ScopeLos Angeles metropolitan area: County of Los Angeles Department of Public Health (Health Officer orders for the County Public Health Jurisdiction, i.e., all cities and unincorporated areas except Long Beach and Pasadena); Los Angeles County Board of Supervisors (tenant-protections resolution); City of Los Angeles (Mayor's public orders under the emergency authority of L.A. Admin. Code ch. 3, sec. 8.27 and 8.29; City Council ordinances); City of Long Beach Health Officer; City of Pasadena Health Officer and City Council; Superior Court of California, County of Los Angeles (general orders of the Presiding Judge); Los Angeles County Metropolitan Transportation Authority (face-covering rule). Los Angeles County ran the largest and longest-lived local order regime in the United States. The County Health Officer (Dr. Muntu Davis, under Cal. Health & Safety Code secs. 101040, 101085 and 120175, enforced through sec. 120295 and L.A. County Code sec. 11.02.080) closed bars, dine-in restaurants, gyms, theaters and bowling alleys on March 16, 2020 (Ex. MET-LA-001), issued the Safer at Home Order on March 19 and re-issued it on March 21, 2020 to conform to EO N-33-20 (Ex. MET-LA-003): all public and private gatherings prohibited, all persons ordered to remain at home except for enumerated purposes, all non-essential businesses ordered to cease in-person operations, indoor malls, playgrounds, flea markets, beaches and trails closed (Ex. MET-LA-074). The April 10 revision extended the order to May 15, 2020 and compelled every Essential Business to implement a written Social Distancing Protocol and to supply and require cloth face coverings by April 15 (Ex. MET-LA-004); the May 13 revision extended it indefinitely and permitted curbside retail only (Ex. MET-LA-005). The City of Los Angeles ran a parallel mayoral regime: the March 15 closure order (Ex. MET-LA-027), the March 19 Safer at Home order (Ex. MET-LA-028), the March 17 commercial-eviction moratorium (Ex. MET-LA-030) codified by Ordinance 186585 (Ex. MET-LA-031), the April 7 Worker Protection Order compelling face coverings for workers and customers of every open business (Ex. MET-LA-029) and the April 7 Supplemental Paid Sick Leave order (Ex. MET-LA-037); the City's order authorized the Department of Water and Power to shut off water and power to any business operating in violation (Ex. MET-LA-032). Long Beach (Ex. MET-LA-041, -042) and Pasadena (Ex. MET-LA-047, -048), which run their own health departments, issued the same closures on March 16 and March 19-22, 2020. The Superior Court suspended all civil and criminal trials and closed courthouses except for essential matters from March 17, 2020 (Ex. MET-LA-058) and kept courtrooms closed for non-essential judicial business through May 12, 2020 (Ex. MET-LA-059). The second quarter of 2020 therefore opened with every non-essential workplace in the metro closed to in-person operation and every resident under a stay-at-home command. Reopening began May 26, 2020 (Ex. MET-LA-006: retail, offices, malls at 50 percent, dine-in with protocols) and was reversed on July 1, 2020 (indoor dining closed, Ex. MET-LA-007) and July 13-14, 2020 (indoor gyms, worship, personal care, malls and offices in non-critical sectors closed: recited in Ex. MET-LA-009; City Ex. MET-LA-033; Pasadena Ex. MET-LA-049); K-12 schools were ordered closed to in-person learning on July 18, 2020 (Ex. MET-LA-009). The County remained in the Purple tier of the State's Blueprint from August 28, 2020 through March 14, 2021 (Ex. MET-LA-010, -043): indoor dining, indoor gyms, indoor worship at the State's terms, non-essential offices and indoor entertainment stayed closed; malls and retail were capped at 25 percent. The November 2020 surge produced the 10 p.m. to 5 a.m. closure of all activities with other households (Nov. 21), the suspension of all in-person dining including outdoor dining from November 25, 2020 (Ex. MET-LA-011; Long Beach Ex. MET-LA-079), the Temporary Targeted Safer at Home Order effective November 30, 2020 and, from December 6-7, 2020, alignment with the State's Regional Stay at Home Order (County Ex. MET-LA-012 (Dec. 30 revision); City Ex. MET-LA-034; Long Beach Ex. MET-LA-077; Pasadena Ex. MET-LA-050): all gatherings prohibited, all persons ordered to stay home, retail at 20 percent, essential offices at 25 percent, non-essential offices closed, personal care closed, a mandatory 10-day quarantine for anyone arriving from outside Southern California. That regime governed the first day of 2021 and continued to January 25-29, 2021 (Ex. MET-LA-013 reopened outdoor dining on January 29, 2021, with indoor dining, indoor gyms and non-essential offices still closed). The Red tier began March 15, 2021 (Ex. MET-LA-071; revised Mar. 19, Ex. MET-LA-014: indoor dining and movie theaters at 25 percent, gyms at 10 percent, non-essential offices still ordered to 'cease in-person operations until further notice'); the Orange tier began April 5, 2021 (Ex. MET-LA-015 (Apr. 14 rev.); Pasadena Ex. MET-LA-072; Long Beach Ex. MET-LA-078: