act, La. R.S. 29:760 et seq., and renewed it without interruption in roughly monthly proclamations through the whole claim period (it lapsed only on March 16, 2022). Every proclamation carried the force of law under La. R.S. 29:724(A), was enforceable by the Governor's Office of Homeland Security and Emergency Preparedness and the State Fire Marshal, and exposed violators to the misdemeanor penalty of La. R.S. 29:724(E) (fine up to $500 or up to six months in parish jail, or both). 2020 Q2 (with the March 13-31 run-up): 27 JBE 2020 (Mar. 13) banned gatherings of 250 or more and closed every public school to students; 30 JBE 2020 (Mar. 16) cut gatherings to 50, ordered all casinos, video poker establishments, movie theaters, bars, bowling alleys and fitness centers and gyms statewide to 'cease operations completely' from 12:00 a.m. March 17, confined restaurants, cafes and coffee shops to takeout, drive-thru and delivery, suspended legal deadlines statewide and authorized local curfews; 33 JBE 2020 (Mar. 22) placed 'all individuals within the state of Louisiana' under 'a general stay-at-home order' from 5:00 p.m. March 23, closed every place of public amusement, every personal care and grooming business and every mall, required every business outside the CISA lists to 'reduce operations to continue with minimum contact with members of the public and essential employees,' capped gatherings at 10 and closed all State office buildings to the public. The stay-at-home order was extended to April 30 (41 JBE 2020, Apr. 2) and to May 15 (52 JBE 2020, Apr. 30); 47 JBE 2020 (Apr. 15) closed school facilities to students for the rest of the 2019-2020 year; 38 JBE 2020 (Mar. 31) limited funerals and graveside services to 10 attendees; the Louisiana Department of Health's State Health Officer prohibited all routine, non-essential dental visits (Notice DENTAL PROVIDER-004, Mar. 17), restricted medical and surgical procedures (Notices ALL-006 and ALL-007, Mar. 18 and 21, superseded by ALL-010 of Apr. 20, effective Apr. 27) and closed commercial body art and tanning facilities (Mar. 21); the Supreme Court continued every jury trial and confined courts to emergency matters (orders of Mar. 16, 20, 23 and Apr. 6); and the Commissioner of Insurance froze policy cancellations and nonrenewals from March 12 to May 12 (Emergency Rule 40). Phase 1 (58 JBE 2020, effective May 15) reopened restaurants, salons, malls, churches, casinos and gyms at 25 percent occupancy with mandatory employee face coverings and kept amusement venues, massage and tattoo establishments and bars without food permits closed; the Supreme Court barred any jury trial before June 30 and capped courthouses at 25 percent. Phase 2 (74 JBE 2020, effective June 5; renewed by 83 JBE 2020 on June 25 with a 250-person indoor crowd cap) raised most sectors to 50 percent and let bars without food permits open at 25 percent. 2020 Q3: 89 JBE 2020 (July 11, effective July 13) imposed the statewide face-covering order, closed every bar to on-premises consumption and cut crowds to 50 indoors and outdoors; those measures were renewed unchanged by 96, 101 and 110 JBE 2020 through September 11, and the Eastern District of Louisiana refused to enjoin the bar closure in 4 Aces Enterprises v. Edwards (Aug. 17, 2020). Phase 3 (117 JBE 2020, effective Sept. 11; 123 JBE 2020 amendment of Sept. 17) raised most sectors to 75 percent but kept casinos at 50 percent, event centers at 50 percent or 250, crowds at 50 percent or 250, on-premises alcohol service to 8 a.m.-11 p.m., bars closed except in parishes at or below 5 percent positivity that opted in (25 percent or 50 patrons), and the mask order statewide; the LDH State Health Officer ordered every nursing facility to follow CMS QSO-20-39-NH visitation rules (Sept. 18) and every PK-12 school to report cases (Sept. 1); BESE's emergency rule of July 14 fixed school group sizes at 10/25/50 by phase and required face coverings for adults and grades 3-12. 