The record in brief

ScopeMetropolitan Milwaukee (City of Milwaukee Health Department orders; the March 2020 joint order of the Milwaukee, North Shore, Cudahy, South Milwaukee and St. Francis health officers; Milwaukee County administrative orders, courts and the Milwaukee County Transit System) and Madison and Dane County (Public Health Madison & Dane County emergency orders; City of Madison Metro Transit; the Wisconsin Supreme Court decisions on the Dane County orders). Statewide instruments are cited by name and date only.

Wisconsin's two largest metropolitan areas were governed for the whole of the six claimable quarters by a layered set of orders in which the local layer, not the State, did most of the work after May 13, 2020. The State layer (cited by name): Executive Order #72 (Mar. 12, 2020), DHS Emergency Order #5 (Mar. 17, 2020; bars and restaurants to take-out), Emergency Order #12, Safer at Home (Mar. 24, eff. Mar. 25, 2020) and Emergency Order #28 (Apr. 16, 2020, to May 26), struck by Wisconsin Legislature v. Palm, 2020 WI 42 (May 13, 2020); Executive Order #82 and Emergency Order #1, face coverings (July 30, eff. Aug. 1, 2020), re-declared by Executive Orders #90, #94/#95, #104 and #105 until Fabick v. Evers, 2021 WI 28 (Mar. 31, 2021); and Emergency Order #3, 25 percent capacity (Oct. 6, eff. Oct. 8 to Nov. 6, 2020). Palm and Fabick ended the statewide orders; neither touched the local ones, and Becker v. Dane County, 2022 WI 63, later held that Wis. Stat. § 252.03 authorizes local health officers to issue exactly these orders and that no state law preempts them.

Run-up and 2020 Q2. Public Health Madison & Dane County ('PHMDC') prohibited gatherings of 250 on March 13, 2020 and of 50 on March 15 (restaurants to 50 percent of seating; long-term care visitation restricted), and on March 25 adopted the State's Safer at Home order as a county order enforceable by county and city forfeiture. Milwaukee's health officers closed bars and restaurants to on-site consumption at 2:01 a.m. on March 17, 2020, a day before the State did, and the City's Commissioner of Health signed a city-wide Stay-At-Home Order on March 23 (eff. 12:01 a.m. Mar. 25, 2020) ordering all residents to stay home, all non-essential businesses to cease on-site activity and all non-essential travel to stop. When the Supreme Court struck the State's order on May 13, 2020, both metros re-imposed the regime locally within a day: PHMDC's Emergency Order #1 (May 13) and Emergency Order #2 (May 18, eff. May 19: stay home encouraged, all gatherings prohibited, non-essential businesses limited to Minimum Basic Operations, dining rooms and bars closed, remote work required 'to the greatest extent feasible'); Milwaukee's 'Milwaukee Safe at Home' Order #1 (May 14, 2020), followed by Phase 2 (May 21) and Phase 3 (early June) with 25 percent capacity limits across retail, dining, worship, fitness and personal care. Dane County's Forward Dane Phase 1 (Emergency Order #3, eff. May 26) set 25 percent capacity and 50-person indoor caps; Phase 2 (Emergency Order #5, eff. June 15) raised them to 50 percent and 50 indoors / 100 outdoors. On June 30, 2020 both metros were under capacity orders: Dane County at 50 percent (Emergency Order #6, eff. June 25, 10:00 p.m.) and Milwaukee at 25 percent (Phase 3), with K-12 schools closed for in-person instruction in Milwaukee.

