The record in brief

ScopeCounty and municipal instruments of the San Francisco Bay Area (the seven coordinated health jurisdictions: the Counties of Alameda, Contra Costa, Marin, San Francisco, San Mateo and Santa Clara and the City of Berkeley), the San Francisco Mayor's emergency proclamation and executive orders, BART, and the Santa Clara County Superior Court, March 2020 through September 30, 2021. Statewide California instruments (Proclamation of Mar. 4, 2020; EO N-33-20 of Mar. 19, 2020; the Blueprint for a Safer Economy of Aug. 28, 2020; the Regional Stay at Home Order of Dec. 3, 2020; the June 11, 2021 Beyond the Blueprint order; the CDPH face-covering guidance of June 18, 2020 and July 28, 2021; the CDPH health-care-worker vaccination orders of July 26 and Aug. 5, 2021; the Cal/OSHA COVID-19 Prevention ETS of Nov. 30, 2020 and June 17, 2021) are cited by name and date only.

The Bay Area is the jurisdiction in which the county health officers acted first, longest and most restrictively in the nation, and it is the jurisdiction in which the Service's assertion that no orders were in effect in the third quarter of 2021 is refuted by eight simultaneous health-officer orders and two proof-of-vaccination orders. 2020 Q2 (with the March 13-31 run-up): on March 13, 2020 San Francisco (Order C19-05b) and Santa Clara County prohibited gatherings of 100 or more; San Mateo issued parallel gathering orders on March 12 and 14. On March 16, 2020 the health officers of Alameda, Contra Costa, Marin, San Francisco, San Mateo and Santa Clara Counties and the City of Berkeley issued identical shelter-in-place orders, effective 12:01 a.m. March 17 through April 7, ordering all individuals to shelter at their residences, ordering all businesses other than Essential Businesses to cease all activities at facilities in the county except Minimum Basic Operations, prohibiting all gatherings of any number outside a household, and prohibiting all travel other than Essential Travel; violation was a misdemeanor under Health and Safety Code section 120295. On March 31, 2020 the same seven jurisdictions superseded those orders through May 3, narrowed Essential Business, halted most construction, closed recreation areas and required every Essential Business to prepare, post and implement a Social Distancing Protocol. On April 17, 2020 San Francisco (C19-12), Marin, Berkeley, San Mateo, Alameda and Contra Costa ordered face coverings at essential businesses, in Minimum Basic Operations, on transit and elsewhere (enforcement from April 22); BART required face masks of riders from April 22. On April 29, 2020 the shelter orders were extended through May 31 (effective May 3-4) with construction and outdoor businesses allowed under protocols; on May 17-22 curbside retail and related manufacturing and logistics resumed under revised orders (SF C19-07d; San Mateo c19-5d; Santa Clara May 18 order effective May 22). The San Francisco Mayor's Proclamation of Local Emergency (Feb. 25, 2020) and its supplements imposed residential and commercial eviction moratoria that were extended through 2020 and into 2021. 2020 Q3: the counties moved from shelter orders to indefinite 'Stay Safer at Home' and 'Risk Reduction' orders (SF C19-07e through C19-07j; Santa Clara's July 2, 2020 Risk Reduction Order effective July 13; Contra Costa's orders HO-COVID19-16 onward), while the State's July 13, 2020 closures applied to indoor dining, bars, gyms, personal care, offices for non-critical sectors and worship; San Francisco's C19-07f (July 13) carried the State's closures into local law; every business remained bound to a Social Distancing Protocol and face-covering rules. 2020 Q4: the Blueprint tiers governed capacity (Contra Costa aligned by order effective Sept. 16, 2020; Santa Clara's Revised Risk Reduction Order of Oct. 5 took effect Oct. 14); Contra Costa capped indoor dining, theaters and worship at 25 percent on Nov. 6 (HO-COVID19-35); Santa Clara imposed a 14-day quarantine on travel of more than 150 miles, 10 percent retail capacity and a hotel essential-travel limit effective Nov. 30; San Francisco's C19-07o (Nov. 28) closed indoor dining under the Purple tier; on Dec. 4, 2020 five counties and Berkeley adopted the State's Regional Stay at Home Order early (effective Dec. 6; SF C19-07p; Contra Costa HO-COVID19-37), closing outdoor dining, personal care and most non-retail sectors and capping retail at 20 percent; the State's order applied to the whole Bay Area Region from Dec. 17; San Francisco imposed a 10-day travel quarantine from Dec. 18 (C19-17). 2021 Q1: the Regional Stay at Home Order was lifted Jan. 25, 2021; the counties sat in the Purple tier until early March, then Red (March) and Orange (late March), with local orders (SF C19-07r-w) carrying each tier's closures and capacity limits into local law. 2021 Q2: Santa Clara's May 18, 2021 order (effective May 19) required every business to ascertain the vaccination status of its personnel, required face coverings and case reporting; San Francisco's C19-07x (May 20) implemented the Yellow tier with local restrictions; on June 11, 2021 San Francisco issued C19-07y ('Safer Return Together'), effective June 15, 2021, which kept mandatory personnel screening, sick-leave, signage and mega-event rules and added a vaccination requirement for personnel in high-risk settings; Santa Clara's June 21, 2021 order phased out its May 18 order. 2021 Q3: on Aug. 2, 2021 the eight Bay Area health officers (Alameda, Contra Costa, Marin, San Francisco, San Mateo, Santa Clara, Sonoma and Berkeley) issued indoor face-covering orders binding everyone regardless of vaccination status, effective 12:01 a.m. Aug. 3, 2021, with businesses 'required to implement the indoor face covering order'; on Aug. 12, 2021 San Francisco required Covered Businesses (indoor dining, bars, gyms and large indoor events) to verify proof of full vaccination of every patron age 12 and older by Aug. 20, 2021 and of personnel by Oct. 13, 2021; Marin required first-responder and public-sector employers to verify vaccination status and test unvaccinated personnel weekly from Sept. 15, 2021; Contra Costa announced a proof-of-vaccination-or-test order on Sept. 14, 2021; San Francisco's C19-07y was further updated Aug. 24 and Sept. 10, 2021; the federal transit mask order and TSA directives governed BART, Muni and Caltrain throughout. Every one of those Q3 2021 instruments was in force on Sept. 30, 2021.

