ScopeMinneapolis-Saint Paul metropolitan area: City of Minneapolis, City of Saint Paul, Hennepin County, Ramsey County, Hennepin County District Court (Fourth Judicial District), Metro Transit and the Metropolitan Council, University of Minnesota. Statewide Minnesota instruments are cited by name and date only.

The Twin Cities layered municipal and county instruments on top of the Governor's orders from March 16, 2020 through September 30, 2021 and beyond, and Minnesota never preempted them. Minneapolis: Mayor Frey declared a local public health emergency on March 16, 2020 (Minn. Stat. 12.29; Minneapolis Code of Ordinances 128.50), ratified by Council Resolution 2020R-075 on March 19, 2020 (Ex. MET-MSP-001, -016). Emergency Regulation 2020-1 (March 16, 2020) adopted the Governor's EO 20-04 closure of bars, restaurants and places of public accommodation as a City regulation enforced by City police and health authorities from noon March 17, 2020 (Ex. -002); ER 2020-3 and 2020-8 added adult day care centers and licensed pedal cars to the closed class (Ex. -003, -006); ER 2020-4 froze new land-use applications March 17 to April 10, 2020 (Ex. -004, -007); ER 2020-11 (effective April 28, 2020) imposed misdemeanor-backed conditions on every licensed congregate health-care facility (visitors barred, communal dining suspended, cohorting, staff masks, screening) until July 24, 2020 (Ex. -008, -012); ER 2020-12 (issued May 21, effective 5 p.m. May 26, 2020) required face coverings in every indoor space of public accommodation and required all employers of such spaces to mask employees with public contact, in force until June 1, 2021 (Ex. -009, -063); ER 2020-13 (effective June 1, 2020) created the expedited temporary outdoor-expansion regime, in force to September 30, 2021 (Ex. -010); ER 2020-17 (issued July 30, effective 5 p.m. August 1, 2020) ordered bar areas in every restaurant, nightclub, brewery, distillery, taproom and indoor entertainment space closed and prohibited counter service, still in force January 15, 2021 (Ex. -013, -017); ER 2020-20 (effective December 23, 2020) capped delivery-platform commissions at 15 percent to September 30, 2021 (Ex. -014); ER 2020-21 granted City employees 80 hours of 2021 COVID-19 sick leave (Ex. -015). The Council's January 15, 2021 resolution lists fifteen regulations then in force (Ex. -017). When the State peacetime emergency ended July 1, 2021, Resolution 2021R-177 extended the local emergency to September 30, 2021 for a planned, phased elimination of the regulations (Ex. -018); Resolution 2021R-261 (August 20, 2021) extended it to November 7, 2021 on Delta findings (Ex. -019); the September 10, 2021 resolution added ER 2021-5, a COVID-19 testing and proof-of-vaccination policy for City employees (Ex. -020). Saint Paul: Mayor Carter declared a local emergency March 15, 2020 (Res 20-550, March 17), continued every ninety days through March 2022 (Ex. -022, -043, -021). More than eighty Emergency Executive Orders followed under Leg. Code 13.06: EEO 2020-1 (March 17, 2020) barred gatherings of fifty or more on City property from March 18 and reviewed event permits (Ex. -023); EO 2020-2 (March 27) directed telework for all City services that could be so performed (Ex. -024); EEO 2020-5 (April 9) cut skyway hours to 7 p.m., kept there to May 31, 2021 on findings that hospitality businesses remained closed and office workers remote (Ex. -025, -030, -039); EEO 2020-8 (April 24) granted fee relief to the closed license classes (Ex. -026); EEO 2020-9 (effective June 1, 2020) required face coverings at City property and required every City-licensed business to require them of all individuals, on pain of licensing action, extended July 6 and August 14 and lapsing about September 23, 2020 after the statewide EO 20-81 (Ex. -027, -029); EEO 2020-10 (effective June 1, 2020) created the C-19 outdoor-service licenses and permits, extended and modified through the winter and made subject to the EO 20-99 pause (Ex. -028, -031, -032, -034, -036); EEO 2020-40 (December 4, 2020) placed the licenses of businesses closed by EO 20-99 in inactive status for the duration of the emergency, extended through September 27, 2021 (Ex. -033, -042, -045); EEO 2021-3 (January 7, 2021) capped delivery commissions at 15 percent (Ex. -035); EEO 2021-21 (May 21, 2021) re-imposed the face-covering mandate on City property and every licensed business one week after the State lifted its own, rescinded June 2, 2021 (Ex. -037, -040); EEO 2021-22 (May 24, 2021) lifted the City's outdoor capacity and distancing conditions (Ex. -038); EEO 2021-33 (August 3, 2021) required face coverings of all individuals regardless of vaccination status at all City-controlled property, extended September 9, 2021 and after (Ex. -041, -044); the August 31, 2021 continuation recites Ramsey County in the CDC's high transmission category (Ex. -043). Hennepin County's Board declared a continued local emergency March 17, 2020 and closed libraries and service centers through April 10, 2020 (Ex. -046); by August 2021 all visitors to county facilities were required to wear face coverings (Ex. -047). Ramsey County's Board declared a State of Emergency March 17, 2020 and the County suspended walk-up services (Ex. -048); the Board continued indoor masking in county facilities May 18, 2021, eased it June 8, 2021, and required cloth face coverings of all visitors and employees in every indoor county facility from August 3, 2021 regardless of vaccination (Ex. -049, -050, -051). The Fourth Judicial District held eviction matters non-public (March 31, 2020), closed the Brookdale and Ridgedale courthouses (May 1, 2020), limited courthouse access to hearing participants (May 18, 2020), required face coverings in courtrooms (May 20, 2020), and remained in a transitional phase from June 14 to September 6, 2021 with most proceedings remote (Ex. -052 to -057, -064). Metro Transit moved to Saturday schedules and suspended overnight service March 25, 2020, directed essential travel only with rear-door boarding and a ten-rider limit in April 2020, and from July 30, 2020 required face coverings of all customers with ten- and fifteen-rider caps (Ex. -058 to -061). The University of Minnesota required masks of all faculty, staff, students, visitors, contractors and vendors indoors from August 2, 2021 (Ex. -062). End of general restrictions

