Local districts and authorities

Cluster LOCAL-DISTRICTS-AUTHORITIES. (1) The largest public school districts' own instruments as orders of governmental authorities: board resolutions declaring emergencies and delegating closure and remote-instruction powers, board policies on remote education, superintendent and CEO directives closing buildings, fixing remote and hybrid periods and reopening dates, and the 2021-22 masking, quarantine, vaccination and testing rules (Board of Education of the City of Chicago; Los Angeles Unified School District Board of Education; New York City Department of Education; Prince George's County Public Schools; Houston Independent School District; Fairfax County Public Schools). (2) Public authorities' instruments: convention center authorities (New York Convention Center Operating Corporation (Javits Center); Metropolitan Pier and Exposition Authority (McCormick Place); Pennsylvania Convention Center Authority; Massachusetts Convention Center Authority; Orange County Convention Center), park districts and libraries (Chicago Park District; Minneapolis Park and Recreation Board; Chicago Public Library), housing authorities (New York City Housing Authority; Housing Authority of the City of Los Angeles) and municipal utilities (Sacramento Municipal Utility District; CPS Energy; Los Angeles Department of Water and Power; Austin Energy / City of Austin Utilities; East Bay Municipal Utility District) whose shutoff moratoria, lobby closures and program suspensions bound their customers, contractors and vendors. Summary

Local school boards, park boards, library boards, housing authorities, convention-center authorities and municipally owned utilities issued instruments of their own during every claimable quarter, and those instruments limited commerce, travel and group meetings for the employers that depend on them. Second quarter of 2020: the Board of Education of the City of Chicago adopted on March 25, 2020 Board Rule 2-4.2 (Emergency Authority in the Event of a Declared State of Emergency) and Resolution 20-0325-RS1 authorizing emergency expenditures and actions in response to COVID-19 (Ex. 001-002); the Los Angeles Unified Board of Education on March 10, 2020 adopted Board Report 308-19/20, declaring that emergency conditions exist at every District school and office and authorizing the Superintendent to take 'any and all actions necessary,' including 'the relocation of students and staff' and 'provision of alternative educational program options,' and to contract without bids under Cal. Pub. Cont. Third quarter of 2021: the Chicago Board adopted Resolution 21-0728-RS7 continuing its COVID-19 emergency authority for FY22 on July 28, 2021 and a Remote Education Policy on a final basis on August 25, 2021 (Ex. 006-007); Houston ISD proposed on August 5 and adopted on August 12, 2021 a mask mandate for 'students, staff, and visitors at all schools, buses, and facilities' regardless of vaccination status, opened a virtual academy on August 30, and on September 27, 2021 announced a Travis County injunction allowing it to continue the mandate (Ex. 047-049); the NYC DOE announced on August 26, 2021 that 'all DOE staff and contractors in DOE buildings are required to have their first dose by September 27th' and universal masking (Ex. 008); Fairfax County Public Schools required all employees to be vaccinated or submit routine negative tests (August 23, 2021) and required proof of vaccination for athletics (August 30, 2021) (Ex. 052-053); PGCPS opened September 8, 2021 with universal masking and a vaccination-or-weekly-testing rule for every employee (Ex. 017-018); the Los Angeles Unified Board adopted on September 9, 2021 the resolution requiring COVID-19 vaccination of all students twelve and older who access in-person instruction, reciting the District's existing requirement 'for all employees to be vaccinated' (Ex. 031-032); LADWP's shutoff moratorium continued through the quarter and was extended by its Board to March 31, 2022 (Ex. 062); McCormick Place, 'closed since March of 2020,' reopened in July 2021 (Ex. 027); the Boston Convention and Exhibition Center hosted its first public convention since the pandemic on September 3, 2021 (Ex. 044). Every one of these authorities acted under a statutory grant of power over the commerce, meetings or premises it limited, and each instrument reached the education, child-care, hospitality, events, contractor, utility-customer and workforce functions of the employers around it.

This cluster holds 31 binding instruments and 38 context records. A binding instrument is an order, rule, emergency amendment, license condition or administrative order with the force of law. A context record is a guidance document, an announcement, an enforcement summary or a data release that explains what the binding instruments did and how the regulator applied them. School-district building closures and remote-instruction periods ended between April 2021 (hybrid returns: PGCPS Apr. 8, 2021, Ex. 015; Chicago Feb.-Mar. 2021, Ex. 004) and the fall of 2021 (full in-person openings: PGCPS Sept. 8, 2021, Ex. 017; NYC DOE Sept. 13, 2021, Ex. 008); the districts' masking, quarantine, vaccination and testing rules then ran through and beyond Sept. 30, 2021. Convention centers reopened between May 29, 2021 (Boston, Ex. 059) and July 2021 (McCormick Place, Ex. 027), and the first public conventions occurred in July-September 2021 (Ex. 027, 044). Utility shutoff moratoria ended June 30, 2021 (SMUD, Ex. 024), September 2021 (CPS Energy, Ex. 042), and March 31, 2022 (LADWP, Ex. 062).

Texas: Executive Order GA-38 (July 29, 2021) purported to bar local mask mandates, including school districts'; Houston ISD, Dallas ISD and Fort Worth ISD adopted mandates in August 2021 nonetheless and litigated; a Travis County temporary injunction let Houston ISD continue its mandate (Ex. 049). Florida: the Governor's EO 21-175 (July 30, 2021) and the Department of Health's emergency rule directed parental opt-outs; Miami-Dade, Broward, Palm Beach, Hillsborough, Orange and Duval boards imposed mandates in August 2021 and the State Board of Education pursued them (see FL State file and MET-TPA, MET-ORL). Illinois, California, New York, Maryland and Virginia did not preempt district rules; the State health orders in those States made masking in schools mandatory for 2021-22 (see IL, CA, NY, MD and VA State files).
