ScopeSacramento metropolitan area: Sacramento County (Public Health Officer orders; Summary Isolation and Quarantine Orders), City of Sacramento (local emergency; eviction moratorium), Sacramento Regional Transit District, Sacramento Superior Court, Yolo County (Public Health Officer orders), Placer County (Health Officer directive and orders; Board of Supervisors Resolution 2020-194; Placer County Transit; the State Public Health Officer's Placer-specific order of July 11, 2020), El Dorado County (Public Health Officer declaration, directives and Lake Tahoe Basin travel order; Ordinance 5121) and the City of South Lake Tahoe. The Sacramento metropolitan area carried a continuous chain of county health officer orders from March 19, 2020 through September 30, 2021, and Sacramento County itself is the strongest local record in the metro: twenty-two successive Health Officer orders were retrieved and read, from the March 19, 2020 stay-at-home order (Ex. MET-SAC-001) to the July 29, 2021 indoor face covering order (Ex. MET-SAC-015), each superseding the last by its own terms and each stating its effective time. 2020 Q2 opened under the Sacramento County stay-at-home order of March 19, 2020 (effective 11:59 p.m. that day) as amended April 7, 2020 (Ex. 002: all non-essential business operations at physical locations ceased, all gatherings of any number prohibited, all non-essential travel ordered to cease, essential businesses required to adopt social distancing protocols), the Yolo County shelter-in-place order of March 18, 2020 (Ex. 065; a misdemeanor under Health & Safety Code 120295), the Placer County Health Officer's directive of March 19, 2020 and orders of April 10 and April 16, 2020 (Exs. 029, 030, 032), and the El Dorado County Public Health Officer's directive of March 19, 2020 (Ex. 050), extended March 31 through April 30, 2020 (Ex. 038), with the March 24, 2020 lodging directive (Ex. 039) and the April 3, 2020 order restricting travel into the Lake Tahoe Basin (Ex. 051), enforced by a $1,000 administrative penalty ordinance (Ex. 041). The Sacramento Superior Court declared court holidays March 20-30, 2020 and closed its courthouses (Ex. 044), extended the closure to April 16, 2020 (Ex. 045) and reopened only in stages through May and June 2020; SacRT suspended school routes March 17, 2020 and cut service (Ex. 064). The City of Sacramento declared a local emergency on March 13, 2020 and adopted an eviction moratorium on March 17, 2020, extended to commercial tenants March 24, 2020 (Exs. 053, 062). Sacramento County's May 22 and May 26, 2020 orders (Exs. 003, 021) began the Stage 2 relaxation but kept the stay-at-home directive; the June 12 and June 19 orders (Exs. 004, 005) opened Stage 2 and 3 sectors under Social Distancing Protocols and a listing of allowable activities. Placer County's local orders expired May 1, 2020; El Dorado's directive expired April 30, 2020 and its Tahoe travel order was rescinded May 27, 2020 (Ex. 042); Yolo's shelter-in-place order was replaced May 28, 2020 by a Roadmap to Recovery health order that carried a face covering requirement (Exs. 070, 073). 2020 Q3 opened with re-closure: Sacramento County ordered all bars closed June 29, 2020 (Ex. 022), closed indoor dining, wineries, entertainment and cardrooms July 2, 2020 (Ex. 006) and, on July 14, 2020, prohibited indoor operations of restaurants, theaters, entertainment centers, zoos and museums, cardrooms, wineries, bars, gyms, places of worship, non-critical offices, personal care, salons and barbershops and indoor malls (Ex. 007); the State Public Health Officer imposed the same closures on Placer County by a county-specific order of July 11, 2020 that expressly superseded Placer's own June 28 bar orders (Ex. 033). Sacramento County ordered every school in the county closed for in-person instruction (August 20 and August 28, 2020; Ex. 023), issued blanket Summary Isolation and Quarantine Orders on July 28, 2020 (Exs. 016, 017), and moved into the Blueprint on August 31, 2020 in the Purple tier (Ex. 008: all gatherings prohibited; outdoor-only operation for restaurants, worship, gyms, personal care, museums, theaters, wineries, entertainment centers and cardrooms) and into the Red tier on September 29, 2020 (Ex. 024). Placer County's Board terminated the county's local health emergency on September 8, 2020 by Resolution 2020-194 (Exs. 049, 060), a political act that left every State order in force in Placer County. 2020 Q4 saw the October 13, 2020 Red-tier order (Ex. 009: retail 50 percent, gyms 10 percent, theaters and worship 25 percent or 100 persons, schools permitted to reopen), the return to Purple on November 13, 2020 (Ex. 025), the November 20, 2020 order incorporating the State's 10 p.m. to 5 a.m. Limited Stay at Home curfew (Ex. 011), and the December 9, 2020 order implementing the Regional Stay at Home Order for the Greater Sacramento Region effective 11:59 p.m. December 10, 2020 (Ex. 012: bars, wineries, personal care, salons, museums, zoos, entertainment centers, cardrooms, indoor playgrounds and live-audience sports closed; restaurants takeout only). SacRT adopted a No Mask, No Ride, No Exceptions policy effective December 11, 2020, as did Yolobus (Ex. 020). 2021 Q2 ran under the April 15, 2021 order (Ex. 014) and the June 1, 2021 Orange-tier order (Ex. 028), which expired by its own terms at 12:01 a.m. June 15, 2021 with the State's Beyond the Blueprint reopening. 2021 Q3: the Sacramento Superior Court's Implementation of Emergency Relief orders of June 25 and July 26, 2021 (Exs. 055, 063) and its courthouse face covering order of September 21, 2020 (Ex. 063) were in force; the Sacramento County Summary Isolation and Quarantine Orders remained in force (Exs. 016, 017); on July 29, 2021 the Sacramento County Health Officer ordered face coverings worn indoors in all public settings and workplaces regardless of vaccination status, effective 12:01 a.m. July 30, 2021, with businesses required to enforce the rule on patrons and post signage, displacing the more permissive Cal/OSHA ETS (Ex. 015); Yolo County's new Face Covering Health Order and an amended local Quarantine Health Order were in force in September 2021 (Ex. 072); and the CDPH orders of July 12, 2021 (K-12 masking), July 26, 2021 (vaccination verification, masking and testing of unvaccinated workers in health care and high-risk congregate settings; summarized for local providers in Ex. 018) and August 5, 2021 (health care worker vaccination) applied throughout the four counties. Placer and El Dorado Counties issued no local face covering order in Q3 2021; the State instruments applied there.

