The record in brief

Kentucky's regime was statewide, executive-branch driven and dense from March 16, 2020 through June 11, 2021, and it was re-tightened twice (July-August 2020 and November 20-December 13, 2020). The predicate is Executive Order 2020-215 (March 6, 2020), declared under KRS Chapter 39A, ratified by the General Assembly in 2020 SB 150 (Acts ch. 73, March 30, 2020), upheld by the Supreme Court of Kentucky in Beshear v. Acree (Nov. 12, 2020), extended by 2021 HJR 77 (March 30, 2021) and by 2021 Special Session HJR 1 (Sept. 7, 2021) through January 15, 2022. 2020 Q2 (with the March 13-31 run-up): the Cabinet for Health and Family Services (CHFS) closed dine-in food and beverage service at 5 p.m. March 16 (KY-003), closed all public-facing businesses that encourage congregation at 5 p.m. March 18 (KY-004), prohibited all mass gatherings on March 19 (KY-006); the Governor directed state agencies to conduct business remotely and suspended in-person-appearance statutes (EO 2020-243, KY-005), closed all non-life-sustaining in-person retail at 8 p.m. March 23 (EO 2020-246, KY-008), ordered every non-life-sustaining business to cease operations at 8 p.m. March 26 (EO 2020-257, Healthy at Home, KY-010, construed 'broadly to prohibit in-person work that is not necessary to protect or sustain life', with professional-services firms required to implement telecommuting 'to the fullest extent possible'), suspended in-person government services and evictions (same order), instructed residents not to travel out of state and imposed 14-day quarantines on return (EO 2020-258, KY-011; extended to inbound travelers by EO 2020-266, KY-013), limited life-sustaining retail to one adult shopper per household (EO 2020-275, KY-014), and CHFS ordered all non-emergent, non-urgent medical, surgical and dental care to cease as of March 18 (KY-009). Reopening (Healthy at Work) began with health care on April 27 (KY-015), then EO 2020-323 (May 8, KY-017) reopened manufacturing, construction, dealerships and offices (50 percent of employees) on May 11 under mandatory CHFS 'Requirements' (KY-019, KY-065, KY-066), retail at 33 percent on May 20 (KY-064), restaurants at 33 percent on May 22, salons on May 25, gyms and theaters at 33 percent on June 1 (KY-069), child care in groups of ten on June 15 (KY-070), and on June 29 CHFS raised restaurants, bars and venues to 50 percent (KY-021). The travel orders were replaced on May 6 by a quarantine request (EO 2020-315, KY-016). 2020 Q3: the statewide face-covering mandate took effect at 5 p.m. July 10 (EO 2020-586, KY-022) and was renewed every thirty days through June 11, 2021 (KY-028, KY-030, KY-031, KY-036, KY-038, KY-039, KY-043, KY-045, KY-047); CHFS cut social gatherings to ten people on July 20 (KY-023), issued a 14-day quarantine travel advisory (KY-024), closed bars and cut restaurants to 25 percent indoors on July 28 (KY-025, KY-072), and reopened them at 50 percent with a 10 p.m. last call and 11 p.m. close on August 11 (KY-026, KY-073). Health-care visitor limits, screening, masking and 30 percent reserved hospital capacity continued under the September 10, 2020 CHFS order (KY-029). The Supreme Court of Kentucky stayed every injunction against these orders on July 17, 2020 and sustained them on November 12, 2020 (KY-032). 2020 Q4: the winter re-tightening (EO 2020-968, KY-033) closed indoor dining, capped gyms at 33 percent, venues at 25 people per room and offices at 33 percent with a telework mandate from 5 p.m. November 20 through 11:59 p.m. December 13, and EO 2020-969 (KY-034) put every K-12 school in remote instruction from November 23 (middle and high schools through January 4, 2021); indoor dining resumed December 14 at 50 percent with an 11 p.m. service cutoff and midnight closing; the courts postponed jury trials to February 1, 2021 and required facial coverings in court facilities (KY-035, KY-063). 2021 Q1: masks, 50 percent capacity and the office telework rule continued; the General Assembly enacted HB 1, SB 1 and SB 2 over vetoes on February 2, 2021 (KY-040, KY-041), the Franklin Circuit Court enjoined them in March, HJR 77 (March 30, KY-046) ratified EO 2020-215 for 90 days and terminated every other unlisted order (also enjoined), capacity rose to 60 percent for eighteen industries on March 1 (KY-018 is the April 19, 2021 minimum requirements carrying the 60 percent and telework rules), and schools were ordered to in-person instruction by March 1 with universal masking (EO 2021-120, KY-042). 2021 Q2: 75 percent capacity from May 28; vaccinated persons exempt from masks from May 13 (EO 2021-326, KY-048); EO 2021-386 (June 11, 1 p.m., KY-049) rescinded the Healthy at Home and Healthy at Work orders and every capacity rule, keeping masks in health care, long-term care and public transportation. 2021 Q3: the state of emergency remained in force every day of the quarter; EO 2021-386's residual mask rules ran to September 7; masks were required in all state office buildings from late July; universal masking and a staff vaccination-or-testing rule were imposed in state-run health facilities from August 3 (CHFS announcement); EO 2021-585 (August 10, 4 p.m., KY-052) required masks in every public and private preschool-12 school and child-care setting; the Kentucky Board of Education's 702 KAR 1:195E (filed August 12, KY-053) and CHFS's 902 KAR 2:213E (filed August 12, KY-054) imposed the same rules by regulation; Cameron v. Beshear (August 21, KY-055) directed dissolution of the injunction against the 2021 legislation; HJR 1 (September 7, KY-056) terminated every un-extended executive order and extended EO 2020-215, EO 2020-243's remote-services directives and dozens of cabinet and board orders to January 15, 2022; SB 1 (Acts ch. 4, veto overridden September 9, KY-057) nullified both mask regulations and left masking to districts; the courts' AO 2021-27 and 2021-28 (August 9, KY-058, KY-059) governed court access and jury trials throughout the quarter.