offices reopened indoors 'with modifications', 50 percent unless all staff vaccinated; restaurants 50 percent); the Yellow tier began May 6, 2021 (Ex. MET-LA-016; Pasadena Ex. MET-LA-073). General business restrictions ended June 15, 2021 (Ex. MET-LA-017; City Ex. MET-LA-076; Pasadena Ex. MET-LA-052), leaving in force the mask rules for unvaccinated persons and for K-12 and youth settings, vaccination-or-test verification at indoor mega events, the isolation and quarantine orders, the health-facility orders (Ex. MET-LA-024, -066) and the County and City eviction moratoria (Ex. MET-LA-025, -026, -031). One month later the County reinstated universal indoor masking, effective 11:59 p.m. July 17, 2021 (Ex. MET-LA-018), followed the same day by the City (Ex. MET-LA-035) and Long Beach (Ex. MET-LA-045) and on July 22 by Pasadena (Ex. MET-LA-053). The third quarter of 2021 then added: the County's Health Care Worker Vaccination order of August 12, 2021 mandating employers of health-care and home-care workers to document full vaccination by September 30, 2021 (Ex. MET-LA-023); masks at outdoor mega events from August 19 (Ex. MET-LA-019; Pasadena Ex. MET-LA-054 from Aug. 20); Pasadena's health-care-worker vaccination order (Aug. 20, compliance Sept. 30; Ex. MET-LA-055) and indoor-mega-event vaccine-or-test order (issued Aug. 26, effective Sept. 15; Ex. MET-LA-056); the City's Ordinance 187134 requiring vaccination of all City employees (effective Aug. 24, 2021; Ex. MET-LA-067); the revised County quarantine and isolation orders of August 26, 2021 (Ex. MET-LA-021, -022) and Long Beach's of September 9 and 15 (Ex. MET-LA-068, -069); the City's Safer L.A. orders of August 24 and September 30, 2021 (Ex. MET-LA-036, -040); the County's September 17, 2021 order requiring bars, breweries, wineries, distilleries, nightclubs and lounges to verify patrons' and employees' vaccination status and outdoor mega events to verify vaccination or testing from October 7, 2021 (Ex. MET-LA-020); the Superior Court's mandatory face-mask order (Ex. MET-LA-062) and its July 29, 2021 general order extending criminal deadlines (Ex. MET-LA-063); and the County eviction moratorium, in force through September 30, 2021 and extended by the Board to January 31, 2022 (Ex. MET-LA-026, -025). California never preempted these local orders; every County order recites that it 'does not supersede any stricter limitation imposed by a local public entity', and the State's orders set floors that Los Angeles County exceeded in every quarter. The only judicial interruption was the Superior Court's December 8, 2020 ruling in the California Restaurant Association's challenge to the outdoor-dining ban, which the Court of Appeal set aside on March 1, 2021 (verified_secondary; see caveats); the ban itself was never enjoined in operation because the State's Regional Stay at Home Order imposed the same prohibition from December 6, 2020.

The State and the local orders

None. California did not preempt, bar or displace local health officer orders at any time in 2020-2021. Cal. Health & Safety Code secs. 101040, 101085 and 120175 empower county and city health officers to take measures to control communicable disease; the State Public Health Officer's orders of March 19, May 7 and July 13, 2020, the Blueprint for a Safer Economy (Aug. 28, 2020) and the Regional Stay at Home Order (Dec. 3, 2020) set statewide floors and expressly permitted local health officers to be more restrictive; EO N-60-20 (May 4, 2020) and the State's variance system made county reopening contingent on local orders. Every County order recites that 'County Health Officer Orders may not be less restrictive than Orders issued by the State Public Health Officer' and that the order 'does not supersede any stricter limitation imposed by a local public entity within the Los Angeles County Public Health Jurisdiction' (Ex. MET-LA-003 para. 4; Ex. MET-LA-012 para. 2(a)); Pasadena's orders recite that where the Pasadena Health Officer's order is more restrictive than the State's, 'the health order of the Health Officer shall control' (Ex. MET-LA-051 para. 6). Long Beach and Pasadena are separately empowered city health jurisdictions carved out of the County order (Ex. MET-LA-003, -004: 'with the exception of the cities of Long Beach and Pasadena'). Litigation history (not an exhibit; see caveats): the California Restaurant Association and a restaurant owner sued the County over the November 25, 2020 outdoor-dining suspension; on December 8, 2020 the Superior Court (Judge Chalfant) ruled the County had to justify the ban with a risk-benefit analysis, a ruling that had no operative effect because the State's Regional Stay at Home Order independently prohibited all in-person dining from December 6, 2020; the Court of Appeal granted the County's writ petition on March 1, 2021 (County of Los Angeles Department of Public Health v. Superior Court, Cal. Ct. App. Mar. 1, 2021, per CourtListener metadata; verified_secondary). No local order in this metro was ever enjoined in operation.
