The record in brief

New Jersey's COVID-19 regime was State-driven, continuous and documented in a single numbered series of gubernatorial executive orders, every one of which is saved here from the Governor's own archive. Governor Murphy declared a Public Health Emergency and a State of Emergency on March 9, 2020 (EO 103, Ex. NJ-001); the Public Health Emergency was renewed fifteen times at 30-day intervals (EOs 119 through 240) and terminated on June 4, 2021 (EO 244, Ex. NJ-052), while the State of Emergency continued through September 30, 2021 and beyond (EO 244 para. 2; P.L. 2021, c. 103, sec. 4). Second quarter of 2020: EO 104 (March 16) capped gatherings at 50, closed casinos, racetracks, gyms and entertainment venues, curfewed non-essential retail and limited restaurants to takeout; EO 107 (March 21, 9:00 p.m.) ordered all residents to remain home, closed the brick-and-mortar premises of all non-essential retail, closed every recreational, entertainment and personal-care business and all indoor malls, cancelled all gatherings, kept restaurants to takeout and delivery, closed schools and colleges, and ordered every business and non-profit in the State to accommodate telework 'wherever practicable' and to reduce on-site staff 'to the minimal number necessary'; EO 108 (March 21) invalidated every conflicting county and municipal restriction; EO 109 suspended all elective surgeries and invasive procedures, 'whether medical or dental,' from March 27 to May 26, 2020; EO 110 closed child care to all but children of essential persons from April 1 to June 15; EO 122 (effective April 10) halted all non-essential construction until May 18 and imposed 50 percent occupancy, mandatory face coverings, staggered shifts and ten-person meeting caps on essential retail, manufacturing and warehousing; EO 125 cut NJ TRANSIT to half capacity. Reopening began with curbside retail and construction on May 18 (EO 142), outdoor gatherings of 25 on May 22 (EO 148), child care on June 15 (EO 149), outdoor dining and full retail at 50 percent on June 15 (EO 150), the end of the stay-home directive on June 9 (EO 153 para. 11), personal care on June 22 (EO 154) and indoor recreation at 25 percent on July 2 (EO 157); indoor dining, scheduled for July 2, was rescinded three days before it began (EO 158) and stayed closed until September 4, 2020 (EO 183). Third quarter of 2020: outdoor gatherings 500 (EO 161), indoor gatherings cut to 25 on August 4 (EO 173), outdoor masks from July 8 (EO 163), gyms indoors at 25 percent only from September 1 (EO 181), indoor dining and theaters at 25 percent from September 4 (EO 183), schools reopened in hybrid or remote formats under mandatory distancing and masking (EO 175), and the Department of Health's binding sector directives for dining, salons, gyms, amusements, hotels and long-term care. Fourth quarter of 2020: EO 192 (effective November 5) imposed enforceable health and safety standards on every in-person worksite in the State (six-foot distancing, masks, sanitizer, hand-hygiene breaks, disinfection, daily health checks, exclusion of symptomatic workers); the winter re-tightening closed indoor dining nightly from 10:00 p.m. (EO 194, November 12), barred bar seating, cut indoor gatherings to 10 and outdoor to 150 then 25 (EOs 196, 204), paused indoor sports (December 5 to January 2) and authorized municipal business curfews (EO 195); the Supreme Court suspended new in-person jury trials on November 16, 2020 (Ex. NJ-100). First quarter of 2021: the 10-person indoor cap held until March 19; capacity rose from 25 to 35 percent on February 5 (EO 219) and to 50 percent on March 19 (EO 230); the dining curfew ended February 5; arenas reopened at 10 to 15 percent on March 1 (EO 225). Second quarter of 2021: outdoor gatherings 200 (April 2, EO 234) and 500 (May 7, EO 238); percentage caps removed on May 19 with six-foot spacing retained and trade shows and conferences capped at 250 (EO 239); the outdoor mask order ended May 17 (EO 241); on May 28 EO 242 lifted the indoor public mask requirement, the six-foot rules and all capacity limits for retail, personal care, gyms, recreation and casinos, and on June 4 removed indoor gathering limits; EO 243 rescinded the telework mandate effective June 4, 2021, after fourteen and a half months; the Department of Health rescinded its business directives on May 28 (ED 21-005); P.L. 2021, c. 103 (June 4) fixed what survived. Third quarter of 2021: the State of Emergency; EO 242 and EO 243 (carrying EO 192's indoor-workplace masking and distancing of unvaccinated or unverified employees and daily health checks, and preserving masking and distancing in health care, home health, office-based health care, correctional, shelter and transit settings); the eviction moratorium as restructured by EO 249 and P.L. 2021, c. 188 (August 4); the insurance grace-period order (EO 123) and the utility grace period (EO 246) to December 31, 2021; every unrevoked Department of Health directive (long-term care testing and visitation, elective-procedure protocols amended June 16, 2021, child care and adult day standards) to January 11, 2022; and the Delta-wave mandates: school masks from August 9 (EO 251), vaccination-or-testing for every worker in hospitals, ambulatory surgery centers, clinics, dialysis, long-term care, home health agencies, health care service firms, medical day care and correctional settings from September 7 (EO 252), the same rule for all preschool-12 school workers announced August 23 for October 18 (EO 253), and child care masking from September 24 with vaccination-or-testing from November 1 (EO 264). Local orders were preempted throughout (EO 108; EO 195), with two carve-outs the State itself created: municipal business curfews between 8:00 p.m. and 5:00 a.m. (November 12, 2020 to May 28, 2021) and municipal indoor mask requirements (from May 28, 2021).