What remained in force

The state of emergency under EO 2020-215 (kept 'in place' by EO 2021-386 para. 5 and extended by 2021 SS HJR 1 to January 15, 2022); face coverings required for any person on planes, buses, trains and other public transportation and in transportation hubs, in any health-care setting and in any long-term-care setting (EO 2021-386 para. 4); the Supreme Court of Kentucky's administrative orders on court facilities and proceedings (AO 2021-16/17 to Aug. 9, 2021; AO 2021-27/28 thereafter); CHFS health-care directives and testing orders; the sector boards' and cabinets' orders later ratified by HJR 1; from July 29-30, 2021 masks in all state office buildings; from Aug. 3, 2021 universal masking in state-run health-care facilities; from Aug. 10, 2021 EO 2021-585 (school and child-care masks) and from Aug. 12, 2021 702 KAR 1:195E and 902 KAR 2:213E, all ended by HJR 1 (Sept. 7) and SB 1 (Sept. 9), after which school masking continued district by district and health-care masking under federal rules.

Preemption of local orders

Kentucky did not bar local orders during 2020. The Governor's and CHFS orders expressly delegated to local health departments 'the authority to take all necessary measures to implement this Order' (CHFS orders of Mar. 16, 17 and 19, 2020; EO 2020-257 para. 6), and EO 2020-586 para. 7 'encouraged' local governments to adopt its requirements; local health departments (KRS ch. 212) and the consolidated governments of Louisville and Lexington issued their own instruments. The General Assembly's 2021 legislation is the preemption layer: HB 1 (Acts ch. 3, Feb. 2, 2021) provides that 'No state or local agency shall enforce restrictions related to the state of emergency impacting the ability of the entities listed in this subsection to remain open and fully operational for in-person services that exceed current applicable guidelines issued by the Centers for Disease Control and Prevention or the executive branch, whichever is least restrictive' (sec. 1(1)(c)); SB 1 (Acts ch. 6) added KRS 39A.100(4)-(5) barring 'any governmental entity' from restricting the right to peaceably assemble or to worship in person; both were enjoined by the Franklin Circuit Court from March 2021 until the Supreme Court's Aug. 21, 2021 mandate (Cameron v. Beshear) and were therefore operative for the balance of Q3 2021. 2021 SS SB 1 (Acts ch. 4, Sept. 9, 2021) nullified the statewide school and child-care mask regulations and vested masking decisions in local school boards, so local school-district mask policies, not State orders, governed from Sept. 10, 2021.

