The record in brief

The Miami metropolitan area ran the most restrictive local regime in Florida, and it ran longest. Every layer of local government exercised force-of-law emergency power under ch. 252, Fla. Stat., and the county and city codes (Miami-Dade Code s. 8B-7; Broward Code ss. 8-53 and 8-56; Palm Beach County Code s. 9-35; Miami Charter s. 4(g)(3); Miami Beach Code s. 26-31), and the three counties coordinated as a single 'tri-county' market. 2020 Q2 (with the March 13-31, 2020 run-up): Miami-Dade closed on-premises food and alcohol service, theaters, gyms and fitness studios on March 17 (EO 03-20), closed all non-essential retail and commercial establishments on March 19 (EO 07-20, the list the Governor later adopted for all of southeast Florida in EO 20-89 and statewide in EO 20-91), capped public groups at ten (EO 10-20, Mar. 24), declared the totality of its orders the 'Safer at Home' protocols (EO 12-20, Mar. 26), closed adult day care (EO 16-20), cut essential food-retail occupancy by half (EO 17-20), compelled twice-daily hospital reporting (EO 18-20) and mandated facial coverings in stores, restaurants, pharmacies, construction sites and transit (EO 20-20, Apr. 9). Broward closed non-essential business on March 23 (EO 20-01), restated it as a Safer at Home order on March 26 (EO 20-03), closed golf courses and theaters (EO 20-04), and on April 10 replaced the series with EO 20-06 restricting public access to every business deemed non-essential under Miami-Dade EO 07-20, as the Governor's EO 20-89 required. Palm Beach declared its emergency March 13, closed all noncritical business March 26 (EO 2020-002, restated 2020-002a effective Mar. 30), closed parks, golf courses and community pools and urged residents to stay home (EO 2020-003a), and directed facial coverings from April 13 (EO 2020-004). The City of Miami closed bars and dine-in service March 17, closed non-essential business and capped occupancy at 50 percent March 19 (Order 20-03), imposed a 10 p.m.-5 a.m. curfew March 27 (Order 20-05) and a shelter-in-place order March 24 (Order 20-04, recited in Order 20-14). Miami Beach closed its beaches and imposed a curfew (Mar. 16-20), closed every hotel and short-term rental to guests by March 23 (Mar. 20 measures) and ordered all residents to remain at home from March 24 (Safer at Home order). Reopening came late and conditioned: Broward Phase 1 on May 18 (EO 20-10: restaurants and retail at 50 percent, salons under DBPR rules, indoor theaters closed), Miami-Dade's New Normal (EO 23-20, May 18) with the City of Miami (Order 20-11, May 20) and Miami Beach (Phase 1 Order, May 20/27) layering stricter terms, Palm Beach Phase 1 on May 11 with EO 2020-002a repealed May 22 (EO 2020-009). Q2 closed with countywide facial-covering mandates in all three counties (Miami-Dade EO 20-20 since Apr. 9; Palm Beach EO 2020-012, June 24; City of Miami Order 20-16, June 25; Broward EO 20-21 restating its EO 20-07 rule) and with Broward's 24-hour closure-and-attestation regime for violators (EO 20-18, June 26). 2020 Q3: the July surge brought the re-closures. Miami-Dade closed theaters, concert houses, bowling alleys, arcades, indoor amusement and casinos (EO 26-20, July 3), then banquet halls and ballrooms, and limited restaurants to outdoor service 6 a.m.-10 p.m. (Amendment 2, July 9); imposed a 10 p.m.