The record in brief

ScopeMetro HNL: City and County of Honolulu (Oahu), Maui County, Hawaii County, Kauai County.

Hawaii has four counties and no municipal governments below them; each mayor acted under Haw. Rev. Stat. ch. 127A (sections 127A-12(c), 127A-13(b), 127A-25) and the county charter, and every county instrument recites that it has the force and effect of law and that violation is a misdemeanor punishable by a fine of up to $5,000, up to a year in jail, or both (Haw. Rev. Stat. 127A-29). County orders took effect with the Governor's approval, which the exhibits record; 2020 Q2: Honolulu declared its emergency March 4, 2020, closed bars and dine-in restaurants and banned public gatherings March 20 (EO 2020-01), and imposed the Stay at Home / Work from Home Order March 22 (EO 2020-02; effective March 23 through April 30), restated April 29 (EO 2020-09; to May 18) and May 6 (EO 2020-10; to May 31); it added a curfew April 10-13 (EO 2020-05), a face-covering mandate for employees and customers from April 20 (EO 2020-07), and confined auto dealers to on-line sales (EO 2020-04). Ho'oulu i Honolulu 2.0 (May 13), 3.0 (May 28) and 4.0 (June 27) kept the shelter-in-place framing while opening Designated Businesses with conditions; dine-in resumed June 5 with gatherings capped at ten. Maui's Public Health Emergency Rules (effective March 22, 2020) ordered all persons to stay at their residence or lodging and closed non-essential businesses; Hawaii County's Rules 2, 3 and 4 (April 17 - May 6, 2020) closed parks, mandated face coverings and ordered all individuals to stay home; Kauai's Rules 1-9 (March 16 - May 13, 2020) included Rule 5 (stay at home, March 24), Rule 6 (face coverings, April 13), Rule 3 (March 21) and Rule 7 (face coverings and safe practices, May 3). 2020 Q3: Honolulu's Ho'oulu 5.0 (July 29) kept ten-person caps and outdoor masking; the August resurgence brought Act With Care - Do Not Gather (EO 2020-23, August 8: bars closed), No Social Gatherings (EO 2020-24, August 20), and the Second Stay At Home / Work From Home Order (EO 2020-25, August 27 - September 9, extended by EO 2020-26 to September 23), which required every non-essential business to cease all activities at its facilities except Minimum Basic Operations and prohibited all social gatherings; on September 24 the City entered Tier 1 of its four-tier Recovery Framework (EO 2020-27: gatherings of five; retail 50 percent). Kauai issued Rules 13-17 (quarantine locations, rental-vehicle prohibition for quarantined persons, enhanced movement quarantine); Hawaii County's Rules 10-12 (July 22 - September 30, 2020) conditioned every open business and mandated face coverings countywide; Maui's June 8, 2020 rules governed. 2020 Q4: Honolulu Tier 2 from October 22 (EO 2020-29, -30, -31) through February 24, 2021; Kauai adopted Rule 19 (October 15, four-tier Business and Recreational Guidelines), Rule 20 and Rule 23 (opting out of Safe Travels from December 2, 2020, so that every trans-Pacific arrival quarantined) and Rule 24 (resort bubbles); Hawaii County ran a two-test arrival regime under Rule 12 as amended (October 15) and Rule 13 (November 27); Maui amended its rules December 8 and 30. 2021 Q1: Honolulu Tier 2 to February 24, then Tier 3 (EO 2021-02, February 25: gatherings of ten; restaurants parties of ten; real estate by remote means where possible); Maui's rules effective January 19, 2021 (AlohaSafe Alert condition); Kauai's Rule 25 (March 5) returned the island to Safe Travels effective April 5; Hawaii County Rule 14. 2021 Q2: Honolulu Tier 3 through June 10 (EO 2021-04, -05, -06), then Tier 4 from June 9 (EO 2021-08: gatherings 10 indoors/25 outdoors; indoor masks); Maui rules effective May 9, 2021 and a June 2021 restatement; Kauai Rule 19 amended May 6 and May 25; Hawaii County Rule 14 extended (Seventh Supplementary Proclamation, April 12, 2021). 2021 Q3: Honolulu Tier 4 to July 7, Tier 5 from July 8 (EO 2021-09: gatherings 25/75; indoor masks; Exhibit B conditions on every Designated Business), cut back August 23 (EO 2021-10, aligned with the Governor's EO 21-05: gatherings 10/25; restaurants, bars and gyms restricted), Safe Access O'ahu vaccination-or-test entry from September 13 (EO 2021-11), and the Safe O'ahu Response Plan from September 22 (Proclamation and EO 2021-13: event categories closed; gatherings 10/25; restaurants and bars seated only at 50 percent with a 10 p.m. liquor cutoff; Safe Access; indoor masks). Maui's rules were in force throughout, with Safer Outside vaccination-or-test conditions from September 15, 2021, restated October 11, 2021 (effective October 16). Kauai's Rule 19 as amended July 8, 2021 ran to October 13, 2021; Rule 1 to July 12, 2021; Rule 26 (September 3, 2021) reimposed limits; the mayor's Tenth Supplementary Emergency Proclamation (August 16, 2021) continued the county emergency. None of the four counties ended its general restrictions before September 30, 2021.