End of general restrictions

What remained in force

SF C19-07y remained in force through Sept. 30, 2021 and beyond, binding every business and governmental entity to personnel symptom screening, sick-leave and signage rules, mega-event rules and (Section 6) a vaccination requirement for personnel in high-risk settings; the local emergency proclamations of San Francisco and the counties; the CDPH face-covering guidance (masks for unvaccinated persons indoors; masks for all on transit and in health care, K-12, shelters and correctional settings); the Cal/OSHA ETS as readopted June 17, 2021; the federal transit mask order and TSA directives; from Aug. 3, 2021, indoor face-covering orders in all eight Bay Area health jurisdictions; from Aug. 20, 2021, San Francisco's proof-of-vaccination requirement; from Sept. 15, 2021, Marin's first-responder vaccination-verification order; from Sept. 22, 2021, Contra Costa's proof-of-vaccination-or-test requirement (date from the county's Sept. 14, 2021 release title; verify).

The State and the local orders

California did not preempt or bar local health-officer orders at any time in the period. The State Public Health Officer's orders (EO N-33-20 of Mar. 19, 2020; the Blueprint of Aug. 28, 2020; the Regional Stay at Home Order of Dec. 3, 2020; the Beyond the Blueprint order of June 11, 2021) each stated that local health jurisdictions could impose more restrictive measures, and the Bay Area counties did so throughout (earlier shelter orders, longer closures, early adoption of the Regional Stay at Home Order on Dec. 4-6, 2020, the Aug. 2021 mask orders and the Aug.-Sept. 2021 vaccination-proof orders). Every other local restriction remained enforceable as a misdemeanor under Health and Safety Code section 120295 and the county ordinance codes.
