The record in brief

ScopeMetro MSY: City of New Orleans / Orleans Parish (Mayor LaToya Cantrell; New Orleans Health Department; Civil District Court, First and Second City Courts, Criminal District Court, Municipal and Traffic Court; Regional Transit Authority); Jefferson Parish (Parish President Cynthia Lee Sheng; Jefferson Transit; 24th Judicial District Court); City of Baton Rouge-Parish of East Baton Rouge (Mayor-President Sharon Weston Broome; 19th Judicial District Court; Capital Area Transit System; East Baton Rouge Parish School System).

New Orleans ran the most restrictive and longest-lived local regime in the Deep South, and it did so through instruments with the force of law under La. R.S. 29:727. Run-up and 2020 Q2 (wages from March 13, 2020). Mayor Cantrell declared a state of emergency on March 11, 2020 (Ex. MET-MSY-001), and on March 16, 2020 promulgated emergency orders effective 6:00 a.m. March 17 that cancelled or prohibited all public and private gatherings, ordered bars, health clubs, malls, live-performance venues, reception facilities and other places of gathering to cease operations, and limited every restaurant to take-out and delivery (Ex. 002). On March 20, 2020 the Health Department issued the Stay at Home directives: residents to remain home except for essential functions, non-essential employers to take all steps reasonably necessary for employees to work remotely, gatherings prohibited even outdoors, movement restricted to authorized work and essential services (Ex. 003), two days before the Governor's 33-JBE-2020. The April 15, 2020 proclamation continued every closure through 6:00 a.m. May 16, 2020 and ordered all individuals in the City to stay at home, reciting the $500 fine and six months' confinement of La. R.S. 29:727(G) (Ex. 004). Jefferson Parish declared its emergency on March 12, 2020 (Ex. 051), closed parish buildings to the public on March 23 (03 CLS 2020, recited in Ex. 052), and extended the measures through April 30 (Ex. 052). East Baton Rouge declared its parish-wide emergency on March 13, 2020 (recited in Ex. 073). Every trial court in the metro closed: the Orleans Civil District Court and First and Second City Courts suspended jury trials and eviction hearings from March 13 and closed the courthouse from 4:00 p.m. March 17 through April 13, then to May 4 and to May 18, with civil jury trials suspended to July 1, 2020 (Exs. 038-042); the Criminal District Court closed on March 16 and extended the closure until further notice on April 23 (Exs. 046-047); the 24th JDC closed until May 4 (Ex. 067); the 19th JDC in Baton Rouge closed until May 1 with the Clerk of Court physically closed except for emergency filings (Ex. 078); the Municipal and Traffic Court closed from March 16 (Ex. 050). The Regional Transit Authority cut all service to a Saturday schedule from March 17, suspended twelve routes on March 29, suspended overnight service from April 12 and waived fares (Exs. 033-035); CATS in Baton Rouge waived fares from April 2020 to May 16, 2021 (Ex. 079). The City's Phase One began May 16, 2020 under the May 15 proclamation, which made every Health Department guideline and Public Health Advisory 'the effect of a temporary emergency order issued by the Mayor' (Ex. 005): retail, worship, gyms, offices and theaters at 25 percent, malls' interior stores closed, gatherings limited to a household (Ex. 006). Jefferson Parish entered Phase One on May 15 with JeT masks required for all riders and parish buildings requiring masks and temperature screening (Exs. 065, 066). 2020 Q3. New Orleans entered Phase Two on June 13, 2020 at 50 percent with gatherings of 100 (Ex. 007), then tightened on July 8 (gatherings 25 indoors, 100 outdoors; Ex. 008) and on July 25 (gatherings 25 indoors and 50 outdoors; bars closed to on-premises consumption; face coverings required at all times; Exs. 009-010), and stayed in that Phase Two through September (Ex. 011). Jefferson Parish imposed a parish-wide indoor mask mandate on July 1, 2020, twelve days before the State's (10 CLS 2020, Ex. 054), with the $500/six-month penalty of La. R.S. 29:727(G) recited. East Baton Rouge's Mayor-President signed Executive Order SWB 2020-07-01 on July 1, 2020, effective 12:01 p.m. July 3, 2020, requiring every commercial and nonprofit entity serving the public to implement a 'No Mask - No Service' policy enforced by the Fire and Police Departments with summonses on a third violation (Ex. 073), extended July 28 until Phase 3 (Exs. 074-076). Jefferson Parish's continuation proclamations (Exs. 053, 055) kept parish buildings under mask-and-screening rules and JeT under a mask requirement through 2020. The 24th JDC reopened in Phase II on June 5 with courtrooms limited to twelve persons and jury trials deferred to July 20, then to September 14, 2020 (Exs. 068-070). 