The record in brief

ScopeCounty and municipal instruments of the Baltimore metropolitan area, Maryland: Baltimore City (Mayor and Health Commissioner), Baltimore County (County Executive), Anne Arundel County (County Executive and Health Officer), Howard County (County Executive), Harford County (County Executive), and the Maryland Transit Administration's Baltimore-area service and face-covering notices.

The Baltimore metro ran on two layers from March 2020 through September 2021: the Governor's numbered Orders (MD-001 to MD-031 in the State file), each of which from May 13, 2020 (Order 20-05-13-01) through February 23, 2021 expressly authorized every county and Baltimore City to issue 'Local Orders' that were 'more restrictive' and directed every State and local law enforcement officer to 'execute and enforce this Order and any Local Order'; Every one of the five jurisdictions declared its own emergency in the second week of March 2020: Baltimore County (Executive Order 2020-002, March 13, 2020), Anne Arundel County (Executive Order No. 16, March 13, 2020), Howard County (Executive Order 2020-02, March 15, 2020, which also closed The Mall in Columbia, the Shops at Savage Mill and two cinemas by name), Harford County (March 18, 2020) and Baltimore City (Mayor Young, March 19, 2020). Baltimore County's Executive Order 2020-003 (March 16, 2020) prohibited every gathering of 50 or more and closed places of assembly; the county, Howard County and Anne Arundel County each suspended legal and procedural deadlines and closed county boards to the public (Baltimore County EO 2020-004 and 2020-009; Howard EO 2020-03 and 2020-04; Anne Arundel EO 17 and EO 19). Second quarter of 2020: April 1 opened under the Governor's Stay-at-Home Order (MD-007) in every jurisdiction; Anne Arundel's Health Officer issued a Public Safety Order effective April 15, 2020 for retail and food establishments; Anne Arundel closed all playgrounds (EO 18, March 31). When the Governor's Stage One began at 5:00 p.m. May 15, 2020, all four counties and the City held back: Baltimore County EO 2020-005 (May 15) kept retail to curbside, malls and personal services closed and indoor worship barred; Anne Arundel EO 21 (May 15, amended May 29) and Howard EO 2020-08 (May 15) kept retail to curbside and worship to ten persons; Baltimore City's Mayor continued the stay-at-home provisions until its June 8, 2020 Order (MET-BAL-003) rescinded them and opened only religious facilities, personal services, youth camps, libraries and day care in a 'modified Phase 1' while retail stayed curbside; Baltimore County opened retail to the public and barbers and salons only on May 22 (EO 2020-006), outdoor dining May 29 (EO 2020-007), and joined the State's Stage Two at 5:00 p.m. June 5 (EO 2020-008); Anne Arundel opened outdoor dining May 29 (EO 22), worship June 5 (EO 23) and non-essential businesses June 5 (EO 24), and terminated its stricter orders at 5:00 p.m. June 12 (EO 25); Howard reopened barbers and salons at 50 percent May 29 (EO 2020-09), regulated foodservice and worship (EO 2020-10, May 29), and rescinded its local orders June 5 and June 12 (EO 2020-11, 2020-12). Third quarter of 2020: on July 21 the health officers of Anne Arundel, Baltimore, Howard, Montgomery and Prince George's Counties and Baltimore City jointly asked the State to roll back reopenings; Baltimore City's Health Commissioner ordered face coverings in public whenever distancing was not possible from 5:00 p.m. July 24 (MET-BAL-002) and indoors in every public space from July 29 (MET-BAL-007); the Mayor issued orders July 22 and August 7, 2020 (recited in MET-BAL-014; the City closed indoor dining from July 24 and reopened it at 25 percent August 7, retrieved only as recitals and secondary reports); Anne Arundel EO 27 (effective 5:00 p.m. July 24) capped social gatherings at 25 indoors and 50 outdoors, ended indoor restaurant service at 10:00 p.m. and closed mall food-court dining; Anne Arundel EO 29 (September 4) and EO 32 (September 21) held religious facilities and retail at 50 percent when the State went to 75, and held foodservice at 50 percent with a 10:00 p.m. indoor cutoff; Baltimore County incorporated each State order by county order (EO 2020-010, -011, -013, -014, -016) so that State rules carried county enforcement. Fourth quarter of 2020: Anne Arundel EO 33 (October 2) eased mall food courts; EO 37 (November 13-20) cut indoor dining to 25 percent and social gatherings to 10 indoors and 25 outdoors and suspended organized sports on county fields; EO 38 (November 20) restated the regime; Baltimore City's Health Commissioner ordered face coverings in all indoor public places, on transit and outdoors when unable to distance from November 6 (MET-BAL-008); Mayor Young's November 10 order (effective November 12, 5:00 p.m.) returned the City to a modified Phase 1 (MET-BAL-009); Howard EO 2020-19 (effective November 17, 5:00 p.m.) prohibited indoor social gatherings over 10 and outdoor over 25 and EO 2020-20 (effective November 27) extended the definition to social and fraternal organizations, recreation sports and wedding receptions; Mayor Scott's December 9 order (effective December 11, 5:00 p.m.) closed indoor and outdoor dining, indoor recreation and theaters and capped retail, religious facilities, personal services, gyms, casinos and museums at 25 percent (MET-BAL-010, MET-BAL-006); Anne Arundel EO 39 (effective December 16, 5:00 p.m.) closed indoor dining, capped retail and personal services at 25 percent and religious facilities at 33 percent, and restricted food-delivery fees (EO 40). First quarter of 2021: Anne Arundel reopened indoor dining at 25 percent January 13 (EO 41) and 50 percent January 27 (EO 42, restated February 25 as EO 43); Baltimore City's January 21 order (effective January 22) reopened indoor dining at 25 percent and outdoor at 50 (MET-BAL-011), restated February 17 (effective February 22; MET-BAL-004); Howard EO 2021-04 (effective February 19) rescinded EO 2020-19 and -20 but kept the 10/25 social-gathering caps; when the Governor's Order 21-03-09-01 ended the delegated local authority at 5:00 p.m. March 12, 2021, Howard rescinded its gathering limits (EO 2021-08, March 17), Baltimore County incorporated the State order (EO 2021-010), Anne Arundel kept its 10/25 social-gathering caps and 50 percent venue caps under county authority (EO 45, March 12), and Baltimore City kept indoor dining at 25 percent on March 12 (MET-BAL-012) and raised it to 50 percent and outdoor to 75 percent only from 6:00 a.m. March 26 (MET-BAL-005), acting under Md. Code, Pub. Safety § 14-109 and the City Emergency Operations Plan. Second quarter of 2021: Anne Arundel terminated every local restriction at 5:00 p.m. April 27 (EO 46) and its civil emergency June 9 (EO 49); Baltimore City's Health Commissioner kept indoor masking after the State's outdoor relaxation (April 30; MET-BAL-013), the Mayor rescinded all seventeen Mayoral Executive Orders at 12:01 a.m. May 15 (MET-BAL-014) while the Health Commissioner the same day continued indoor, transit, school and outdoor-venue masking (MET-BAL-015), and on June 16 ordered every City COVID health order rescinded at 6:00 a.m. July 1, 2021 (MET-BAL-016); Howard ended its deadline suspensions July 1 (EO 2021-12, May 19); Harford announced July 1 as the end of its local emergency (MET-BAL-097). The State and the local orders