2020 Q4: Phase 3 was renewed (134 JBE 2020, Oct. 8; 143 JBE 2020, Oct. 22; 158 JBE 2020, Nov. 5); a petition signed by a majority of the House of Representatives on October 23, 2020 purporting to terminate the emergency under La. R.S. 29:768(B) was declared unenforceable by the 19th Judicial District Court on November 12, 2020 and the regime continued without interruption; on November 24 the State stepped back to Modified Phase 2 (168 JBE 2020, effective Nov. 25): 50 percent occupancy for restaurants, retail, salons, gyms and malls, crowds capped at 25 percent or 75 indoors and 150 outdoors, bars closed indoors except in opted-in parishes at or below 5 percent positivity, alcohol service ended at 11 p.m., athletic events at 25 percent, event centers at 25 percent or 75, and the statewide mask order. 2021 Q1: Modified Phase 2 was renewed through March 3 (209 JBE 2020, Dec. 22; 6 JBE 2021, Jan. 12; 17 JBE 2021, Feb. 10), and from January 13, 2021 the proclamations ordered every State and local office to 'develop or continue plans to allow for employees to work remotely to the extent practical' and 'strongly encouraged' every business to do the same; the Supreme Court barred jury trials statewide from January 11 to April 1, 2021. Phase 3 resumed March 3 (29 JBE 2021: 75 percent; bars 25 percent or 250; crowds 250 indoors; alcohol to 11 p.m.; masks), and on March 31 (66 JBE 2021) most capacity limits ended but event centers, sporting events and conventions stayed at 50 percent, indoor crowds at 500, and the mask order stayed statewide. 2021 Q2: 79 JBE 2021 (Apr. 27, effective Apr. 28) lifted the general mask order but kept masks on public conveyances, in State offices (opt-out) and in every early childhood, K-12 and postsecondary institution, and kept 75 percent caps (100 percent with masks) on athletic events, event centers, theaters and conventions; 85 JBE 2021 (May 14) freed State offices; 93 JBE 2021 (May 25, effective May 26) ended the last capacity and crowd rules, ended school masks at the close of the 2020-2021 academic year, and kept masks on public conveyances and in correctional institutions; the LDH released its medical, surgical and dental procedure orders effective May 24, 2021. 2021 Q3: the emergency was renewed on June 22 (117 JBE 2021, to July 21) and July 21 (131 JBE 2021, to Aug. 18) with the conveyance mask rule, the correctional mask rule, the high-risk stay-home directive and the State-employee remote-work and quarantine guidelines; on August 2, 2021, 137 JBE 2021 reinstated a statewide indoor mask mandate for every person five and older 'when indoors in any place outside of a private residence,' effective August 4, enforced by citations against businesses and organizations that fail to enforce it; 167 JBE 2021 (Aug. 31) extended it to September 29 and 181 JBE 2021 (Sept. 28) to October 27, so the mandate was in force on every day from August 4 through September 30, 2021 and beyond; 145, 168 and 182 JBE 2021 carried the emergency suspensions; the Commissioner of Insurance issued Emergency Rule 46 (Aug. 12, effective Aug. 9) on hospital surge transfers; the LDH's August 3, 2021 school decision tree fixed 10-day isolation and quarantine rules for K-12 schools. The general mask mandate ended October 27, 2021 (203 JBE 2021), which kept masks in K-12 schools unless a system adopted the LDH quarantine protocol. Louisiana never preempted local orders: every mitigation proclamation preserved local authority to be stricter, and New Orleans was stricter throughout. Louisiana issued no travel-quarantine order and no statewide health-care-worker or State-employee vaccination mandate in the claim period.