2020 Q3. Milwaukee's Order #4 (Phase 4) took effect 12:01 a.m. July 1, 2020: gatherings capped at the lesser of 50 percent, one person per 30 square feet or 250; schools closed for in-person instruction 'until further notice'; Order #4.1 (July 30, eff. July 31) added a mandatory Business COVID Safety Plan for every restaurant and bar (deadline Sept. 15, 2020) and MHD approval of a safety plan before any school could open in person. The Common Council's 'MKE Cares' ordinance (File 200426, adopted July 13, eff. July 16, 2020) created MCO § 62-8 requiring face coverings indoors in any building open to the public and outdoors within six feet of others. Dane County went the other way on July 2, 2020 (Emergency Order #7): indoor gatherings cut to 10, outdoor to 25, restaurants to 25 percent of seating, taverns closed to indoor customers; Emergency Order #8 (eff. July 13) added a universal face-covering mandate nineteen days before the State's; Emergency Order #9 (eff. Aug. 24) confined in-person schooling to grades K-2, a provision the Supreme Court enjoined September 10, 2020 and vacated June 11, 2021 while leaving the gathering, tavern and mask provisions in place. Both transit systems capped riders (MCTS at 10 per bus, Madison Metro at 15 then 20), ran reduced schedules and required masks (Metro from July 13, MCTS from Aug. 1, 2020).

2020 Q4 and 2021 Q1. Milwaukee's Order #4.2 (Oct. 26, eff. Oct. 29, 2020) cut gathering limits to the lesser of 25 percent, one per 30 square feet or 10 indoors / 25 outdoors, required seating for all guests, closed dance floors and held restaurants and bars at 25 percent; Order #4.3 (eff. Dec. 3, 2020) and Order #4.4 (eff. Feb. 5, 2021) continued the 25 percent regime into March 2021. Dane County prohibited all indoor gatherings from November 18, 2020 (Emergency Order #10 and its Nov. 20 amendment), then allowed 10 indoors from December 16 (Emergency Order #11) and January 13, 2021 (Emergency Order #12), with restaurants at 25 percent and taverns closed to indoor service through March 9, 2021 (Emergency Order #13).

2021 Q2. Milwaukee's Phase 6 order (eff. Mar. 19, 2021) allowed 75 percent / 750 indoors, 1,000 outdoors and 50 percent for restaurants and bars, still with schools conditioned on approved plans and masks under § 62-8; its May 19, 2021 revision expired by its terms at 12:01 a.m. June 1, 2021, ending all City capacity restrictions and, by the ordinance's own 'for the duration' clause, the mask mandate. Dane County's Emergency Order #14 (eff. Mar. 10) moved restaurants to 50 percent (taverns 25 percent), Emergency Order #15 (eff. Apr. 7) continued it, and Emergency Order #16 (eff. May 5) set 75 percent until it expired at 12:01 a.m. June 2, 2021; isolation and quarantine requirements and health-care and transit masking continued.

2021 Q3. Dane County reimposed a universal indoor face-covering order for everyone age two and older effective August 19, 2021 (Face Covering Emergency Order, to Sept. 16), superseded by Face Covering Emergency Order #2 effective September 10, 2021 (to Oct. 8) and then #3 (Oct. 8 to Nov. 5), a chain that ran to March 1, 2022 and that the Supreme Court upheld in Becker. In Milwaukee County no city or county general order was in force July 1 to September 30, 2021; what was in force was the federal transit mask order on every MCTS bus (TSA extension of Aug. 23, 2021 to Jan. 18, 2022), Milwaukee County's own administrative orders for County facilities and workforce (Service Risk and Re-Opening Requirements AO 20-13v10 from July 1, 2021; Health Screening AO 20-17v4 from July 15; Universal Face Mask Policy AO 20-14v7 from Aug. 2; case-response AO 20-7v8 from Aug. 19, 2021), and the State's isolation and quarantine framework; the Milwaukee Health Department's August 5, 2021 school guidance was guidance, not an order, and is listed as not in force.

End of general restrictions

2021-06-01 (Milwaukee); 2021-06-02 (Dane County)

Instrument City of Milwaukee: Phase 6 COVID-19 Public Health Plan (revised May 19, 2021) expired by its terms at 12:01 a.m. June 1, 2021 (Ex. MET-MKE-064; announced Ex. MET-MKE-040), ending capacity limits and the MCO § 62-8 mask requirement. Dane County: Emergency Order #16 (Apr. 29, 2021) expired at 12:01 a.m. June 2, 2021 (Ex. MET-MKE-022; Ex. MET-MKE-048).