Instrument Statewide: Emergency Executive Order 21-21 (May 6, 2021; capacity, party-size and distancing limits ended 11:59 p.m. May 27, 2021) and Emergency Executive Order 21-23 (May 14, 2021; statewide face-covering requirement lifted). Local: Minneapolis Emergency Regulation 2020-12 (face coverings) rescinded June 1, 2021 (recital in ER 2022-01, Ex. MET-MSP-063); Saint Paul Emergency Executive Order 2021-25 (June 2, 2021) rescinding the re-imposed mask mandate EEO 2021-21 (Ex. MET-MSP-040).

What remained in force

The Minneapolis local public health emergency (extended to Sept. 30, 2021 by Res. 2021R-177 and to Nov. 7, 2021 by Res. 2021R-261) with Emergency Regulations 2020-5, 2020-6, 2020-7, 2020-13, 2020-14, 2020-18, 2020-20, 2020-21, 2021-2, 2021-4 and, from its promulgation, 2021-5 (City employee testing and proof-of-vaccination policy); the Saint Paul local emergency (continued June 1, Aug. 31 and Nov. 29, 2021) with EEO 2021-22 (outdoor operations), 2021-23 (skyway hours), 2021-3 (delivery cap), 2020-40 (inactive licenses), 2020-38, 2020-3, 2020-4, 2020-29, 2020-33, 2020-44 as extended, and from Aug. 3, 2021 EEO 2021-33 (face coverings at all City-controlled property regardless of vaccination); Hennepin County and Ramsey County face-covering requirements in county facilities from August 2021; the Hennepin County District Court transitional-phase rules (June 14 - Sept. 6, 2021) and courthouse entry conditions; the University of Minnesota Face Covering Protocol (Aug. 2, 2021); the federal CDC conveyance mask order and TSA directives on Metro Transit and at MSP.

The State and the local orders

None. Minnesota did not preempt or bar local COVID-19 orders. The Governor's statewide face-covering order (Emergency Executive Order 20-81, July 25, 2020) and its rescission (Emergency Executive Order 21-23, May 14, 2021) each left local governments and businesses free to keep their own requirements; Minneapolis kept ER 2020-12 to June 1, 2021, Saint Paul re-imposed a mandate May 21 - June 2, 2021 and again for City property from Aug. 3, 2021, and Ramsey County required masks in every county building from Aug. 3, 2021. The State peacetime emergency ended July 1, 2021 by legislative action; the local emergencies were continued by the city councils under Minn. Stat. 12.29 and the municipal codes (Ex. MET-MSP-018, -043). No court enjoined any instrument in this folder.