What remained in force

Sacramento County Summary Isolation Order and Summary Quarantine Order of July 28, 2020 (Exs. 016, 017; 'in effect until rescinded in writing'); Sacramento Superior Court face covering order of September 21, 2020 and its Gov. Code 68115 emergency relief orders (Exs. 055, 063); the State's June 15, 2021 face covering guidance, mega-event rules and Cal/OSHA ETS; from July 30, 2021 the Sacramento County indoor face covering order (Ex. 015); Yolo County's Face Covering Health Order and amended Quarantine Health Order (Ex. 072); CDPH orders of July 12, July 26 and August 5, 2021.

The State and the local orders

California did not preempt or bar local health officer orders. Health & Safety Code 101040, 101085 and 120175 empower county health officers to issue orders, and Health & Safety Code 131080 (recited in Ex. MET-SAC-015 paragraph 10) provides that where a local order and a State public health order conflict the more restrictive provision controls. The State did override one local relaxation in this metro: the State Public Health Officer's Amended Order for Placer County of July 11, 2020 (Ex. 033) closed bars and indoor sectors in Placer County and by its paragraph 4 'supersedes any orders issued by Placer County on or after June 28, 2020, for the purpose of closing bars, pubs, breweries, and brewpubs.' Placer County's Board of Supervisors terminated the county's local health emergency on September 8, 2020 (Resolution 2020-194, Ex. 049); that resolution did not and could not terminate the State's orders, which continued to apply in Placer County through June 15, 2021, and the county's public health officer resigned that month. No court enjoined any Sacramento-area local order in the period studied.

Permitted as an essential service with restrictions under the State's list; Sacramento County orders defined residences to include hotels, motels and shared rental units (Ex. 001 paragraph 10(j)); the City of Sacramento eviction moratorium (Mar. 17 and 24, 2020; Ex. 062) and the Sacramento Superior Court's suspension of unlawful detainer proceedings, partially resumed for pre-Mar. 18, 2020 writs on June 3, 2020 (Ex. 058).

Hospitals and long-term care

State instruments; Ex. 018 (July 27, 2021) states the local outbreak reporting thresholds and the July 26, 2021 State order's masking, respirator and testing requirements for acute care and long-term care settings in Sacramento County.