What remained in force

Dane County: isolation and quarantine requirements; masks in health-care settings and on public transportation (Ex. MET-MKE-048); then the Face Covering Emergency Orders from Aug. 19, 2021 (Exs. MET-MKE-023, -024, -025). Milwaukee County: the federal transit mask order on MCTS (Ex. MET-MKE-044); County administrative orders for County facilities and employees (Ex. MET-MKE-052); the statewide isolation/quarantine framework. City of Milwaukee: no general order or mask mandate from June 1, 2021 until the January 2022 ordinance (post-period).

The State and the local orders

Wisconsin did not preempt or bar local COVID-19 orders at any time in the six quarters. Wis. Stat. § 252.03 gives local health officers power to 'do what is reasonable and necessary for the prevention and suppression of disease' and to 'forbid public gatherings when deemed necessary to control outbreaks or epidemics.' The Wisconsin Supreme Court's decisions striking statewide instruments (Wisconsin Legislature v. Palm, 2020 WI 42, May 13, 2020, on Emergency Order #28; Fabick v. Evers, 2021 WI 28, Mar. 31, 2021, on successive gubernatorial emergency declarations) did not reach local orders, and both metros re-imposed their regimes locally within a day of Palm (Exs. MET-MKE-005, -074). The only judicial limit on the local orders in this metro was James v. Heinrich, 2021 WI 58 (temporary injunction Sept. 10, 2020; decision June 11, 2021), holding that § 252.03 does not authorize a local health officer to close schools and vacating the school-closure provisions of PHMDC Emergency Order #9; the court left the gathering, capacity, tavern and mask provisions untouched (Ex. MET-MKE-026). Becker v. Dane County, 2022 WI 63 (July 8, 2022) then held that § 252.03 authorizes local health officers to act by order, that no state law preempts Dane County's enforcement ordinance and that the delegation is constitutional (Ex. MET-MKE-027). The Legislature's 2021 attempts to constrain the emergency response (2021 AB 1, vetoed Feb. 5, 2021; 2021 AB 23 on vaccination mandates, vetoed Apr. 23, 2021; 2021 SB 183 on federal-funds oversight, vetoed Mar. 29, 2021; veto overrides failed May 17, 2022) never became law (docs.legis.wisconsin.gov histories read Sept. 26, 2026). The State's October 2020 capacity order (Emergency Order #3) expressly permitted more restrictive local orders, and Milwaukee's health department determined that its own order governed (Ex. MET-MKE-033).

Milwaukee: closed under Stay-At-Home; gyms 25 percent (Phase 3), 50 percent (Phase 4), one per 30 sq. ft. with mandatory masks (Order #4.2 onward); places of public amusement under Gathering Size Limits (lesser-of rule: 10 indoors Oct. 29, 2020 to Feb. 4, 2021; 250 from Feb. 5; 750 from Mar. 19, 2021). Dane: closed Mar. 25 to May 25, 2020; 25 percent then 50 percent; outdoor venues 25 percent of seating (Phase 1); indoor gatherings 10 (July 2, 2020), prohibited (Nov. 18 to Dec. 15, 2020), 10 (to spring 2021).

Hotels and short-term rentals

Milwaukee Stay-At-Home Order treated hotels, motels and shared rental units as residences for stay-home purposes (Ex. 030); Phase 4 release: 'Hotels/Motels - 50% capacity; pools, hot tubs and exercise facilities' limited (Ex. 057); Milwaukee County projected $100 million of lost 2020 revenue (Ex. 043).

