Cluster ST-CORRECTIONS-EMA-GUARD. (1) State departments of corrections and the largest county jails: the instruments that suspended visitation, volunteer entry, tours, programming, work release, off-site medical trips, intake from county jails and inter-facility transfers, that screened or excluded contractors and vendors at the door, and that in 2021 conditioned entry and employment on vaccination or testing (Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, District of Columbia, Georgia, Illinois, Iowa, Kansas, Kentucky, Louisiana, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Jersey, New Mexico, New York, Ohio, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Vermont, Virginia, Washington, Wisconsin; Harris, Maricopa, San Diego and King Counties; Philadelphia). Summary

Every State prison system in the United States closed its doors to visitors in the second week of March 2020, and most closed them to volunteers, tour groups, program providers and every contractor the warden did not deem mission-critical. The suspensions were not brief. New York's ran to August 2020 and returned in the winter; New Jersey's ran from Mar. 14 to Oct. 9, 2020 and again to May 1, 2021; Colorado's remained total in April 2021; Texas's ran seventeen months, to August 2021, when contact visits resumed only for vaccinated inmates. Alongside visitation the agencies suspended the commerce that runs through a prison gate: Ohio admitted 'only mission critical contractors (construction, medical, food service, etc.),' Oregon limited 'institution access to only essential staff,' California suspended 'large-scale construction projects located within the secure perimeter' and cancelled 'visiting and volunteer entries statewide,' South Carolina and Alabama suspended work release and labor crews (removing inmate labor from private employers), Alabama suspended community physician appointments and Ingram State Technical College classes, Arizona suspended community-college classes, Louisiana postponed the Angola rodeo and halted 'routine transfers from local level,' and every system screened vendors at the door. Governors reached the same functions by order: California N-36-20 and Illinois 2020-13 halted intake from county jails; Colorado D 2020 016 suspended the Department's 'duty to receive and take custody of prisoners'; Michigan 2020-29 required screening of 'staff, incarcerated persons, vendors, and any other person entering the facility' and suspended transfers; Washington 20-50 waived release statutes; New Jersey 124 built an emergency home-confinement program; Kentucky 2020-267 and 2020-293 commuted sentences conditionally. The county jails did the same: Maricopa County admitted only 'legal or essential operational personnel,' San Diego ended 'all social visits,' 'visitors for reentry programs' and 'group classes,' Harris County restricted public access to storefronts and substations, and King County cut its population by a third in three weeks on the Executive's direction. The emergency-management layer is the State-level Defense Production Act: New Jersey EO 109 required every business to inventory its PPE, EO 111 required daily reporting of hospital capacity and supplies to the Office of Emergency Management on pain of the Disaster Control Act's penalties, and EO 113 empowered the Superintendent of State Police 'to take or use personal services and/or real or personal property, including medical resources'; Maryland's order of Mar. 19, 2020 put the receipt, 'stockpiling, rationing, and distributing' of Strategic National Stockpile assets under the Secretary of Health; Maryland, Kentucky, Michigan, California and Texas capped prices of medical supplies and consumer goods under emergency powers. The Guard layer shows the States' militias ordered into active duty (Maryland, Washington, Arkansas, Texas) and assigned to testing sites, PPE manufacturing and distribution, food banks and nursing-home disinfection, with the federal Title 32 funding memoranda (DEFENSE-GUARD file) carrying those missions to the end of 2020 and into 2021. By quarter: 2020 Q2 is the closure quarter (every instrument in force); 2020 Q3 and Q4 continue the suspensions (Georgia through Aug. 12, 2020 and beyond; Tennessee re-suspended Dec. 1, 2020; New Jersey's outdoor visits from Oct. 9, 2020 were reservation-only and capped); 2021 Q1 and Q2 carry the winter re-suspensions and the first conditional reopenings (New Jersey May 1, 2021; Colorado June 19, 2021; Texas's Parole Board rescinded its remote-hearing regime only on Mar. 10, 2021); 2021 Q3 carries the vaccination-or-testing regimes for staff and contractors (California from Aug. 2, 2021, Colorado from Aug. 17 and Sept. 28, 2021, with the State-employee mandates of Washington, Oregon, Massachusetts, Illinois, New Jersey, Connecticut, Maryland, Pennsylvania, New Mexico and Nevada cross-cited from the State files), the CDCR rule that N95 or KN95 masks be worn by 'employees and visitors' at every institution 'regardless of vaccination status,' Texas's vaccination-conditioned visitation from August 2021, and the Maryland Guard order and price order in force to Aug. 15, 2021.

The third quarter of 2021

What ended the general restrictions, and what remained
Instrument
No single instrument. The correctional regimes outlasted the States' general business restrictions: California's June 15, 2021 reopening left CDCR's masking and protective-equipment directives unchanged (Ex. 016) and was followed by the Aug. 2, 2021 vaccination-verification rule (Ex. 009); Texas's GA-34 (Mar. 10, 2021) ended the Parole Board's temporary orders (Ex. 036) but TDCJ visitation stayed suspended until August 2021 (Ex. 066, 067); Colorado ended its visitation suspension June 19, 2021 and imposed a vaccination requirement Sept. 28, 2021 (Ex. 091, 093); New Jersey's visits remained outdoor, reservation-only and screened through Q3 2021 (Ex. 020); Maryland's Guard and price orders ran to the end of the state of emergency, Aug. 15, 2021 (Ex. 037, 038).

Preemption. Not applicable to this cluster in the ordinary sense. New Jersey EO 113 para. 4 barred any municipality or county from enacting or enforcing any order that 'will or might in any way conflict' with the commandeering order. County sheriffs' jail rules operated under their own statutory authority (Tex. Local Gov't Code § 351.041; A.R.S. § 31-101; Cal. Gov't Code § 26605; RCW 70.48.071) and were not preempted by State orders; State correctional orders bound privately operated prisons in terms (Arizona Ex. 032, Tennessee Ex. 068, Mississippi Ex. 080, Georgia Ex. 070).