Preemption of local orders

Yes, from the first day. EO 104 para. 12 (March 16, 2020) and EO 107 (March 21, 2020) barred any municipal, county or other political subdivision from enacting or enforcing conflicting orders; EO 108 (March 21, 2020, Ex. NJ-005) invalidated every existing county or municipal COVID-19 restriction that conflicted with EO 107, naming as examples changes to the essential-retail list, limits on business scope or hours, density or distancing rules, gathering orders and curfews, and reserved to municipalities only short-term-rental platforms and parks (para. 3). Every later order repeated the bar. EO 118 (April 7, 2020) removed county power over county parks; EO 195 (November 12, 2020, Ex. NJ-038) restated the preemption for EOs 103-194 and created the single wartime exception, letting municipalities and counties restrict the hours of non-essential retail, food and beverage, personal care and recreation businesses between 8:00 p.m. and 5:00 a.m. (Newark and other cities used it).

Offices and telework

March 21, 2020 to June 4, 2021 (EO 107 para. 10; EO 243 para. 1): 'All businesses or non-profits in the State, whether closed or open to the public, must accommodate their workforce, wherever practicable, for telework or work-from-home arrangements'; para. 11: 'the business or non-profit should make best efforts to reduce staff on site to the minimal number necessary to ensure that essential operations can continue.' Office buildings required masking policies for prolonged proximity from July 8, 2020 (EO 163 para. 3); every in-person worksite under EO 192 standards from Nov. 5, 2020 (distancing, masks, sanitizer, hygiene breaks, disinfection, daily health checks, exclusion and notification); building owners' cleaning protocols from April 10, 2020 (EO 122 para. 5); indoor workplace masking and distancing kept for unvaccinated or unverified employees and daily health checks kept after May 28 and June 4, 2021 (EO 242 paras. 2-3; EO 243 paras. 2, 4), into Q3 2021 through c. 103 sec. 1(14) (inference). DOBI Bulletin 20-06 (March 19, 2020) permitted licensed lenders' staff to work from home on condition that no licensable activity be conducted in person with the public from the home.

Tri-State travel advisory announced June 24, 2020, effective June 25: 14-day self-quarantine expected for travelers from designated States, implemented in New Jersey as an advisory with a voluntary survey shared with local health departments (NJ-087); converted Nov. 25, 2020 to all travel beyond New York, Connecticut, Pennsylvania and Delaware, with New Jersey 'strongly discourag[ing] all non-essential interstate travel'; CDC-aligned 7/10-day quarantine from February 2021; unvaccinated travelers only from April 2021 (NJ-088); no longer in effect as of May 17, 2021 (NJ-108). NJ TRANSIT capped at 50 percent April 13 - July 15, 2020 with masks (EOs 125, 165); transit masking preserved May 28, 2021 (EO 242 para. 13) and required federally from Feb. 1, 2021 (CDC order; TSA directives).

Face coverings

Face coverings required for workers and customers at essential retail from April 10, 2020 (EO 122 para. 1(k)) and at manufacturing, warehousing and construction sites (para. 3(g)); on NJ TRANSIT from April 13 (EO 125); at all reopened retail, personal care, dining and recreation premises (EOs 142, 150, 154, 157); at indoor gatherings (EO 152); outdoors where distancing not practicable from July 8, 2020 (EO 163 para. 1) and in office buildings for prolonged proximity (para. 3); in schools (EO 175); at every in-person worksite for employees, customers and visitors from Nov. 5, 2020 (EO 192 para. 1(b)); outdoor requirement rescinded May 17, 2021 (EO 241); indoor public-space requirement lifted May 28, 2021 (EO 242 para. 1) with masking kept in non-public indoor workplaces (para. 3), health care, home health, office-based health care, correctional, shelter and transit settings (para. 13) and schools and child care (para. 9); vaccinated employees exempted June 4, 2021 (EO 243 para. 2); municipalities permitted to reimpose indoor mask requirements from May 28, 2021 (EO 242 para. 18); school masks Aug. 9, 2021 (EO 251); child care masks Sept. 24, 2021 (EO 264).