2020 Q4. New Orleans moved to Phase 3.1 on October 3 (gatherings 50/100; restaurants 75 percent; bars takeout only; Ex. 012), Phase 3.2 on October 17 (bars outdoors only; Ex. 013) and Phase 3.3 on November 14 (gatherings 100/150; Ex. 014), then back to Modified Phase Two at 6:00 p.m. November 25, 2020 (gatherings 25 percent or 75 indoors and 150 outdoors; restaurants 50 percent; bars 25 percent or 50 indoors; Exs. 015-016), and on December 31 closed bars to indoor service with an 11 p.m. closing hour (Ex. 017). Jefferson Parish followed 168-JBE-2020 into Modified Phase Two on November 25 with bars closed to indoor consumption (Exs. 055-056). The Criminal District Court closed its building again from November 10 to November 23, 2020 (Ex. 049). 2021 Q1. New Orleans dropped to Modified Phase One on January 8, 2021 (retail and restaurants 25 percent indoors; bars outdoors only; 11 p.m. close; Ex. 018), returned to Modified Phase Two on January 29 with gatherings of 10 indoors and 25 outdoors (Ex. 019), and for Mardi Gras (6:00 a.m. February 12 to 6:00 a.m. February 17, 2021) ordered every bar to cease all operations including take-out, barred restaurants from all take-out alcohol sales, prohibited packaged alcohol sales in the French Quarter and CBD and closed Bourbon Street to loitering (Exs. 020-021). Modified Phase Three began March 12, 2021 (retail, restaurants, salons, theaters, offices 75 percent; bars and gyms 50 percent; gatherings 75/150; Ex. 022). The Civil District Court suspended civil jury trials again from January 12 to March 1, 2021 (Exs. 044-045). Jefferson Parish continued its measures through 2, 4 and 5 CLS 2021 (Exs. 057-059). 2021 Q2. New Orleans eased on April 30 (gatherings 250/500; retail 100 percent; Ex. 023), May 15 (Ex. 024) and May 28 (large-event pathways conditioned on masking or proof of vaccination or a negative test; Ex. 025). Jefferson Parish terminated 10 CLS 2020 on April 28, 2021 upon 79-JBE-2021, keeping masks in parish buildings and on JeT (Ex. 060), then lifted the building requirement for the vaccinated on May 15 while keeping masks on public transit (Ex. 061). CATS resumed fares May 16, 2021 (Ex. 079). 2021 Q3. The metro re-tightened before the State did. The 24th JDC ordered masks in courthouse common areas from July 22, 2021 (Ex. 071). New Orleans issued an indoor mask advisory July 23 (Ex. 026) and on July 31, 2021 at 6:00 a.m. reinstated an indoor mask requirement for all individuals over two 'at all times when in indoor spaces outside the household' with mandatory workplace rules for every business (Exs. 027-028). Jefferson Parish required masks in parish buildings from July 29 (12 CLS 2021, recited; Ex. 064) and on August 3, 2021 ordered every individual in unincorporated Jefferson Parish to wear a face covering indoors in any place outside a private residence, effective August 4 (13 CLS 2021, Ex. 063). Baton Rouge required masks in all City-Parish buildings from July 30, 2021 (Ex. 077) and the East Baton Rouge school system required masks for all K-12 students and staff from August 3 (Ex. 080). The 24th JDC moved criminal matters to videoconference and required rapid tests before transport from August 2 (Ex. 072). On August 12-13, 2021 New Orleans became the first Southern city to require proof of vaccination or a negative PCR test within 72 hours for entry to every restaurant, bar, brewery, gym, fitness class, indoor sports venue, concert hall, event space, casino, bowling alley and indoor amusement facility, effective 6:00 a.m. August 16, 2021 (Exs. 029-030), and on August 19 the Mayor ordered every City employee and every public-facing City contractor employee to be vaccinated or tested periodically from August 30, 2021 (LC 21-05, Ex. 032). The statewide mask mandate (137-JBE-2021, effective August 4, 2021) ran alongside these local orders through September 30, 2021 and beyond. Every one of the Q3 2021 instruments listed in q3_2021_in_force was in force on September 30, 2021; the City's October 29, 2021 guidelines (Ex. 031) carried the vaccination-or-test requirement into the fourth quarter. Louisiana did not preempt these local orders; the Governor's proclamations preserved local authority to impose stricter measures, and East Baton Rouge's order recites that the Governor 'has clarified that his plan to reopen Louisiana's economy includes maintaining the authority of local governments to require businesses to adopt and enforce... face covering requirements' (Ex. 073).