-6 a.m. countywide curfew (EO 27-20, July 3) that ran, in 10 p.m., 11 p.m. and midnight versions, until April 12, 2021; and on August 31 restated the regime in EO 28-20 (indoor dining at 50 percent, six per table, bars and venues closed). Broward's EO 20-21 (July 10) closed bars, nightclubs, banquet halls and indoor theaters and mandated masks in every establishment; EO 20-22 (July 17-20) imposed an 11 p.m.-5 a.m. curfew to August 1 and a ten-person cap on gatherings; EO 20-24 (Aug. 21) restated the closures and barred alcohol sales 11 p.m.-5 a.m. Palm Beach closed on-premises food and alcohol service 11 p.m.-5 a.m. (EO 2020-014, July 16; 2020-015, July 23), adopted every State executive order as a county order enforceable by closure, civil citation and misdemeanor prosecution (EO 2020-017, Aug. 7), and moved to Phase 2, Step 1 only on September 4 (EO 2020-024: theaters at 50 percent, playhouses at 33 percent, bars still closed). Miami Beach limited restaurants to outdoor service, imposed a 10 p.m.-6 a.m. curfew and barred package alcohol sales after 8 p.m. (Modified Phase 2 Order, July 16). The Governor's EO 20-244 (Sept. 25) ended the counties' power to close businesses and to cut restaurants below 50 percent, and suspended fines on individuals; the counties answered within days with orders that kept every operating condition the State left them (Miami-Dade EO 30-20, Sept. 26; Broward EO 20-26, Sept. 25/26, and EO 20-28, Oct. 16; Palm Beach EO 2020-028, Sept. 29). 2020 Q4: masks, distancing, six-per-table rules, midnight-to-5 a.m. or 6 a.m. on-premises service bans, ten-person gathering caps and the Miami-Dade curfew (midnight to 6 a.m. from Oct. 12) remained in force; Broward consolidated everything into a Comprehensive Emergency Order (EO 20-29, Dec. 16) and reimposed a midnight-5 a.m. curfew for the holidays (EO 20-30, Dec. 25-Jan. 4); the Fourth District Court of Appeal upheld the Palm Beach mask order on January 27, 2021 (Machovec). 2021 Q1: the same regime, with Palm Beach extending EO 2020-012 through May 18, 2021, Miami-Dade issuing vaccine-reporting orders (EO 32-20, Jan. 23) and Miami Beach restating its Phase 3 order (Mar. 4) and declaring a spring-break emergency with an 8 p.m. curfew and causeway closures (EO 2021-01-SB, Mar. 20). 2021 Q2: Miami-Dade's EO 33-20 (Apr. 6) kept the public mask mandate, the curfew until Apr. 12 and the ten-person street-gathering cap; Broward's EO 21-02 (Apr. 19) set vaccination and positivity metrics for any reduction; Palm Beach relaxed outdoor masking for the vaccinated (EO 2021-005, May 1); the City of Miami cancelled its own orders on April 15 (Order 20-18) while keeping residents subject to the County's; Miami Beach reissued its order April 29 through May 5. The Governor's EO 21-102 (May 3, 2021) suspended every local COVID-19 restriction on individuals and businesses, EO 21-101 and SB 2006 invalidated them from July 1, 2021, and the State emergency lapsed June 26, 2021. 2021 Q3: what survived were the instruments the exhibits show: the Miami-Dade local state of emergency renewed every week through September 2021 (with affidavits every 15 days), Miami-Dade EO 02-21 (July 29) compelling daily hospital reporting, the County's mask requirement at County facilities (Mayor's statement, July 30), the federal mask mandate on Miami-Dade Transit (County notice, Aug. 3), Broward Emergency Directive 21-A (Aug. 5) and Palm Beach Emergency Directive 2021-A (Aug. 23) compelling daily hospital reporting under new or continued local emergencies, and the Miami-Dade County Public Schools' mandatory facial coverings for students, employees and visitors (Aug. 19), alongside the State's school rules (64DER21-12 and 21-15) and the federal layer.