What remained in force

The statewide public health emergency (renewed June 22, July 21, Aug. 2, Aug. 31 and Sept. 28, 2021); the directive that persons at higher risk 'should stay at home' except for enumerated activities; the face-covering requirement on public conveyances and in transportation hubs (restating the CDC order); face coverings in all correctional institutions; face coverings in early childhood, K-12 and postsecondary institutions through the last day of the 2020-2021 academic year; State-employee COVID-19 sick-leave, quarantine and remote-work guidelines (Civil Service Commission and Division of Administration), procurement and legal-deadline suspensions (94, 118, 132, 145, 168, 182 JBE 2021); the LDH nursing home, adult residential care and ICF/DD visitation order of Sept. 18, 2020 (until further notice); the LDH school reporting order of Sept. 1, 2020 (until rescinded); local authority to impose stricter measures (New Orleans reinstated masks July 30, 2021 and vaccination-or-test entry Aug. 16, 2021); and, from August 4, 2021, the reinstated statewide indoor mask mandate (137, 167, 181 JBE 2021) through October 27, 2021.

Preemption of local orders

None. Louisiana did not preempt or bar local COVID-19 orders at any time in the claim period. Proclamation 30 JBE 2020 Section 1 (Mar. 16, 2020): 'This order does not limit the ability of a local jurisdiction or political subdivision from enacting more restrictive limitations.' Every mitigation proclamation from 79 JBE 2021 (Apr. 27, 2021) forward, including 85, 93, 117, 131, 137, 167, 181 and 203 JBE 2021, provides that 'All local governing authorities and operators of private businesses and organizations shall retain the authority to issue more restrictive measures than that imposed by the State,' and 79, 85, 93, 117 and 131 JBE 2021 add 'including requiring members of the public to wear face coverings while in local governmental buildings and private business establishments.' Every phase proclamation declared a statewide state of emergency under La. R.S. 14:329.6 'for the purposes of allowing the chief law enforcement officer of any political subdivision to... promulgate orders for any provision therein, including a local curfew from 10:00 p.m. to 5:00 a.m.' The only relaxation mechanism ran the other way: 89 JBE 2020 let a parish opt out of the face-covering requirement if its two-week incidence was below 100 per 100,000 (opt-out removed by 117 JBE 2020 on Sept. 11, 2020), and 117, 134, 158, 168 JBE 2020 and 209 JBE 2020, 6, 17 and 29 JBE 2021 let a parish at or below 5 percent positivity opt in to bar service. The Legislature's attempt to end the emergency by petition under La. R.S. 29:768(B) (Oct. 23, 2020) was declared void by the 19th Judicial District Court (Nov. 12, 2020) and had no effect on any instrument; the Governor's proclamations were renewed without interruption.

Travel and quarantine

No Louisiana travel-quarantine order. Persons at higher risk 'should stay at home' except for enumerated essential activities in every proclamation from 58 JBE 2020 (May 15, 2020) through 203 JBE 2021 (Oct. 26, 2021), unvaccinated only from Mar. 31, 2021; the CDC conveyance mask order was restated as a State requirement in 79, 85, 93, 117, 131, 137, 167, 181 and 203 JBE 2021 § 3(B); State-employee quarantine guidelines in every extension proclamation; LDH K-12 quarantine rules (LA-054); Louisiana travelers were quarantined by Texas (GA-12, Mar. 29, 2020), Florida (EO 20-86, Mar. 27, 2020) and other States (their files).

Face coverings

May 15, 2020 every owner or employee with public contact must wear a face covering (58 § 2(D); 74 § 2(C)); July 13, 2020 every individual must wear a face covering 'when inside a commercial establishment or any other building or space open to the public, whether indoor or outdoor,' including public and commercial transportation; businesses must require it; citations only to businesses that fail to enforce; parish opt-out below 100 cases per 100,000 (89 § 4); Sept. 11, 2020 statewide without opt-out (117 § 3), continued by 134, 158, 168, 209 JBE 2020 and 6, 17, 29, 66 JBE 2021 to Apr. 27, 2021; Apr. 28, 2021 general mandate lifted, kept on conveyances, in State offices (opt-out) and in all schools (79); May 14 State offices freed (85); May 26 schools freed at year end (93); Aug. 4-Oct. 27, 2021 indoor mandate for all persons five and older in any place outside a private residence, businesses cited for failure to enforce, local authority to be stricter preserved (137, 167, 181); Oct. 27, 2021 recommendation only except K-12 (203).

