ScopeCincinnati and Hamilton County, Ohio (City of Cincinnati mayoral emergency declarations and emergency orders, City Council ordinances, Hamilton County Court of Common Pleas and Hamilton County Municipal Court joint administrative orders, Hamilton County Public Health advisories, Southwest Ohio Regional Transit Authority (Metro) orders, Cincinnati Public Schools); Northern Kentucky (City of Covington emergency declaration and executive orders, Transit Authority of Northern Kentucky, Boone County Fiscal Court, Northern Kentucky Health Department). Statewide Ohio and Kentucky instruments are cited by name and date only.

The Cincinnati metropolitan area straddles two States whose regimes differed in structure but not in reach. On the Ohio side the general closures, the stay-at-home order, the gathering caps, the county-tier mask order, the statewide mask order (July 23, 2020), the November 19, 2020 curfew and the June 2, 2021 rescission were Ohio Department of Health instruments (OH file). The local layer sat on top of them and, in Cincinnati, added orders of its own with the force of law. The Mayor of Cincinnati declared a local emergency on March 11, 2020 under Article III of the Charter and Article XVIII of the Administrative Code (Ex. MET-CIN-050); Council amended Article XVIII, Section 9 on March 20, 2020 so that a declared emergency would continue until the declaring officer ended it rather than lapsing after two weeks (Ordinance 0096-2020, Ex. MET-CIN-029). Under the declaration the Mayor and the Cincinnati Board of Health issued numbered Joint Emergency Orders with 'the force of law': No. 4 (March 17, 2020) required 'all individuals in the public spaces of the City of Cincinnati... to maintain a minimum of six feet (6') of physical distance from other persons at all times' and stayed in force until rescinded May 27, 2020 (Exs. MET-CIN-045, -051); No. 6 (April 1, 2020) required every restaurant remaining open for carry-out to 'develop and submit a plan' for compliance with State and local orders (Ex. MET-CIN-048); No. 7 closed the streetcar and No. 8 closed 'all bike sharing and electric scooter services and rental businesses... for the duration of the declared emergency' (Exs. MET-CIN-047, -049); No. 9 (April 14, 2020) ordered every person who tested positive, was diagnosed, or had 'reason to believe they have COVID-19' to self-isolate at home for 14 days (Ex. MET-CIN-046). On May 13, 2020 Council enacted Ordinance 0141-2020, forbidding any employer to demote, terminate or take adverse action against an employee for obeying an order of the Mayor, the Governor, the Ohio Department of Health, the Cincinnati Health Commissioner or the Board of Health to remain at home, quarantine or isolate, with treble-wage damages (Ex. MET-CIN-030), and Ordinance 0142-2020, creating civil offenses for failing to comply with emergency orders and health orders (Ex. MET-CIN-031). The Mayor reissued the declaration on June 29, 2020 for the reopening phase (Ex. MET-CIN-019), and on July 3, 2020 Council passed Emergency Ordinance 0246-2020, effective July 9, 2020: every individual in the City 'shall wear a facial covering' when entering, waiting to enter, or inside the public areas of any place of business, in any City building, and 'in any public transportation vehicle,' every place of business 'shall require all employees that interact with the public to wear a facial covering,' a $25 civil penalty applied, and the ordinance ran 'during the pendency of the Declaration of Emergency issued by the Mayor effective June 29, 2020' (Ex. MET-CIN-001). Metro made the requirement operative on every bus from 6:00 p.m. July 8, 2020 (Ex. MET-CIN-015). The Mayor reissued the declaration again on November 16, 2020 for the winter wave (Ex. MET-CIN-024) and, the same day, Joint Emergency Order 14 suspended all public meetings of the City through December 13, 2020; amended orders of February 18 and March 8, 2021 prohibited in-person public attendance at City meetings through April 18, 2021 (Exs. MET-CIN-028, -032, -033). On April 28, 2021 Council enacted Ordinance 0137-2021, barring eviction actions for nonpayment of rent where the tenant tenders the arrears, 'for so long as the State of Emergency declared by the Governor... on March 9, 2020 exists' (Ex. MET-CIN-021). On May 17-18, 2021 the Mayor, City Manager and Health Commissioner rescinded the June 29, 2020 declaration, ending the City mask ordinance, and issued a limited declaration