Vaccination mandates

EO 252 (Aug. 6, 2021): vaccination-or-testing (one to two tests weekly) for every worker, contractor and support staff member in hospitals, ASCs, long-term care, clinics, dialysis, FQHCs, PACE, medical day care, licensed home health agencies, registered health care service firms, correctional facilities and community residences, effective Sept. 7, 2021, with tracking and reporting to local health departments; EO 253 (Aug. 23, 2021): all preschool-12 school workers, contractors and regular volunteers, effective Oct. 18, 2021; EO 264 (Sept. 20, 2021): child care workers, effective Nov. 1, 2021; EO 271 (Oct. 20, 2021): State contractors (post-period). New Jersey issued no vaccination-proof-for-entry order for patrons in 2021.

Standing duties

The statutes, codes and penalty provisions of New Jersey that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the New Jersey duties →

New Jersey placed every employer under standing duties before any COVID-19 order issued, and every COVID-19 order was written on top of them. First, the Civilian Defense and Disaster Control Act, N.J.S.A. App. A:9-33 et seq. (Ex. DUT-NJ-006): section 9-45 empowers the Governor to make orders on 'the conduct of the civilian population' and on 'any matter that may be necessary to protect the health, safety and welfare of the people,' and provides that such orders 'having to do with the conduct of persons... shall be binding upon each and every person within this State'; section 9-49 makes any person who violates 'any order, rule or regulation adopted by the Governor' a disorderly person subject to six months' imprisonment or a $1,000 fine or both; section 9-50 reaches aiding and abetting; section 9-40 bars any subdivision from enforcing a rule at variance with the Governor's. Every COVID-19 order closes with the duty of 'every person or entity in this State or doing business in this State... to cooperate fully' and a penalty paragraph citing App. A:9-49 and -50 (Ex. NJ-004 paras. 24-25; NJ-011 paras. 7-8; NJ-036 paras. 11, 13; NJ-050 paras. 20-21; NJ-051 paras. 7-8). The Appellate Division held in JWC Fitness, LLC v. Murphy, No. A-0639-20 (App. Div. Oct. 18, 2021) (Ex. DUT-NJ-013), that the Governor exercised 'his authority to regulate the operations of specified categories of businesses under N.J.S.A. App. A:9-40 and 9-45' and that a violator 'shall be adjudged a disorderly person and be subject to fine or imprisonment.' Second, the Emergency Health Powers Act, P.L. 2005, c. 222 (Ex. DUT-NJ-001): the declaring order 'may also prescribe necessary actions or countermeasures to protect the public's health' (26:13-3(a)); the Commissioner may 'close, direct and compel the evacuation of, or... decontaminate... any facility of which there is reasonable cause to believe that it may endanger the public health' (26:13-8(a)), a power EO 192 para. 13 recited as the sanction for any employer 'that fails to adhere to the protocols'; the Commissioner may take 'all reasonable and necessary measures to prevent the transmission of infectious disease' (26:13-12); a quarantined person 'shall obey the commissioner's orders' (26:13-15(d)). N.J.S.A. 26:4-2 (Exs. DUT-NJ-001 s. 31, DUT-NJ-002) gives the Department and every local board power to 'maintain and enforce proper and sufficient quarantine,' remove infected persons and 'disinfect any premises,' with the Department overseeing 'the uniform exercise of these powers' during a declared public health emergency; N.J.S.A. 26:4-129 (Ex. DUT-NJ-003) penalizes any person who 'fails to perform any duty imposed by this chapter.' N.J.A.C. 8:57-1.11 (Ex. DUT-NJ-012) requires written isolation and quarantine orders on report of a communicable disease and commands that 'any person who is responsible for the care, custody, or control of a person who is ill or infected... shall take all measures necessary to prevent transmission.' Third, the State Sanitary Code has 'the force and effect of law' and 'shall be enforced by each local board of health, the local police authorities and other enforcement agencies' (26:1A-9, Ex. DUT-NJ-004), each violation 'a separate offense' punishable by $50 to $1,000 (26:1A-10, Ex. DUT-NJ-005); its retail-food chapter excludes any worker 'affected with any disease in a communicable form... or... acute respiratory infection' from food work and directs the person in charge to 'relieve him or her of duties' (8:24-2.2, Ex. DUT-NJ-011), and lets the health authority order corrective action, closure and the exclusion of infected employees (8:24-8.8, Ex. DUT-NJ-017); local boards 'shall examine into and prohibit... all causes of disease' and 'shall cause the same to be removed and abated at the expense of the owner' (26:3-46, Ex. DUT-NJ-016). Fourth, the workplace statutes: 'Every employer shall furnish a place of employment which shall be reasonably safe and healthful for employees... including methods of sanitation and hygiene' (34:6A-3, Ex. DUT-NJ-009); public employers 'shall... [p]rovide... a place of employment which [is] free from recognized hazards' (34:6A-33, Ex. DUT-NJ-010); private-sector enforcement is federal under 29 U.S.C. 654(a)(1) (text at Ex. DUT-CT-009). EO 192 (Ex. NJ-036) supplied the pandemic content for every in-person worksite from November 5, 2020 ('is required to abide by the following requirements, at minimum'), incorporating CDC recommendations and DOH guidance by command, with a Department of Labor complaint intake, Department of Health inspections and subpoenas, and closure under 26:13-8; EO 243 paras. 1-2 and EO 242 para. 3 carried those requirements past June 4, 2021 (Exs. NJ-051, NJ-050). N.J.A.C. 12:70 (Ex. DUT-NJ-014, effective Aug. 10, 2020) prohibited penalizing an employee who took recommended time off for an infectious disease. Fifth, the liability shield: P.L. 2020, c. 18 (Ex. DUT-NJ-007) immunized health care professionals and facilities only, and only for acts 'in the course of providing medical services in support of the State's response' or 'undertaken in good faith... to prevent the spread of COVID-19,' expiring September 1, 2021 (P.L. 2021, c. 103, s. 2, Ex. NJ-053); the general business shield, A4189 (Ex. DUT-NJ-008), was introduced June 1, 2020 and never enacted, so every other employer kept its full duty of care, measured by the instruments above. Sixth, the operating conditions: EO 107 ('must close,' 'must, wherever practicable, provide pickup,' 'shall abide by social distancing practices to the extent practicable,' 'must accommodate their workforce, wherever practicable, for telework'), EO 122 ('must adopt policies that include, at minimum'; 'Continue to follow guidelines and directives issued by the New Jersey Department of Health, the CDC and the Occupational Health and Safety Administration'), EO 150 para. 1(c) ('Satisfy all standards issued by DOH'), EO 157 ('provided that such businesses adopt policies that they comply with the standards issued by the Division of Consumer Affairs and DOH'), EO 183 para. 1(f) ('Abide by all other health and safety standards issued by the Commissioner of DOH'), EO 242 ('must continue to abide by all other current health and safety standards'), and the DOH directives ('must adhere to the protocols listed below,' Exs. NJ-069, NJ-070; 'shall comply with the attached Department of Health standards,' Ex. NJ-075; 'shall adhere to guidance by the Centers for Disease Control,' Ex. NJ-073). Seventh, the Attorney General's December 2020 enforcement releases (Exs. DUT-NJ-015, DUT-NJ-018) charged licensees for failing to 'enforce face covering requirements for patrons and employees,' 'maintain a six-foot minimum distance between dining tables' and 'enforce social distancing among employees and patrons,' stating that those who 'flout curfews, seating restrictions, face covering mandates, and other mitigation measures will face consequences.' Nothing in this State's record was voluntary.

The question these duties answer

Whether the measures New Jersey employers took 'beyond' the emergency orders were voluntary within Notice 2021-20 Q&A-14. New Jersey answer: they were the performance of duties imposed by the Civilian Defense and Disaster Control Act (N.J.S.A. App. A:9-40, -45, -49, -50: orders on the conduct of persons 'binding upon each and every person within this State'; disorderly-persons offense), the Emergency Health Powers Act (N.J.S.A. 26:13-3, -8, -12, -15), the communicable-disease title (N.J.S.A. 26:4-2, -129), the State Sanitary Code with 'the force and effect of law' (N.J.S.A. 26:1A-9, -10; N.J.A.C. 8:57-1.11, 8:24-2.2, 8:24-8.8), nuisance law (N.J.S.A. 26:3-46), the Worker Health and Safety Act (N.J.S.A. 34:6A-3) and PEOSHA (N.J.S.A. 34:6A-33) with the federal general duty clause, the Department of Labor's COVID-19 rule (N.J.A.C. 12:70), and orders that made continued operation conditional on Department of Health standards (EO 107, 122, 150, 157, 183, 192, 242, 243), enforced by prosecution, license suspension and closure under N.J.S.A. 26:13-8; the Legislature granted no immunity to businesses outside health care.
