The record in brief

ScopeRiverside County and San Bernardino County, California (the Inland Empire): county health officer orders, the County Executive Officers' emergency regulations, the Riverside Superior Court's administrative and general orders, the transit agencies (Riverside Transit Agency, SunLine Transit Agency, Omnitrans) and the City of Palm Springs emergency orders, March 2020 through September 30, 2021.

Riverside and San Bernardino Counties layered their own orders on top of the Governor's Executive Order N-33-20 and the State Public Health Officer's stay-at-home order of March 19, 2020, and the two counties' regimes ran in parallel. Riverside County's Public Health Officer, Dr. Cameron Kaiser, declared a local health emergency on March 8, 2020 (ratified and extended by the Board of Supervisors on March 10, 2020, which also proclaimed a local emergency), cancelled events above 250 persons on March 12, gatherings above 10 on March 13, closed all schools by orders of March 13-17 (extended on April 1 to June 19, 2020 and, for K-12 only, re-issued May 9), confined short-term lodging (hotels, motels, vacation rentals and timeshares, defined as stays of 60 days or less) to COVID-19 mitigation uses on March 27 and April 2, closed golf courses on April 2, and on April 4, 2020, jointly with the County Executive Officer as Director of Emergency Services, prohibited all public or private gatherings regardless of venue or size, required face coverings of all persons including essential workers, closed bars and gyms, ended all on-site dining, directed every essential business to make every effort to use telecommuting, barred non-essential personnel from hospitals and long-term care facilities and directed hospitals to delay elective surgeries, effective April 5 through April 30, 2020, with criminal penalties and civil penalties of up to $1,000 per violation per day. An April 20 amendment reopened parks and non-contact outdoor sports; an April 29 amendment effective May 1 through June 19, 2020 kept the face-covering mandate (and required every business to require face coverings of employees and to refuse service to uncovered customers), six-foot distancing and the school closure. On May 8, 2020 the Board of Supervisors voted 5-0 to revert to the State's orders and on May 9, 2020 the Health Officer rescinded the lodging, golf and face-covering orders so that the County 'now aligns itself with the State's Orders as they now exist or may be issued or amended in the future'; the K-12 closure ran to June 19, 2020. From May 9, 2020 the general business regime in Riverside County was the State's (the May 7, 2020 State Public Health Officer order and the Stage 2 attestation of May 22, 2020; the county-specific State order of July 1, 2020 closing bars and indoor sectors; the statewide July 13, 2020 order; the Blueprint for a Safer Economy from August 28, 2020 (Riverside in the purple tier most of the fall, red from September 23 to October 20, 2020, purple again through March 15, 2021, red March 16 and orange April 6, 2021); the Regional Stay at Home Order for the Southern California Region from December 6, 2020 to January 25, 2021; and the June 15, 2021 Beyond the Blueprint order). Riverside County's own instruments after May 2020 were targeted: the June 10, 2020 order cancelling the Coachella and Stagecoach festivals for 2020, a June 30, 2020 order closing brewpubs, bars and pubs, the July 13, 2020 closure of the County Administrative Center and other county buildings to the public, the January 29, 2021 amended order cancelling Coachella and Stagecoach for April 2021, the February 24, 2021 order cancelling the Temecula Valley Balloon and Wine Festival, and the February 17, 2021 quarantine and work-exclusion protocol for critical infrastructure workers that remained in force through the third quarter of 2021. San Bernardino County's Acting Health Officer, Dr. Erin Gustafson, declared a local health emergency on March 10, 2020 (Board resolutions of the same day), ordered COVID-19 reportable (March 10), cancelled all gatherings and closed bars, movie theatres, gyms and health clubs and confined food establishments to takeout (March 17, effective March 18 through April 6), confined short-term lodging to mitigation and essential-worker uses (March 27), imposed screening, masking and single-facility staffing rules on licensed facilities (April 6, updated May 8, 2020, superseded June 15, 2021), required face coverings of all persons leaving home and ordered non-essential businesses to remain closed, essential businesses to telecommute and international arrivals to quarantine 14 days (April 7, effective April 8), consolidated everything in omnibus orders of April 17 (effective April 18) and April 23 (effective April 25) that prohibited all gatherings of persons from more than one household, required face coverings in public and at essential businesses and closed short-term lodging, and then on May 8, 2020 rescinded every local order except the reporting and licensed-facility orders and 'directed [individuals and entities] to Executive Orders N-33-20 and N-60-20, and all orders issued thereafter'. A May 29, 2020 order (effective June 1) made face coverings 'strongly encouraged' and authorized businesses to require them; it was repealed July 2, 2020 after the State's June 18 face-covering mandate. The State Public Health Officer's county-specific order of July 2, 2020 closed San Bernardino County's bars, brewpubs and breweries indoors and outdoors and the indoor operations of dine-in restaurants, wineries, family entertainment centers, movie theaters, zoos, museums and cardrooms. San Bernardino County's June 15, 2021 order, effective the day the State reopened, kept licensed entities under the CDPH All Facilities Letter 20-17 screening regime and adopted CDPH's face-covering rules by reference; it was in force throughout the third quarter of 2021 and was rescinded in June 2022. The Riverside Superior Court suspended civil jury trials and unlawful detainer trials on March 16, 2020, closed courthouses in April, June-July and October 2020, mandated face coverings and six-foot distancing in every courthouse from May 6, 2020 (General Order 2020-21, superseded by General Order 2020-67 of November 17, 2020, in force until March 4, 2022), suspended all new jury trials from December 7, 2020 through February 26, 2021 under the Regional Stay at Home Order, closed all courthouses on the third Friday of each month from October 16, 2020 through April 16, 2021, cut clerk's office hours to 7:30 a.m.-2:00 p.m. until December 31, 2021 (General Orders 2020-60, 2021-17, 2021-25), restricted the public to livestream access for remote proceedings from July 6 to November 9, 2021 (General Order 2021-26) and continued to obtain and implement Chief Justice emergency orders under Government Code section 68115 on July 20, August 18 and September 14, 2021 (General Orders 2021-27 through 2021-34). The three transit agencies cut service in March-April 2020, moved to rear-door boarding, suspended fares, capped passengers (RTA at 10, Omnitrans at 20 per bus) and required face masks from April 2020, and stayed under the CDC conveyance mask order and the TSA security directives through September 2021. The City of Palm Springs issued its own emergency orders from March 14, 2020 (local emergency; essential-construction rules April 25; in-store employee and customer protection May 9; face-covering strengthening July 1; early closure of restaurants, bars, wineries, distilleries and breweries July 29, 2020; eviction moratorium ordinances through September 30, 2020).