Offices and telework

Milwaukee: non-essential businesses ordered to cease on-site activity except Minimum Basic Operations, work from home permitted (Ex. 030, Mar. 25, 2020); every MMFS order required businesses 'to facilitate remote work to the greatest extent possible' (Ex. 033). Dane: Emergency Order #2 (May 19, 2020) required all businesses 'to the greatest extent feasible, use technology to avoid meeting in person, including... remote work'; 'meetings, trainings, and conferences are considered Mass Gatherings' capped at 50 (June 15, 2020) and 10 (July 2, 2020 onward) (Exs. 005, 008, 010). Milwaukee County: Telework AO 20-3 from Mar. 16, 2020 (Ex. 052).

Manufacturing

Non-essential manufacturing facilities in the City of Milwaukee were required to cease on-site activity Mar. 25 to mid-May 2020 except Minimum Basic Operations (Ex. 030 § 3); breweries, wineries and distilleries could continue manufacturing with distancing while their taprooms were closed or limited (Exs. 034, 035).

Construction

Treated as essential infrastructure in both stay-home orders (Exs. 030, 005: 'essential infrastructure, broadly defined'), subject to Social/Physical Distancing Requirements and Safe Business Practices.

Real estate

Stay-home orders barred landlords from entering leased residential premises except for maintenance emergencies (Exs. 030, 005); showings and closings depended on the Minimum Basic Operations and essential-services definitions.

Hospitals and long-term care

Dane County Mar. 15, 2020 order: long-term care facilities exempt from the gathering ban only if all visitation except compassionate care restricted, volunteers and non-essential personnel excluded, group activities and communal dining cancelled, active screening (Ex. 002). Milwaukee Phase 6 release (Mar. 18, 2021): the order 'no longer restricts visitors to long-term care facilities' (Ex. 038), establishing that the City's orders had restricted them until then. Health-care masking continued in Dane County after June 2, 2021 (Ex. 048).

Dental and elective health care

No metro-level order located; governed by the statewide Safer at Home order's health-care provisions and the Wisconsin Dental Association and DHS guidance.

Schools

Milwaukee: K-12 schools closed for in-person instruction and extracurricular activities 'until further notice' from Mar. 25, 2020 through Phase 4 (Exs. 030, 056, 059); from Order #4.1 (July 31, 2020) to the Phase 6 orders (spring 2021) closed 'until they have COVID-19 safety plans approved by the Milwaukee Health Department' (Exs. 060, 034-037, 069); Aug. 5, 2021 guidance only (Ex. 070). Dane: closed for instruction Mar. 25, 2020 (Ex. 003) through Phase 1 (Ex. 006); open 'as of July 1, 2020' (Ex. 008); grades 3-12 ordered virtual by Emergency Order #9 (eff. Aug. 24, 2020), enjoined Sept. 10, 2020 and vacated June 11, 2021 (Exs. 012, 026); written hygiene and masking requirements for schools continued in Emergency Orders #10-#16.

Child care

Milwaukee: child care settings capped at 50 percent (Phase 3) and 75 percent of building capacity (Orders #4.2-#4.4) (Exs. 055, 034, 035); Dane: child care subject to the orders' child care and youth settings sections; Madison and Dane isolation and quarantine requirements continued after June 2, 2021 (Ex. 048).

Milwaukee County Circuit Court: Chief Judge Triggiano's emergency order effective Mar. 16, 2020; Supreme Court orders of Mar. 22, 2020 suspending jury trials and most in-person proceedings to May 22, 2020 (extended); Clerk's in-person hours limited from Mar. 24, 2020; criminal division office closed to the public (Exs. 053, 072, 073). Milwaukee County closed senior centers, parks venues and the Zoo from Mar. 16, 2020 (Ex. 053) and governed County facilities through administrative orders into Q3 2021 (Ex. 052). Madison closed libraries and public-facing counters from March 2020 (Exs. 045, 050).

Travel and quarantine

Milwaukee Stay-At-Home Order: 'All travel... except Essential Travel and Essential Activities... is prohibited' (Ex. 030 § 5). MCTS: Saturday schedules on weekdays and Freeway Flyers suspended (Mar. 2020), fares suspended to June 1, 2020, 10 riders per bus, masks from Aug. 1, 2020, federal mask order through Q3 2021 (Exs. 041-044).