Maryland never barred local orders outright. From Order 20-05-13-01 (May 13, 2020) through Order 21-02-23-01 every Governor's order authorized political subdivisions to issue 'Local Orders' that were 'more restrictive' and made every State and local law enforcement officer responsible to 'execute and enforce this Order and any Local Order' (MD-010, MD-026 in the State file; recited in MET-BAL-033, MET-BAL-054, MET-BAL-083, MET-BAL-088). Order 21-03-09-01 provided that the authority so delegated 'shall cease to be effective at 5:00 pm on March 12, 2021' (recited in Howard EO 2021-08, MET-BAL-091, and Anne Arundel EO 45, MET-BAL-072). The counties and the City responded differently: Howard rescinded its local limits and applied the State order (EO 2021-08, March 17, 2021); Baltimore County incorporated the State order by county order (EO 2021-010; index only); Anne Arundel kept social-gathering and venue caps under its own charter and emergency authority until April 27, 2021 (EO 45, EO 46); Baltimore City continued to issue capacity orders under Md. Code, Pub. Safety § 14-109, the City Charter and the Baltimore City Emergency Operations Plan (MET-BAL-012, MET-BAL-005, MET-BAL-014), and its Health Commissioner continued to issue face-covering orders under COMAR 10.06.01.06 and Baltimore City Health Code § 4-404 through March 1, 2022 (MET-BAL-013, MET-BAL-015, MET-BAL-017, MET-BAL-018).