Offices and telework

EO 2020-257 para. 1(o): 'Professional services firms must implement telecommuting and remote work to the fullest extent possible, and should only use in-person interaction to support Minimum Basic Operations or where telecommuting is impossible' (Mar. 26, 2020); EO 2020-323 reopened offices May 11, 2020 at 50 percent of in-person employees (KY-017 para. 2(f)) with the CHFS requirement that 'Employees who are currently able to perform their job duties via telework should continue to telework' and 'no more than 50% of employees are physically present in the office on any given day' (KY-019); Nov. 20-Dec. 13, 2020: 'All professional services and other office-based businesses must mandate that all employees who are able to work from home do so, and close their businesses to the public when possible. Any office that remains open must ensure that no more than 33% of employees are physically present in the office any given day' (KY-033 para. 8); 50 percent with the work-from-home mandate from Dec. 14; 60 percent Mar. 1, 2021; minimum requirements of Apr. 19, 2021: 'Employees able to perform their job duties via telework (phone or internet) should do so as much as possible' (KY-018); rescinded June 11, 2021.

Manufacturing

Critical-product manufacturing permitted under EO 2020-257 para. 1(p); all other manufacturing ceased Mar. 26 and reopened May 11, 2020 under EO 2020-323 para. 2(a) (KY-017) and the Manufacturing, Distribution and Supply Chain requirements v1.2 (KY-065); rescinded June 11, 2021.

Construction

Designated life-sustaining and permitted to continue under EO 2020-257 para. 1(h) (KY-010) subject to social distancing; from May 11, 2020 subject to the mandatory Construction requirements v1.1 (KY-066) and minimum requirements; rescinded June 11, 2021.

Real estate

Real-estate, appraisal and title services classed as professional services permitted only with telecommuting to the fullest extent possible (EO 2020-257 para. 1(o)); Real Estate Authority orders ratified by HJR 77; residential evictions suspended Mar. 26-Aug. 24, 2020 (KY-010 para. 5, KY-017 para. 7, KY-027) with 30-day notice and meet-and-confer rules thereafter; court eviction dockets suspended (KY-002) and later held in abeyance (KY-059); offices at 50 percent from May 11, 2020 (KY-019).

Hospitals and long-term care

Elective procedures ceased Mar. 18, 2020 (KY-009); phased resumption Apr. 27-May 27 with 'at least 30% bed capacity' reserved and pre-procedure testing (KY-029); visitor bans then one visitor per patient (KY-029 para. 15-16); long-term-care visitation under CHFS guidance and CMS; universal masking in state-run health facilities and staff vaccination-or-testing from Aug. 3, 2021; masks in health-care and long-term-care settings required by EO 2021-326 and EO 2021-386 through Sept. 7, 2021; SB 2 (KY-061) long-term-care visitation rights from Sept. 9, 2021.

Dental and elective health care

All non-emergent, non-urgent in-person medical, surgical, dental and other health-care practice ceased close of business Mar. 18, 2020 (KY-009); outpatient services, clinics, PT, optometry and dental offices (with enhanced aerosol protections) resumed Apr. 27 (KY-015); outpatient surgery May 6; inpatient surgery 50 percent May 13 and full volume May 27 (KY-029 bundle); waiting rooms eliminated, screening, universal masking, 14-day PPE supply and visitor limits continued under the Sept. 10, 2020 order (KY-029); Board of Dentistry order of Apr. 17, 2020 ratified through Jan. 15, 2022 (KY-046, KY-056).

Schools

In-person classes ceased by recommendation Mar. 16, 2020 and remained closed through the 2019-20 year; KDE Healthy at School guidance; all K-12 schools ordered remote from Nov. 23, 2020, middle and high schools through Jan. 4, 2021, elementary reopening Dec. 7 outside red counties (KY-034); Healthy at School expectations mandatory from Jan. 4, 2021 with virtual options and high-risk staff accommodations (KY-037); in-person instruction by Mar. 1, 2021 with universal masking (KY-042); masks in all schools Aug. 10, 2021 (KY-052) and 702 KAR 1:195E Aug. 12 (KY-053); nullified by SB 1 Sept. 9, 2021 (KY-057), which authorizes district masking, quarantine and test-to-stay policies and remote days.

Child care

Centers ordered closed by Mar. 20, 2020 (CHFS directive; recited in Governor's release of Mar. 17); reopened June 15, 2020 with a maximum group size of ten (KY-070); regular group sizes restored Mar. 15, 2021; masks for all staff, visitors and children age two and older from Aug. 10, 2021 (KY-052) and 902 KAR 2:213E Aug. 12 (KY-054); nullified Sept. 9, 2021 (KY-057).