End of general restrictions

2020-09-25 (closures and sub-50-percent restaurant caps ended; individual fines suspended); 2021-05-03 (all remaining local business and individual mandates suspended: Miami-Dade EO 33-20 shown as 'Canceled' on the County index; Palm Beach EO 2020-012 due to expire May 18, 2021; Broward CEO and Miami Beach Apr. 28, 2021 order overtaken); 2021-07-01 (invalidation of every pre-July 1 local order)

Instrument Florida EO 20-244 (Sept. 25, 2020) (FL-047) ended the counties' authority to close businesses and to limit restaurants below 50 percent, and suspended COVID-19 fines and penalties on individuals; Florida EO 21-102 (May 3, 2021) (FL-060) suspended 'all local COVID-19 restrictions and mandates on individuals and businesses' and barred counties and cities from renewing or enacting any for the rest of the State emergency; EO 21-101 (May 3, 2021, effective July 1, 2021) (FL-059) and SB 2006, Ch. 2021-8, s. 12 (FL-030) invalidated every pre-July 1, 2021 local COVID-19 emergency order and capped any new one at 7 days, extendable to 42

What remained in force

Metro consequence of EO 20-244: from Sept. 26-29, 2020 every business in the three counties could open, but under county operating conditions the State left intact: facial coverings in every establishment and in public (Miami-Dade EO 20-20; Broward EO 20-21 s. 3 and the CEO ch. 3; Palm Beach EO 2020-012), six feet between tables and no more than six per table as the price of exceeding 50 percent (Miami-Dade EO 30-20 s. 3(e); Broward EO 20-28 Att. 2; the CEO ch. 12), on-premises food and alcohol service bans from 11 p.m. or midnight to 5 or 6 a.m., the Miami-Dade curfew (EO 27-20 to Apr. 12, 2021), ten-person gathering caps, signage, sanitation and employee-screening rules, closure of establishments with a positive employee (Miami-Dade EO 28-20/30-20 s. 5-6), the 24-hour closure and attestation regime for violators (Broward EO 20-18; Palm Beach EO 2020-017; Miami Order 20-17), and fines on businesses (Broward: $500/60 days criminal, $1,000 per day civil, $15,000 knowing violation; Palm Beach: $250/$350/$500 citations, s. 162.09 fines to $15,000; Miami-Dade: closure and compliance plans). Metro consequence of EO 21-102: on May 3, 2021 every remaining county and city business and individual mandate in the metro was suspended (Miami-Dade EO 33-20 and its amendment appear as 'Canceled' on the County's May 7, 2021 index; the City of Miami had already cancelled Orders 20-04, 20-06, 20-11, 20-16 and 20-17 on Apr. 15, 2021). After May 3, 2021 and through Sept. 30, 2021: the local states of emergency themselves (Miami-Dade renewed weekly through Sept. 23, 2021 and beyond; Palm Beach newly declared Aug. 17, 2021 and terminated Oct. 19, 2021; City of Miami's 67th extension June 22, 2021), hospital-reporting instruments (Miami-Dade EO 02-21, July 29, 2021; Broward Emergency Directive 21-A, Aug. 5, 2021; Palm Beach Emergency Directive 2021-A, Aug. 23, 2021), masks at Miami-Dade County facilities (Mayor's statement, July 30, 2021), the federal mask order on Miami-Dade Transit and at its stations (County notice, Aug. 3, 2021), the Miami-Dade County Public Schools' mandatory facial coverings and 10-day isolation protocol (Aug. 19, 2021), and the State and federal layers (FL-063, FL-032, FL-033; the CDC conveyance order and TSA directives).

The State and the local orders

Florida preempted the metro's orders in four steps, each recorded in the exhibits. (1) EO 20-91 s. 4 (Apr. 1, 2020) and EO 20-92 (Apr. 1, 2020) made the State order 'supersede any conflicting official action or order issued by local officials' while (through EO 20-89, Mar. 30, 2020) ordering Miami-Dade, Broward, Palm Beach and Monroe to restrict access to businesses deemed non-essential under Miami-Dade EO 07-20 and barring curfews on transit to essential establishments; Broward EO 20-06 (Apr. 10, 2020) and Palm Beach EO 2020-017 (Aug. 7, 2020) were issued 'to implement' and 'adopt by reference' the State orders. (2) EO 20-244 (Sept. 25, 2020): 'No COVID-19 emergency ordinance may prevent an individual from working or from operating a business'; restaurants 'may not be limited... to less than fifty percent (50%) of their indoor capacity'; collection of fines and penalties 'enforced upon individuals' suspended. Broward's County Administrator recited that she was 'compelled to allow all establishments in Broward County to operate' (EO 20-29) and deleted her closure section 'to the extent preempted' (EO 20-26 s. 1-2); Miami-Dade EO 30-20 and Palm Beach EO 2020-028 recited the same compulsion and kept masks, distancing, hours and enforcement. (3) EO 21-102 (May 3, 2021): 'all local COVID-19 restrictions and mandates on individuals and businesses are hereby suspended'; no county or municipality 'may renew or enact' any for the rest of the State emergency; ss. 2-3 of EO 20-244 superseded. (4) SB 2006, Ch. 2021-8, s. 12 (eff. July 1, 2021), s. 252.38(4): a local emergency order 'automatically expires 7 days after issuance,' extendable 'for a total duration of not more than 42 days'; 'The Governor may, at any time, invalidate an emergency order issued by a political subdivision'; and EO 21-101 (May 3, 2021, eff. July 1, 2021): 'any emergency order issued by a political subdivision due to the COVID-19 emergency which restricts the rights or liberties of individuals or their businesses is invalidated.' The Q3 2021 local instruments were drafted around that statute: Broward Emergency Directive 21-A s. 3 and Palm Beach Emergency Directive 2021-A s. 5 each recite that the directive 'is not, is not intended to be, and shall not be construed as an emergency order as defined by Section 252.38(4)(a)' that limits rights or liberties, and Palm Beach declared a new local emergency on Aug. 17, 2021 and extended it in seven-day increments until terminating it Oct. 19, 2021. Injunction history: the Fourth District Court of Appeal affirmed the denial of a temporary injunction against Palm Beach EO 2020-012 (Machovec v. Palm Beach County, No. 4D20-1765, Jan. 27, 2021), holding that the mask mandate does not implicate the right to refuse medical treatment and survives rational-basis review; the Miami Beach spring-break declaration cites 7020 Entertainment, LLC v. Miami-Dade County, No. 20-25138 (S.D. Fla.) and Smith v. Avino, 91 F.3d 105 (11th Cir. 1996) as upholding the Miami-Dade curfew. Construction