Vaccination mandates

None issued by the State of Louisiana for health-care workers, State employees or the public in the claim period. Proclamations from 66 JBE 2021 (Mar. 30, 2021) exempted fully vaccinated persons from the high-risk stay-home directive and, from Apr. 28, 2021, from certain mask rules in groups of ten or fewer; 137 JBE 2021 (Aug. 2, 2021) applied the indoor mask mandate to vaccinated and unvaccinated persons alike; the LDH K-12 decision tree of Aug. 3, 2021 exempted fully vaccinated close contacts from quarantine. Vaccination-proof entry rules in the period were local and federal (EO 14042, 14043; FED-B).

Standing duties

The statutes, codes and penalty provisions of Louisiana that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Louisiana duties →

Louisiana law placed every person, every employer and every owner or operator of premises under standing duties that made the pandemic measures compulsory from March 11, 2020 through the third quarter of 2021 and beyond. Title 40 commands the state health officer to 'prepare, promulgate, and enforce' the Sanitary Code, and requires that the Code 'provide for and require... application and implementation of appropriate control measures to expressly include isolation and quarantine proceedings and measures, for all communicable diseases of public health significance' (R.S. 40:4(A)(2), Ex. DUT-LA-001); paragraph (A)(13) makes the state health officer 'expressly empowered and authorized to issue emergency rules and orders when necessary and for the purposes of controlling... communicable, contagious, and infectious diseases, and any other danger to the public life, health, and safety.' R.S. 40:5 vests in the state health officer and the office of public health 'exclusive jurisdiction, control, and authority' to 'isolate or quarantine for the care and control of communicable disease,' to 'take such action as is necessary to accomplish the subsidence and suppression of diseases of all kinds in order to prevent their spread,' over 'all places of public accommodation' and 'the sanitary conditions required at any public gathering or meeting' (Ex. DUT-LA-002). R.S. 40:6 makes any violation of the Sanitary Code a crime, makes a violation of its isolation or quarantine provisions punishable by up to two years, authorizes the district attorney to enjoin any violation 'when necessary to arrest or prevent epidemics or to abate any imminent menace to the public health,' and adds civil fines of up to $100 per day per violation (Ex. DUT-LA-003). R.S. 40:7 directs the state health officer to quarantine an infected parish or municipality and provides that the resulting rules 'shall be observed and obeyed' (Ex. DUT-LA-004). The Sanitary Code itself (LAC 51:II.117) makes it the state health officer's 'duty' to institute control measures whenever a case of communicable disease occurs and to declare any 'house, building, apartment, room, or place' where a case occurs a place of quarantine, makes it 'a violation of this code for any person to enter or leave any quarantined area,' and gives locality-quarantine rules 'the same force and authority as this code' (Ex. DUT-LA-005). Every one of the Governor's COVID-19 proclamations recited these powers, expressly empowering the Secretary of Health and the State Health Officer 'to take any and all actions authorized thereto under Titles 29 and 40 of the Louisiana Revised Statutes and under the State Sanitary Code (LAC Title 51)' (Exs. LA-012 sec. 1(C), LA-023, LA-029, LA-036). The emergency statutes made obedience to every proclamation a legal duty enforced by criminal penalty: under R.S. 29:724(A) the Governor's 'proclamations, and regulations so issued shall have the force and effect of law,' and under R.S. 29:724(E) 'any person or representative of any firm, partnership, or corporation violating any order, rule, or regulation promulgated pursuant to this Chapter, shall be fined not more than five hundred dollars or confined in the parish jail for not more than six months, or both' (Ex. DUT-LA-006); the Louisiana Health Emergency Powers Act, under which Proclamation 25 JBE 2020 issued, declares that 'the government must do all that is reasonable and necessary to