Worship and gatherings

All mass gatherings prohibited Mar. 19, 2020 (KY-006, faith-based events named); in-person worship resumed May 20, 2020 at 33 percent (KY-067); gatherings of 10 from May 22, 50 from June 29, back to 10 on July 20 (KY-023); indoor social gatherings capped at 8 people from 2 households Nov. 20-Dec. 13, 2020 (KY-033 para. 5); worship exempt from the 25-person venue cap; caps lifted June 11, 2021; SB 1 (KY-041) bars restrictions on in-person worship from Aug. 21, 2021.

Vaccination mandates

No statewide health-care-worker or State-employee vaccination mandate; CHFS required staff and contractors in state-operated health-care facilities to be vaccinated by Oct. 1, 2021 or tested at least twice weekly (announced Aug. 2, 2021; verified_secondary); 2021 SS SB 2 (KY-061) directs vaccine promotion and creates a single vaccination permitting form.

Standing duties

The statutes, codes and penalty provisions of Kentucky that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Kentucky duties →

Kentucky law imposed, throughout the six quarters, five standing duties that made the pandemic protocols compulsory for every employer and every operator of premises open to the public. First, the communicable-disease statutes commanded the Cabinet for Health and Family Services to act: KRS 214.020, in the text in force from March 6, 2020 to February 1, 2021, provided that when the Cabinet 'believes that there is a probability that any infectious or contagious disease will invade this state, it shall take such action and adopt and enforce such rules and regulations as it deems efficient in preventing the introduction or spread' of the disease and 'shall establish and strictly maintain quarantine and isolation at such places as it deems proper' (Ex. DUT-KY-009 sec. 22 (prior text in brackets); Ex. KY-032 at 82 n.61); KRS 211.180(1) directed the Cabinet to 'enforce the administrative regulations promulgated by the secretary' for the 'Detection, prevention, and control of communicable diseases' (Ex. DUT-KY-003); KRS 211.025 made it the Cabinet's duty to 'enforce all public health laws' and 'do all other things reasonably necessary to protect and improve the health of the people' (quoted in Ex. KY-032 at 82 n.62). The Cabinet's standing control regulations turned those commands on persons and premises: 902 KAR 2:050 requires the local health department or the Cabinet, whenever a person 'has been implicated as a possible reservoir or possible source of infection of any communicable disease,' to 'employ such measures as are necessary to secure adequate isolation, restriction of employment or other control procedures,' and, for implicated property, 'adequate cleaning, disinfection, or other control procedures necessary to insure cessation of transmission' (Ex. DUT-KY-006 secs. 1-2); 902 KAR 2:030 requires local health departments to inspect premises 'in a condition conducive to the spread of any communicable disease,' to 'Establish and maintain quarantine, isolation or other measures as required by law' and to 'Introduce such other measures... as are necessary because of widespread infection or threatened epidemic' (Ex. DUT-KY-020 sec. 1). Local health departments held the statutory power to 'Issue written orders directed to the owner or occupant of any property, or to any person, firm, or corporation whatever, commanding... compliance with applicable public health laws of this state and all regulations of the Cabinet' and to seek mandatory or prohibitory injunctions (KRS 212.245(5)-(6), Ex. DUT-KY-005), and Louisville's health department used that power to close businesses in the first weeks (Ex. MET-SDF-027). Failure to comply with a Cabinet regulation or order is an offense for every day of noncompliance (KRS 211.990(2), Ex. DUT-KY-004); violation of a local board's regulation carries a fine for each day (KRS 212.990(2), Ex. DUT-KY-016); willful violation of a Cabinet regulation under KRS 214.020 is a Class B misdemeanor (KRS 214.990(2) as amended February 2, 2021, Ex. DUT-KY-002). Second, the emergency-management chapter gave every order 'the full force of law' (KRS 39A.180(2), Ex. DUT-KY-007; the 2020 text quoted in Ex. KY-032 at 57) and directed 'The law enforcement authorities of the state and of its counties, urban-counties, charter counties, and cities' to 'enforce the written orders and administrative regulations issued pursuant to KRS Chapters 39A to 39F' (KRS 39A.180(4)); violation of any order under the chapter was a Class A misdemeanor (up to twelve months and $500, KRS 532.090(1), 534.040(2)(a)) until 