Instrument Riverside County: Order of the Health Officer and of the County Executive Officer as Director of Emergency Services Rescinding Public Health Orders, effective May 9, 2020 (Ex. MET-RIV-009), after the Board of Supervisors' 5-0 vote of May 8, 2020 (Ex. MET-RIV-011); San Bernardino County: Order of the Health Officer for the Control of COVID-19, effective 12:00 p.m. May 8, 2020 (Ex. MET-RIV-026). From those dates the general business restrictions in both counties were the State's (N-33-20 and the State Public Health Officer's orders, the Blueprint tiers, the Regional Stay at Home Order), which ended with the State's June 15, 2021 Beyond the Blueprint order.

What remained in force

Riverside: the K-12 school closure through June 19, 2020 (Ex. 010); the June 10, 2020 and January 29, 2021 Coachella/Stagecoach cancellation orders and the February 24, 2021 Temecula festival order (Exs. 012, 016, 018); the county worker-quarantine protocols (Ex. 017); the local health emergency and local emergency of March 8 and 10, 2020 (recited as continuing in every 2021 order); the Riverside Superior Court's orders (Exs. 032-049), including the face-covering mandate (GO 2020-67, to March 4, 2022), reduced clerk hours (to December 31, 2021) and remote-access restriction (July 6-November 9, 2021). San Bernardino: the March 10, 2020 reportable-disease order (Ex. 019) and the May 8, 2020 licensed-facilities order (Ex. 027), superseded June 15, 2021 by an order that itself remained in force through 2021 (Ex. 031); the local health emergency and Board resolutions of March 10, 2020. The State and the local orders

California did not preempt or bar local orders; Health and Safety Code sections 101040, 101085 and 120175 authorize county health officers to issue orders stricter than the State's, and both counties did so in March-May 2020. The retreat from local orders in May 2020 was voluntary (Riverside Board vote of May 8, 2020; San Bernardino Health Officer order of May 8, 2020), after which each county's own orders recited that individuals and businesses were 'directed to' the Governor's and State Public Health Officer's orders. The State's county-specific orders of July 1-2, 2020 (Exs. 014, 030) and the Blueprint tier assignments operated directly on the two counties. No injunction against a Riverside or San Bernardino County order was located.

'Hospitals and healthcare providers shall take measures to preserve and prioritize resources including delaying non-emergent or elective surgeries or procedures where feasible' (Riverside Ex. 006 par. 1.o; San Bernardino Ex. 023 par. 8, Ex. 024 par. 9) in force to May 8-9, 2020; statewide CDPH directives thereafter.

Schools

Riverside: all schools, colleges and universities closed Mar. 16-June 19, 2020 by orders of Mar. 13/17, Apr. 1 and May 9, 2020 (Exs. 004, 010); San Bernardino: closures under the State framework (no county order located). 2020-21: State remote/hybrid framework and county waiver process (Riverside waivers Aug. 21, 2020); 2021-22: CDPH K-12 masking order (statewide).

Child care

Riverside: stable groups of 12 (Apr. 1 and May 9 orders) or 10 (Apr. 4 order), no mixing, one provider per group (Exs. 004, 006, 010).