to run until the end of the Governor's statewide emergency (Exs. MET-CIN-022, -023). The Hamilton County courts ran a parallel and longer regime: Joint Administrative Order M200001 (March 13, 2020) suspended all jury trials and continued all civil and criminal matters for thirty days from March 16, 2020 and relocated all in-person Clerk operations (Ex. MET-CIN-008); the March 24 and April 6, 2020 orders limited courthouse access to 'critical court proceedings' and suspended petit jury summons (Exs. MET-CIN-009, -002); the April 6, 2020 screening order required every person entering the Courthouse to submit to questions and a temperature check and excluded anyone exposed within 14 days (Ex. MET-CIN-003); the June 1, June 22 and September 25, 2020 orders capped in-person dockets (fifteen to twenty cases), limited access to necessary participants, and ordered every entrant to wear a face covering (Exs. MET-CIN-004, -010, -005); jury trials were suspended October 26, 2020 to March 8, 2021 (Exs. MET-CIN-006, -011, -026, -012); the June 3, 2021 order lifted the access limits but kept the exclusion of symptomatic and exposed persons and each judge's authority over capacity and masks (Ex. MET-CIN-025); and on August 11, 2021 Joint Amended Administrative Order M210001 ordered that 'anyone entering Court Facilities... shall wear a facial covering/mask in all common areas,' in force until February 24, 2022 (Exs. MET-CIN-007, -027). Hamilton County Public Health issued advisories rather than orders (November 19, 2020 stay-at-home advisory, Ex. MET-CIN-013; July 30, 2021 universal indoor masking recommendation, Ex. MET-CIN-035) and communicated the State's county-tier mask mandate effective July 8, 2020 (Ex. MET-CIN-036). Metro suspended fares and cut service to a Saturday schedule from March 29, 2020, resumed fares April 12, and restored full service June 28, 2020 (Exs. MET-CIN-016, -018, -017). On the Kentucky side the regime was the Commonwealth's (Governor Beshear's executive orders and Cabinet for Health and Family Services orders, KY file); the Northern Kentucky Health Department issued no general closure or mask order this research located. Covington's Mayor declared a State of Emergency on March 19, 2020 and by executive order closed Commission meetings to the public from March 24, 2020 and closed playgrounds, courts and fields on March 27, 2020; the City Manager closed the City Hall lobby from March 17, 2020 and sent non-essential staff home March 23, 2020 (Exs. MET-CIN-037 to -041, -044); TANK moved to Sunday schedules, free fares and rear-door boarding from March 23, 2020 (Ex. MET-CIN-040); Boone County Fiscal Court met by videoconference under the state of emergency (Ex. MET-CIN-052). For the third quarter of 2021 the local instruments in force were the Hamilton County courts' June 3 and August 11, 2021 orders, the codified Cincinnati ordinances 0141-2020 and 0142-2020, the federal transit mask order on Metro and TANK, and (Kentucky) the Commonwealth's school-mask regulations of August-September 2021; the Cincinnati mask ordinance and emergency orders had ended May 17-18 and June 18, 2021.

The State and the local orders

Ohio did not bar local mask or emergency orders in 2020-2021; Cincinnati's Ordinance 0246-2020 ran from July 9, 2020 to May 17, 2021 without State interference, and the July 8, 2020 State mask order for Level 3 counties (Hamilton included) and the July 23, 2020 statewide order overlaid rather than displaced it. Ohio Senate Bill 22 (effective June 23, 2021; OH file) limited State and local health authority prospectively (general isolation and quarantine orders confined to persons diagnosed or directly exposed, R.C. 3709.212; legislative power to rescind executive orders) and is the reason no Ohio local government in this metro reissued a general mask mandate in the third quarter of 2021; the courts' August 11, 2021 mask order was issued under the judiciary's own authority and was unaffected. Kentucky's regime was statewide and the Commonwealth's; the 2021 General Assembly's limits on the Governor (HB 1, SB 1, SB 2), Cameron v. Beshear (Ky. Aug. 21, 2021), and the September 2021 special session (SB 1, leaving school masking to districts) are KY-file instruments. Northern Kentucky local governments did not issue general business orders of their own in 2020-2021 that this research located; the Northern Kentucky Independent District Board of Health's 2021 posts are meeting notices only.