protect the health and safety of its citizens' (R.S. 29:761, Ex. DUT-LA-017), empowers the Governor to 'control ingress and egress to and from a disaster area, the movement of persons within the area, and the occupancy of premises therein' (R.S. 29:766(D)(7), Ex. DUT-LA-007), and empowers the State 'to close, direct and compel evacuation of, or to decontaminate or cause to be decontaminated any facility of which there is a reasonable cause to believe that it may endanger the public health' (R.S. 29:769(A)(1), Ex. DUT-LA-008); every proclamation from Phase 1 forward also declared a state of emergency 'pursuant to La. R.S. 14:329.6,' under which local chief law enforcement officers may order the 'closing of places of amusement and assembly' and regulate 'the occupancy and use of buildings,' with a $500 or six-month penalty under R.S. 14:329.7 (Exs. DUT-LA-009, DUT-LA-015); parish presidents held parallel powers over 'the occupancy of premises' under R.S. 29:727(F)(7) (Ex. DUT-LA-016). Every Louisiana employer was bound by R.S. 23:13 to 'furnish employment which shall be reasonably safe for the employees therein,' to 'adopt and use methods and processes reasonably adequate to render such employment and the place of employment safe,' and to 'do every other thing reasonably necessary to protect the life, health, safety and welfare of such employees' (Ex. DUT-LA-010), and by the federal general duty clause. In June 2020 the Legislature enacted three liability shields, each retroactive to March 11, 2020, and each protecting only the business that 'substantially compl[ied] with the applicable COVID-19 procedures established by the federal, state, or local agency which governs the business operations' (Acts 2020, No. 336, R.S. 9:2800.25(A), Ex. DUT-LA-011; Acts 2020, No. 362, R.S. 29:773(A), Ex. DUT-LA-012) or, for restaurants, 'in substantial compliance with Proclamation Number 25 JBE 2020 and any subsequent related proclamations and applicable COVID-19 procedures established by a federal, state, or local agency' (Acts 2020, No. 305, Ex. DUT-LA-013): the Legislature made compliance with the health protocols the legal standard of care. The proclamations made continued operation conditional in terms: the stay-at-home order required every non-CISA business to 'reduce operations to continue with minimum contact with members of the public and essential employees, while requiring proper social distancing' (Ex. LA-005 sec. 6); Phase 1 through Phase 3 allowed each sector to operate only 'under the following conditions,' capped occupancy 'as determined by the State Fire Marshal,' required that 'all businesses and organizations shall require that any owner or employee having interaction or contact with the public shall wear a mask or a face covering,' and provided that 'any business operating pursuant to this subsection shall follow the applicable guidance from the State Fire Marshal published at opensafely.la.gov and the Louisiana Department of Health with regard to sanitization and disinfection' (Exs. LA-012, LA-023, LA-029); the statewide face-covering orders required 'all businesses or organizations... [to] require all persons who enter the premises to wear a face covering' and provided that 'citations under this Section shall be written only to businesses or organizations... that fail to enforce the requirement' (Exs. LA-014 sec. 4, LA-023 sec. 3, LA-036 sec. 2). The Fifth Circuit affirmed the district courts' refusal to enjoin the bar-closure proclamations, holding the orders 'at least rationally related to reducing the spread of COVID-19' (Big Tyme Investments, L.L.C. v. Edwards, No. 20-30526 (5th Cir. Jan. 13, 2021), Ex. DUT-LA-014), as the Eastern District of Louisiana had done in 4 Aces Enterprises, LLC v. Edwards (Ex. LA-075). Where the text of an instrument recommends rather than commands (the proclamations' 'strongly encouraged' clauses for individual masking before July 13, 2020; the 'is encouraged to follow' clause for shopping malls in 66 JBE 2021; the 'should' sentences of the Open Safely and Return to Work guidance), the records say so, and the legal effect of guidance is located in the proclamation clause that incorporates it with the verb 'shall follow.'