Honolulu: Proclamation and EO 2021-13 (Sept. 17, 2021; effective Sept. 22 - Oct. 19, 2021), amended by EO 2021-14 (Oct. 8), 2021-15 (Oct. 27), 2021-16 (Nov. 22, 2021) and 2022-01 (Jan. 5, 2022). Maui: Public Health Emergency Rules restated Oct. 11, 2021 (effective Oct. 16, 2021) and continued into 2022. Kauai: Rule 19 repealed by Rule 27 (Oct. 13, 2021), Rule 27 repealed by Rule 28 (Dec. 1, 2021), Rule 28 repealed Mar. 1, 2022 (county archive).

What remained in force

After Sept. 30, 2021: the statewide indoor mask mandate and Safe Travels; Safe Access O'ahu, Maui Safer Outside and Kauai Rules 26-28 (vaccination or negative test for entry to restaurants, bars, gyms and similar establishments); gathering caps of 10 indoors and 25 outdoors; restaurant and bar seating, capacity and hours limits; the mayors' emergency proclamations.

The State and the local orders

None. The Governor's proclamations authorized county emergency orders and rules subject to the Governor's approval, and the exhibits carry the approval line (e.g., Ex. MET-HNL-011 'Approved by GOV/HI-EMA 5/13/20'; the Honolulu framework amendments of March 8 and March 24, 2021 carry the Governor's signature block). No State instrument barred or displaced a county order between March 2020 and September 30, 2021; the State's Executive Order 21-05 (Aug. 10, 2021) set statewide floors that Honolulu implemented by EO 2021-10 and the other counties incorporated by reference.

Manufacturing

Confined to essential supply chains under the stay-at-home orders; Designated Businesses thereafter; Kauai Rule 10 (Ex. 093).

Construction

Essential Infrastructure, including public works and housing construction, under the stay-at-home orders (Ex. 004; Maui Ex. 044 item 15; Kauai Rule 10 reopened 'other closed manufacturing or construction' May 22, 2020, Ex. 093).

Real estate

Honolulu prohibited in-person showings through June 4, 2020 and permitted them from June 5, 2020 with limits (Ex. 012); ten-attendee cap under Tier 3 (Ex. 026); 'should be accomplished by remote/electronic means whenever possible' through Sept. 2021 (Ex. 038).

Hospitals and long-term care

State instruments; the county orders exempted health care operations while restricting the commerce, travel and gatherings around them.

Dental and elective health care

Healthcare Operations were Essential Businesses under every county order (Ex. 004, 042, 055, 068).

Schools

State Department of Education closures; Maui treated educational institutions as essential for essential functions only (Ex. 042, 044).

Child care

Childcare facilities listed as essential in Maui's rules (Ex. 044 item 13; Ex. 046 item 13 'Preschool facilities').

Worship and gatherings

All public gatherings and events prohibited in Honolulu Mar. 20 - Apr. 30, 2020 (Ex. 003) and under the stay-at-home orders; ten-person caps June-Aug. 2020 (Ex. 012-016); all social gatherings prohibited Aug. 20 - Sept. 23, 2020 (Ex. 018-020); five under Tiers 1-2; ten under Tier 3; 10/25 under Tier 4; 25/75 under Tier 5 (July 8 - Aug. 22, 2021); 10/25 from Aug. 23, 2021 (Ex. 033, 037).