Open construction sites deemed essential 'irrespective of the type of building' (Miami-Dade EO 07-20; Palm Beach EO 2020-002 s. 4(bb)); architects, engineers and surveyors essential (Palm Beach only 'with regard to ongoing construction projects'); facial coverings mandatory on construction sites from Apr. 9-13, 2020 (Miami-Dade EO 20-20 s. 1; Palm Beach EO 2020-004 s. 3); Broward's employer rules (EO 20-21 Att. 1; CEO ch. 11) applied to job sites as establishments.

Miami-Dade EO 01-20 closed congregate meal sites (Mar. 16, 2020) and EO 16-20 closed adult day cares (Apr. 3, 2020); EO 18-20 compelled twice-daily hospital bed, ICU, ventilator and COVID census reporting (Apr. 4, 2020; once daily from Aug. 29, 2020); EO 32-20 compelled vaccine-dose and appointment reporting by hospital systems, municipalities and all dispensers (Jan. 23, 2021); EO 02-21 (July 29, 2021), Broward Directive 21-A (Aug. 5, 2021) and Palm Beach Directive 2021-A (Aug. 23, 2021) compelled daily reporting including vaccination status and elective-surgery status through Q3 2021; the State's DEM visitation orders (FL-004, -028, -044, -049) governed long-term care.

Dental and elective health care

Health-care providers, including dentists, deemed essential in every closure order (Miami-Dade EO 07-20 s. 2; Broward EO 20-01 s. 3(a) 'except to the extent precluded by the Governor's Executive Order 20-72'; Palm Beach EO 2020-002 s. 4(a) the same); the State's EO 20-72 elective-procedure ban (FL-009) governed to May 2020; local masks and screening applied to clinics as establishments from Apr. 2020.

Schools

Private schools, colleges and educational institutions closed except for online or distance learning (Miami-Dade EO 07-20 s. 2; Broward EO 20-01; Palm Beach EO 2020-002 s. 4(k); Miami Beach Mar. 20, 2020 and Phase 1/2 orders through July 2020); Broward CEO ch. 31 exempted schools from establishment rules but regulated extracurricular activities (ch. 26, 29); M-DCPS mandatory facial coverings, distancing, screening, 10-day isolation and limited visitors for 2021-22 (Aug. 19, 2021) under EO 21-175 and DOH rules 64DER21-12/15 (FL-063, FL-032, FL-033).

Child care

Child-care facilities limited to serving employees of essential businesses in stable groups of ten or fewer, no mixing, separate rooms (Miami-Dade EO 07-20 s. 2; Palm Beach EO 2020-002 s. 4(v)); Miami Beach Safer at Home order limited child care to groups of ten; youth activities and camps regulated by Broward EO 20-21 Att. 16 and CEO ch. 26 through May 2021.

Miami-Dade did not limit attendance at religious services (EO 07-20 s. 5; EO 28-20 s. 8; EO 33-20 s. 8) but capped street gatherings at ten (EO 10-20, Mar. 24, 2020; EO 33-20 s. 6 to May 2021) and exempted religious institutions from masks (EO 33-20 s. 5(c)(iii)); Miami Beach reduced places of worship to ten persons (Mar. 20, 2020), then 50 percent with masks (Phase 1 and 2 orders); Broward EO 20-06 s. 6 urged ten; Broward EO 20-22 s. 3 (July 20, 2020) prohibited private gatherings over ten and any other gathering over ten with owner and landlord liability, carried into CEO ch. 5 to May 2021; Palm Beach EO 2020-002 s. 7 urged ten at worship and EO 2020-024 limited parties to ten.

Courts and public offices