End of general restrictions

2021-05-28 (New Orleans); 2021-05-15 (Jefferson Parish); the statewide mask mandate ended April 28, 2021 (79-JBE-2021) and was reinstated August 4, 2021 (137-JBE-2021)

Instrument New Orleans: NOHD Guidelines for COVID-19 Reopening dated May 28, 2021 (Ex. MET-MSY-025), which kept gathering caps of 250 indoors and 500 outdoors and conditioned larger events on universal masking or proof of vaccination or a negative test; Jefferson Parish: Proclamation 8 CLS 2021 (May 15, 2021; Ex. 061), which ended the parish face-covering mandate except on public transit; East Baton Rouge: the parish followed the State's Phase 3 and the statewide mask mandate, and its own 'No Mask - No Service' order ran to Phase 3 (September 11, 2020) by its extension terms (Exs. 073-075)

What remained in force

In New Orleans after May 28, 2021: the March 11, 2020 state of emergency; the May 15, 2020 proclamation delegating force-of-law regulation to the Health Department; gathering caps of 250/500; mandatory safety requirements for all businesses (screening, distancing, sanitation, posting); masks on public conveyances, in government offices, in health-care facilities and in schools; then from July 31, 2021 the indoor mask mandate, from August 16, 2021 the vaccination-or-test entry requirement, and from August 30, 2021 the City-employee and contractor vaccination-or-testing rule. In Jefferson Parish after May 15, 2021: masks on public transportation and paratransit, the procurement suspension and the emergency itself; then from July 29, 2021 masks in parish buildings and from August 4, 2021 the parish-wide indoor mask requirement. In East Baton Rouge after May 2021: the parish-wide emergency; then from July 30, 2021 masks in all City-Parish buildings and from August 3, 2021 masks in all EBR public schools, alongside the statewide mandate from August 4, 2021.

The State and the local orders

Louisiana did not preempt or bar local COVID-19 orders at any time between March 2020 and September 30, 2021. The Governor's phase proclamations expressly preserved the authority of parishes and municipalities to impose more restrictive measures, and New Orleans exercised it continuously (declining to enter Phase Two with the State on June 5, 2020; keeping bars, gatherings and capacity below State levels through May 2021; reinstating masks July 31, 2021 before the State's August 4 mandate; imposing a vaccination-or-test entry requirement the State never adopted). Executive Order SWB 2020-07-01 recites the Governor's clarification that local governments retained authority to require businesses to adopt and enforce face-covering requirements (Ex. 073). Jefferson Parish's 10 CLS 2020 mask mandate preceded the statewide mandate by twelve days and was terminated by the Parish President, not by the State, on April 28, 2021 (Ex. 060). No injunction against any New Orleans, Jefferson Parish or East Baton Rouge COVID-19 instrument was located. The 2021 Regular Session bills to curtail gubernatorial emergency powers did not become law in the period; the State's emergency (25-JBE-2020 and renewals) ran through March 16, 2022.

Statewide LDH orders. New Orleans guidelines required face coverings in all health-care facilities, including physicians' offices, hospitals and long-term care facilities, in every version through Q3 2021 (Ex. 027).

Dental and elective health care

Governed statewide. Locally, health-care facilities were exempt from the New Orleans gathering ban (Ex. 002) but subject to the universal mask requirement in all health-care facilities in every NOHD guideline through Sept. 30, 2021 (Exs. 025, 027).