2021 Senate Bill 1 substituted fines of $100 and $250 effective February 2, 2021 (KRS 39A.990, Ex. DUT-KY-008; the struck words 'guilty of a Class A misdemeanor' appear in Ex. KY-041 sec. 6), and Senate Bill 1 was itself enjoined from March 3 to August 21, 2021 (Exs. KY-041, KY-055). The Cabinet's own emergency regulation of August 7, 2020 made the business the enforcer: 'Any owner, operator, or employer of a business or other public-facing entity who violates this administrative regulation by permitting an individual on the premises who is not wearing a face covering... shall be fined... The business may also be subject to an order requiring immediate closure,' with enforcement by 'the Labor Cabinet, the Department for Public Health, another state regulatory agency, and each local health department' (902 KAR 2:210E sec. 3, Ex. DUT-KY-018; its predecessor 902 KAR 2:190E is quoted in Ex. KY-032 at 84-85). Third, Kentucky's own occupational safety and health act, a federally approved State plan, bound every employer to 'furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm' and to 'comply with occupational safety and health standards promulgated under this chapter' (KRS 338.031(1), Ex. DUT-KY-010), on pain of civil penalties of up to $7,000 per serious violation and $70,000 per willful or repeated violation (KRS 338.991, Ex. DUT-KY-011); the Kentucky standards board adopted the federal general-industry standards by reference (803 KAR 2:300, Ex. DUT-KY-013; Subparts I and J through 803 KAR 2:308 and 2:309) and, on July 20, 2021, adopted OSHA's COVID-19 Healthcare Emergency Temporary Standard for every covered Kentucky employer: 'an employer shall comply with 29 C.F.R. Part 1910, Subpart U' (803 KAR 2:330E sec. 2, Ex. DUT-KY-012). The Healthy at Work regime wrote the Labor Cabinet into enforcement: the requirements documents told restaurants and bars that those 'who fail to follow these requirements of the Executive Order will be subject to a fine and may also be subject to an order from a local health department or the Labor Cabinet requiring immediate closure' (Ex. KY-073), and every entity that failed to comply 'can be reported to KYSAFER at 833-KYSAFER or kysafer.ky.gov' (Ex. KY-018; Ex. DUT-KY-019). Fourth, the General Assembly's 2021 liability shield protected only the compliant: 'an owner who follows any executive action to prevent the spread of COVID-19 during the COVID-19 declared emergency' does not 'Assume responsibility, or incur liability, for any alleged injury, loss, or damage to persons or property arising from a COVID-19 claim,' where 'Executive action' means 'All orders and guidelines related to a COVID-19 declared emergency issued by the Governor or any state agency, the President of the United States or any federal agency, or a local governmental agency' and 'Industry-specific guidelines... adopted by a state agency that govern the industry' (2021 SB 5, Acts ch. 205, sec. 1(1)(d), (2), law April 11, 2021, retroactive to March 6, 2020, Ex. DUT-KY-014). Fifth, the Kentucky Food Code kept every retail food establishment under a permit that 'shall be suspended immediately upon notice to the permit holder without a hearing if... The cabinet has reason to believe that an imminent public health hazard exists' (902 KAR 45:005 sec. 7(2), Ex. DUT-KY-015), the vehicle by which the Cabinet's March 16, 2020 dine-in closure and its restaurant protocols were enforced. The Governor's orders wrote these duties into the pandemic regime in terms: every business permitted to operate 'must follow, to the fullest extent practicable, social distancing and hygiene guidance from the CDC and the Kentucky Department of Public Health. Failure to do so is a violation of this Order, and could subject said business to closure or additional penalties as authorized by law' (Ex. KY-010 para. 3); 'All entities shall implement and comply with the minimum requirements for all entities pursuant to subsequent Orders of the Cabinet for Health and Family Services' (Ex. KY-017 para. 3); and the Commonwealth's own FAQ told employers that 'each industry sector will have a list of requirements that they must meet in order to safely reopen. If a business fails to comply with those requirements, it will not be able to reopen' (Ex. DUT-KY-019). The Supreme Court of Kentucky upheld the whole structure in November 2020, holding that KRS 214.020, 211.025 and 211.180(1) 'provide a rational basis for the face covering and the social distancing measure' and that the orders 'shall have full force of law' upon filing (Ex. KY-032 at 57, 82).
